The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday, May
13, 2021, at 6:31 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street,
Baytown, Texas with the following in attendance:

Mayor Capetillo convened the May 13, 2021, City Council Regular Meeting with a quorum
present at 6:31 P.M., all members were present.
Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Mike Lester.
1. MINUTES
a. Consider approving the minutes of the City Council Work Session and Regular
Meeting held on April S, 2021.
b. Consider approving the minutes of the City Council Work Session and Regular
Meeting held on April 22, 2021.
A motion was made by Council Member Alvarado and seconded by Council Member Charles
Johnson to approve the meeting minutes with regards to agenda items 1.a. and Lb., as submitted.

2. RECOGNITIONS AND CITIZEN COMMUNICATIONS
a. Present a proclamation designating May 16-22, 2021, as National Public Works
Week.
Mayor Capetillo presented a proclamation to the staff of Public Works and Engineering,
designating May 16`l' through the 22"d, 2021, as National Public Works Week.
b. Present a proclamation designating May 16-22, 2021, as Emergency Medical
Services Week.
Mayor Capetillo presented a proclamation to Fire Chief Kenneth Dobson, designating May 16"'
through the 22"d, 2021, as Emergency Medical Services Week.
C. Present certificates of recognition to members of the Teen Round Table.
Library Director, Jamie Eustace presented the item and recognized the Teen Round Table
("TRT"), a group fonned to provide input on launching or relaunching the Youth Advisory
Commission "YAC". The group was led by teen librarian extraordinaire, Katie Beverly and
supported by Community Engagement Coordinator, Sabrina Martin. Ms. Eustace stated that
since January, the group met twice a month and provided ideas on how to better engage the
youth.
Additionally, Mayor Capetillo presented certificates to the members of the TRT present at the
meeting.
d. Recognition of Ms. Alice Jauregui for her role as Interim Public Affairs Director.
City Manager Rick Davis presented an award to Ms. Alice Jauregui, who served as the Interim
Public Affairs Director from May 2020 to April 2021, and also expressed appreciation of her
efforts and expertise in handling all of the important issues during the past year.
3. VOLUNTARY ANNEXATION OF APPROXIMATELY 71.66 ACRES
a. Conduct a second public hearing regarding the proposed annexation of
approximately 71.66 acres consisting of approximately 69.50 acres of land, legally
described as Tract 37A-5, Abstract 21, G. Ellis Survey, Baytown, Harris County, Texas.
At 6:47 P.M., Mayor Capetillo opened and conducted the second public hearing regarding the

proposed annexation of approximately 71.66 acres consisting of approximately 69.50 acres of
land, legally described as Tract 37A-5, Abstract 21, G. Ellis Survey, Baytown, Harris County,

Texas, along with approximately 2.16 acres being the entire width of N. Main Street right-of-
way extending northwards approximately 1335.01 feet from the current city limits.
Director of Planning and Development Services, Martin Scribner presented a summary of the
second public hearing regarding agenda item 3.a. He stated that the annexation and the rezoning
that accompanied it was to allow Castle Rock Communities to develop a residential project with
266 single-family homes. He noted that the services agreement was adopted at the first public
hearing held last month and the second public hearing for the rezoning of the property was
expected to be held at the Planning and Zoning Commission meeting next week then go before
Council next month.
With there being no one registered to speak regarding agenda item 3.a., Mayor Capetillo closed
the public hearing at 6:48 P.M.
b. Consider an ordinance for the first reading of the proposed annexation of
approximately 71.66 acres consisting of approximately 69.50 acres of land, legally
described as Tract 37A-5, Abstract 21, G. Ellis Survey, Baytown, Harris County, Texas,
along with approximately 2.16 acres being the entire width of N. Main Street right-of-way
extending northwards approximately 1335.01 feet from the current city limits.
A motion was made by Mayor Pro Tem Heather Betancourth and seconded by Council Member
Charles Johnson to approve Ordinance No. 14,717, related to Item 3.b. The vote was as follows:

4. PROPOSED ORDINANCES
a. Consider an ordinance amending Chapter 98 "Utilities," Article IV "Sewer
Service," Section 98-94 "Tapping fees," Subsection (a) of the Code of Ordinances,
Baytown, Texas, to standardize the sanitary sewer tap fees.
Director of Public Works and Engineering, Frank Simoneaux presented the item and stated that
Ordinance No. 14,718 adjusted the City's sanitary sewer tap fees. He stated that current charges
were $600 for a short side tap, which is when the house is on the same side of the road as the
sewer main and $650 for a long side tap, which is when the house is on the opposite side of the
sewer main. He stated that this fee was last revised in 2010 and staff requested to implement a
$800 single fee to cover either long side or short side taps, as a single fee would be easier to
implement in the new software being developed for the permitting process. Additionally, he
noted that staff researched other cities for comparative purposes and recommended approval.
A motion was made by Council Member Charles Johnson and seconded by Council Member
Mike Lester to approve Ordinance No. 14,718, related to Item 4.a. The vote was as follows:

2013, TO EXPAND COUNCIL'S RULES OF PROCEDURE TO GOVERN
CONDUCT OF THE CITY COUNCIL WHEN ACTING IN AN OFFICIAL
CAPACITY; PROVIDING A REPEALING CLAUSE; CONTAINING A
SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
6. REPORTS
a. Receive the City of Baytown's Quarterly Financial and Investment Reports for the
Quarter Ending March 31, 2021.
Director of Finance, Victor Brownlees presented the item and stated that there was a change to
the format of the quarterly report that would provide Council with more insight of the city's
financial performance. Additionally, he provided Council with the City's quarterly financial and
investment reports for the period ending March 31, 2021.

Agenda item 7.c. was pulled from the consent agenda for discussion.

Council Member Mike Lester expressed his appreciation to City Management and the Public
Works and Engineering staff for their efforts in addressing some of the issues and concerns of
the citizens in the Bay Oaks Harbor neighborhood related to street maintenance.

8. APPOINTMENTS
a. Consider six (6) appointments to the Baytown Municipal Development District
(MDD).
b. Consider six (6) appointments to the Baytown Hospitality Public Facilities
Corporation (PFC).
Acting Deputy City Clerk, Raquel Martinez presented the items together and considered six
appointments to the MDD and the Baytown Hospitality Public Facilities Corporation, in which
the appointments were for two-year terms. She noted that there were two At -Large Resident
positions and further stated that Mr. David Jirrels and Mr. Gary Englert requested reappointment
and that Mayor Capetillo and Council Members Alvarado, Presley, and Johnson would continue
to serve on the board until such time as they cease to serve on City Council. Additionally, she
noted that the appointments were the same for both MDD and PFC, therefore, the items could be
considered together.
A motion was made by Council Member Chris Presley and seconded by Council Member
Charles Johnson to approve the reappointments of Mr. David Jirrels, At -Large Resident; Mr.

relates to Items 8.a. and 8.b. The vote was as follows:

9. MANAGER'S REPORT
a. The Annual Arts and Eats Fest is scheduled for Saturday, May 22nd from 4:00 P.M.
to 8:00 P.M. at Baytown Town Square located at 213 West Texas Avenue.
Assistant Director of Parks and Recreation, Clifford Hatch presented the item and extended an
invite to everyone to the Arts and Eats Festival scheduled for Saturday, May 22"d from 4:00 to
8:00 P.M. at Town Square. He mentioned that the Arts and Eats Festival, actually started as a
food truck festival then evolved into the Arts and Eats Festival. He stated that event would
include a stage perfonnance throughout the event by Gary Michael Dahl; chalk artists doing live
5 x 5 chalk murals; a speed painting artist, doing an hour of painting every hour starting at 4:30
P.M.; balloon artists; face painters; a car show; stilt walkers; and a live Asphalt Art Project.
City Manager Rick Davis presented recognition to various staff members and introduced the new
Public Affairs Director, Mr. Thomas Reeves.
10. EXECUTIVE SESSION
a. Recess into and conduct an executive session pursuant to Section 551.087 of the
Texas Government Code to deliberate the offer of a financial or other incentive to a
business prospect.
At 7:05 P.M., Mayor Capetillo recessed into and convened an executive session pursuant to
Section 551.071 of the Texas Government Code to deliberate the offer of a financial or other
incentive to a business prospect.
At 7:34 P.M. Mayor Capetillo reconvened the regular meeting and announced that in accordance
with Section 551.102 of the Texas Government Code, no action was taken in executive session.
