AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE FIRST AMENDMENT TO THE CONSULTING SERVICES
AGREEMENT WITH TERRACON CONSULTANTS, INC., FOR CONSTRUCTION
MATERIAL TESTING SERVICES FOR THE PUBLIC SAFETY FACILITY PROJECT,
PHASES 2 AND 3;AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN
AMOUNT NOT TO EXCEED TWO HUNDRED ELEVEN THOUSAND FIVE
HUNDRED AND N01100 DOLLARS ($211,500.00); AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS:
Section 1: That the City Council of the City of Baytown,Texas,hereby authorizes and directs the
City Manager to execute the First Amendment to the Consulting Services Agreement with Terracon
Consultants, Inc., for construction material testing services associated with the Public Safety Facility
Project, Phases 2 and 3. A copy of the amendment is attached hereto,marked Exhibit"A," and made a part
hereof for all intents and purposes.
Section 2: That the City Council of the City of Baytown authorizes payment to Terracon
Consultants, Inc.,in an amount not to exceed TWO HUNDRED ELEVEN THOUSAND FIVE HUNDRED
AND NO.100 DOLLARS ($211,500.00) for construction material testing services in accordance with the
amendment authorized in Section 1 hereinabove.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.

Explanation:
This Amendment encompasses the following: The scope of work for the Public Safety Campus will be
expanded from Phase 1 which was in the original contract to include Phase 2 and 3. This project is being built
in phases and Phases 1 is towards the east(back) of the property. Phase 2 and 3 will include the rest of the
project to main. The scope that will added will include proof rolling operations, subgrade compaction,
gradation testing, density testing, testing of concrete placed for the driveway and foundations, and weld/bolt
inspections. This work includes certified field technicians and project oversight. The scope of the work
includes observation, testing and documentation of construction activities to maintain compliance assurance
with construction specifications

Consultant agrees to perform change(s) included in this Contract Amendment for the price and time indicated.
The prices for changes included all costs associated with this Contract Amendment.
No work is to be done until this Amendment is executed.No payment to the Consultant shall be made for work
included in the Amendment until this Amendment is executed.
Unless a different meaning clearly appears from the context,words and phrases as used in this Amendment, the
terms and phrases as used herein shall have the same meanings as in the Agreement. The provisions of this
Amendment and the Agreement and all previous amendments. if any,shall be read together and construed as one
agreement provided that, in the event of any conflict or inconsistency between the provisions of this Amendment
and the provisions of the Agreement and any previous amendment, the provisions of this Amendment shall
control This Amendment has been jointly negotiated by the parties hereunder and shall not be construed against
a party hereunder because that party may have assumed primary responsibility for the drafting of this Amendment.
By this Amendment, the City does not consent to litigation or suit, and the City hereby expressly revokes any
consent to litigation that it may have granted by the terms of this Amendment,the Agreement or any other contract
or agreement or addenda. any charter, or applicable state law. Nothing contained in this Amendment or in the
Agreement shall be construed in any way to limit or to waive the City's sovereign umnunity.
The persons executing this Agreement hereby represent that each party has the fiull power and authority to enter
into and perform pursuant to this Aruendrnent, and that each has been properly authorized and empowered to
enter into this Amendment.
Upon execution by all parties, the following changes identified for the Contract Value and/or Contract
Time shown, are made part of the Contract.

EXHIBIT "A"
SCOPE OF SERVICES
1. Earthwork:
Observe and document proof rolling operations for pavement and building subgrade.
Sample subgrade, backfill, select fill, and treated material. Prepare and test the
samples for classification by the Atterberg Limits, moisture density relationship, and -
200 sieve analysis.
Obtain samples of select fill during building pad placement to test Atterberg Limits.
Samples typically require two (2) working days for processing and testing in
accordance with ASTM Standards, however, preliminary test results can be obtained
within one (1) working day. It will be at the discretion of the contractor to suspend
placement of fill before test results are known.
Obtain samples of native subgrade for lime determination.
Perform on site gradation tests after final mix of lime stabilized subgrade.
Perform field density tests using the nuclear method to determine the moisture
content and percent compaction of the soils.
2. Drilled and Under-reamed Foundation System:
Observe the installation of the drilled under-reamed footing foundations. For each
pier observed, information regarding shaft depth, auger diameter, and chained
belling tool diameter will be documented. The chained belling tool diameter will be
measured when extended above ground for each bell size.
Record dimensions and the number, size, and length of vertical reinforcing bars used
for footings.
Obtain pocket penetrometer readings on soil cuttings removed during excavation at
or near the bearing stratum to document the approximate shear strength of the soil.
Sample the fresh concrete placed in footings and perform required tests, including
slump, air content, concrete temperature, and cast test specimens during
placements
3. Shallow Spread Footing Foundation System:
Record dimensions and the number, size, and length of vertical reinforcing bars used
for footings.
Obtain pocket penetrometer readings on soil cuttings removed during excavation at
or near the bearing stratum to document the approximate shear strength of the soil.
Sample the fresh concrete placed in footings and perform required tests, including
slump, air content, concrete temperature, and cast test specimens during
placements
4. Cast-In-Place Concrete (structures):
Sample the fresh concrete, perform required tests, including slump, air content,
concrete temperature, and cast test specimens during placements.
Perform compressive tests of concrete test cylinders cast in the field.
Consultant understands that the contractor will be responsible for maintaining the initial
curing temperature of the concrete test specimens. Consultant will record the initial
curing temperatures only when curing boxes are provided by the contractor.
5. Concrete (paving and misc. civil):
Sample the fresh concrete, perform required tests, including slump, air content,
concrete temperature, and cast test specimens during placements.
• Perform compressive tests of concrete test cylinders cast in the field.
• Consultant understands that the contractor will be responsible for maintaining the initial
curing temperature of the concrete test specimens. Consultant will record the initial
curing temperatures only when curing boxes are provided by the contractor.
6. Welded and Bolted Framing Connections:
Provide a certified welding inspector (CWI) at the job site to observe field welding
procedures and visually check bolted/welded connections in accordance with
applicable AISC and AWS specifications and Contract Documents. The approved
Shop Drawings will be required for this inspection.
7. Project Management:
Consultant will assign a project manager to this project, working directly with Ms. Noosha Smith,
PE. The project manager will serve as the daily contact for the Project Team. The Project
manager's responsibilities include:
Assigning and managing the technician(s) on site.
Coordinating field and laboratory testing.
Communicating with Consultant Engineering Technicians, Contractors, and Owner's
site representative.
Reviewing laboratory and field test reports and submitting reports to the City
approved distribution list.
Monitoring our budget, track cost due to retests and cancellations, and invoice,
monthly.
Consultant recommends that a copy of the scope of services in this Cost Estimate Letter be
provided to the general contractor, so they understand our scope of services and schedule us
accordingly. Please note that the number of tests and trips described in the Scope of Services
does not constitute a minimum or maximum number of tests or trips that may be required for
this project and are based solely on the contractors scheduling.
