Ordinance No. 15,054 ORDINANCE NO. 15,054 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE FIRST AMENDMENT TO THE MEET AND CONFER AGREEMENT WITH THE BAYTOWN MUNICIPAL POLICE ASSOCIATION, INC.; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ****************************************************************************** BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1: That the City Council of the City of Baytown, Texas, hereby authorizes the Mayor to execute and the City Clerk to attest to the First Amendment to the Meet and Confer Agreement with the Baytown Municipal Police Association, Inc. A copy of said amendment is attached hereto, marked Exhibit "A," and made a part hereof for all intents and purposes. Section 2: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown. STATE OF TEXAS § COUNTY OF HARRIS § This First Amendment("Amendment")to that certain Agreement between the City of Baytown, Texas and Baytown Municipal Police Association(collectively the"Parties")effective October 1,2019,is made by and between the same parties on the date hereinafter last specified. WITNESSETH: WHEREAS,the City of Baytown("City")and Baytown Municipal Police Association, ("Association")did enter into an Agreement through the process of Meet and Confer on September 11, 2019,effective October 1,2019,to achieve and maintain harmonious relations between the Parties related to working conditions and other conditions of employment in accordance with Subchapter B of Chapter 142 Texas Local Government Code and not deny local control by the City;and WHEREAS,the Parties agreed that the Internal Affairs Complaint Procedure issued on June 28, 2016 under Directive No.8PD-GO 08.03 would remain effective throughout the term of the Agreement; and WHEREAS,the Parties agree it is necessary and in the best interest to both Parties to modify the Internal Affairs Complaint Procedure policy to adjust for the new Police Chief's name in accordance with TMPCA Best Practices;and NOW THEREFORE,for and in consideration of the mutual covenants and agreements herein contained,the parties hereto do hereby mutually agree as follows: 1. The Internal Affairs Complaint Procedure policy, BPD-GO 08.03,will be revised to reflect the current Chief of Police and new effective date.
