The Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Chris Presley. 1. MINUTES a. Consider approving the minutes of the City Council Work Session and Regular Meeting held on August 12, 2021. A motion was made by Council Member Charles Johnson and seconded Mayor Pro Tern Laura Alvarado to approve the meeting minutes of the City Council Work Session and Regular Meeting held on August 12, 2021, as submitted. RECOGNITIONS AND CITIZEN COMMUNICATIONS a. Consider a resolution accepting a grant from the Port of Houston 2021 Community Grant Program for the construction of the Chandler Arboretum Greenhouse. Mayor Capetillo had fonner Mayor Stephen Don Carlos and Port Commissioner come forward to present a check to Ms. Tracey Prothro and Mr. Cornell Gordon from the Parks and Recreation Department. They also took photos with other members of the staff and Council. Commissioner Don Carlos noted that he represents all of the cities located in Harris County on the Port Commission, which is about 31 cities. He provided a brief summary of the Port of Houston's 2021 Community Grants Program, which is aimed at projects and programs that enhance our communities, and they try to focus on community improvements, beautification, environmental projects, and workforce development. Commissioner Don Carlos further noted that the donation that the Port of Houston is making to the City is for $50,000, and he is glad to report that that is the largest grant out of the program for this cycle; therefore, they should be very proud of Tracey Prothro and the program that the City is fostering, since the new Arboretum is going to be a beautiful addition to the City's Park System. The proceeds from the donation is to be used for the greenhouse project, which is truly a worthy project that fits directly into the goals of their program. Commissioner Don Carlos encouraged the City and Parks Department to continue to bring projects to the Port for funding as they want to help all the communities that deal with the Port and want to be supportive and to really encourage environmental investment by our Cities. A motion was made by Council Member Charles Johnson and seconded Council Member Chris Presley to approve Resolution No. 2746, related to Item 2.a. City Council Regular Meeting Minutes September 9, 2021 Page 3 of 17 3. PROPOSED LIMITED PURPOSE ANNEXATION OF APPROXIMATELY 514.39 ACRES NORTH OF E. WALLISVILLE AND WEST OF GARTH RD. a. Conduct the first public hearing regarding the proposed limited purpose annexation of approximately 514.39 acres, located generally North of East Wallisville Road and West of Garth Road. Director of Planning and Development Services Martin Scribner summarized the subject of the public hearing regarding agenda item 3.a., which is for a Limited Purpose Annexation ("LPA"), for the Friendswood Development that will have roughly a total of 2,000 homes. Mr. Scribner noted that this is part of a development agreement that was approved in 2018, which there was a Strategic Partnership Agreement and a Municipal Utility District developed as part of that, and this LPA is just the next step in that development agreement. With there being no one registered to speak regarding agenda item 3.a., Mayor Capetillo closed the public hearing at 6:42 P.M. 4. PROPOSED ANNEXATION OF APPROXIMATELY 23.39 ACRES ALONG THOMPSON RD, NORTH OF ELLIS SCHOOL RD. a. Conduct a first public hearing regarding the proposed annexation of approximately 23.39 acres of land in Harris County, Texas, including 20.82 acres of privately -owned land along Thompson Road North of Ellis School Road, along with approximately 2.57 acres being the entire width of Thompson Road right-of-way extending North approximately 1,879 feet from the current city limits to the northern end of the subject property. At 6:42 P.M., Mayor Capetillo opened and conducted the public hearing regarding the proposed annexation of approximately 23.39 acres of land in Harris County, Texas, including 20.82 acres of privately -owned land along Thompson Road North of Ellis School Road, along with approximately 2.57 acres being the entire width of Thompson Road right-of-way extending North approximately 1,879 feet from the current city limits to the northern end of the subject property. Director of Planning and Development Services Martin Scribner summarized the subject of the public hearing regarding agenda item 4.a., and noted that the properties are also being rezoned to General Commercial to allow for about 250,000 square feet of warehouse and office, which is going through the process concurrently with this annexation. Mayor Capetillo acknowledged that a representative of the developer, Mr. Jarrad Coulter, had signed up to speak; however, Mr. Coulter noted that he had no comments at this time. A motion was made by Council Member Charles Johnson and seconded by Council Member Heather Betancourth to approve Ordinance No. 14,823, related to Item 4.b. PROPOSED ANNEXATION OF APPROXIMATELY 59.25 ACRES AT SOUTHEAST SJOLANDER AND IH-10 a. Conduct a first public hearing regarding the proposed annexation of approximately 59.25 acres of land, located generally at the southeast intersection of Sjolander Road and Interstate 10. At 6:44 P.M., Mayor Capetillo opened and conducted the public hearing regarding the proposed annexation of approximately 59.25 acres of land, located generally at the southeast intersection of Sjolander Road and Interstate 10. Director of Planning and Development Services Martin Scribner summarized the subject of the public hearing regarding agenda item 5.a. and noted that staff had received a lot of questions regarding this proposed annexation and what is happening on parts of this property. As a clarification, Mr. Scribner noted that the East of this property was already zoned Light Industrial ("LI"), and currently has approximately 2.5 to 3 million square feet of Light Industrial City Council Regular Meeting Minutes September 9, 2021 Page 5 of 17 use. In its entirety, the subject property is almost 60 acres and the Eastern half is going to be added to the development, which is almost entirely going to be detention for the rest of the industrial use to the East. Mr. Scribner further noted that the rezoning of the property will come before Council once it completes the process with the Planning and Zoning Commission. However, the Western half that is being annexed has no development being proposed for that property at this time, but is being annexed concurrently with the Eastern half. With there being no one registered to speak regarding agenda item 5.a., Mayor Capetillo closed the public hearing at 6:46 P.M. b. Consider an ordinance authorizing a Service Agreement with CCFHPP Interest, LLC, concerning approximately 59.25 acres, legally described as Tracts 9C & 31, Abstract 4, William Bloodgood Survey, Baytown, Harris County, Texas. A motion was made by Council Member Jacob Powell and seconded by Council Member Mike Lester to approve Ordinance No. 14,824, related to Item 5.b. STORMWATER PROJECTS - PARTNERSHIP WITH HARRIS COUNTY a.. Consider an ordinance authorizing an Interlocal Agreement with Harris County Flood Control District for the West Texas Avenue Drainage Project. Director of Public Works and Engineering Frank Simoneaux presented the item and noted that this was an interlocal agreement with Harris County for the West Texas Avenue Drainage Project. The project includes the scope pictured on the snap presented, which is along West City Council Regular Meeting Minutes September 9, 2021 Page 6 of 17 Texas, West Defee, North Whiting, and North Jones. Mr. Simoneaux noted that the project will include upgrading the stone drainage system in this area, along with other utility street improvements, sidewalks and streetscape along West Texas. The estimated cost of the project is $4,491,847, which is proposed to be funded by the Community Development Block Grant through the General Land Office Partnership Grant from Harris County and the City of Baytown. He further noted that the City of Baytown is proposed to contribute $787,500; Harris County, $7101408; and CDBG $2,993,939; however, the City has not received the contract from GLO, at this time, but will be presented to the Council once it is received and the project will be on hold until such time. Mr. Simoneaux noted that staff recommended approval of this item. The vote was as follows: Ayes: Mayor Brandon Capetillo, Mayor Pro Tern Laura Alvarado, Council Member Charles Johnson, Council Member Chris Presley, Council Member Heather Betancourth, Council Member Jacob Powell, Council Member Mike Lester Nays: None Approved ORDINANCE NO. 141825 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AN INTERLOCAL AGREEMENT WITH HARRIS COUNTY FLOOD CONTROL DISTRICT FOR THE WEST TEXAS AVENUE DRAINAGE PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED SEVEN HUNDRED EIGHTY-SEVEN THOUSAND FIVE HUNDRED AND NO/100 DOLLARS ($787,500.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. b. Consider an ordinance authorizing an Interlocal Agreement with Harris County Flood Control District for the West Baytown Drainage Project. Director of Public Works and Engineering Frank Simoneaux presented the item and noted that this was an interlocal agreement with Harris County for the West Baytown Drainage Project. It is the first phase of drainage work in West Baytown, and includes a trunk sewer system along Oklahoma Street and it extends from Minnesota straight to the Bay, as shown on the map presented. He noted the estimated cost of the project is $7,100,000 and it will also include utilities, street improvements, and sidewalks. Harris County will contribute $2,943,536; however, the cost for drainage -related items will be shared equally between Harris County and the City. The City will contribute $4,156,474 and will cover the cost of the non -drainage items in whole, which includes the streets sidewalks, and other utilities; therefore, Mr. Simoneaux noted that staff recommended approval of this item. PROPOSED ORDINANCES a. Consider an ordinance amending Chapter 98 "Utilities," Article III "Water Service," Section 98-59 "Rates," Subsection (a) and Article IV "Sewer Service," Section 98-91, Sewer Service Charge" of the Code of Ordinances, Baytown, Texas, to update rates for users outside the city limits. Assistant City Manager Nick Woolery presented the item and noted that it was actually a follow- up on what the Council adopted a couple of months ago, and they wanted to make sure that the Out -of -City Rate was what it should be and that it is a fair rate. Currently, they are charged 150% of the In -City rate, but this will actually lower it to 120% of the In -City rate. It is in alignment with what the City's consultant recommended during the rate study and in reviewing what other cities do for their Out -of -City rates as well. He noted that staff recommended approval at this time. Consider an ordinance adopting the tax rate for General Fund Maintenance and Operations at $0.48931 per $100 valuation for the fiscal year ending September 30, 2021, and adopting the tax rate for Debt Service at $0.29569 per $100 for the fiscal year ending September 30, 2022. Finance Director Victor Brownlees noted that this adoption of the tax rate for General Fund Maintenance and Operations as well as for Debt Service will provide a combined tax rate of 78.5 cents, which is a reduction in the current year from 79.15 cents, and staff recommended approval. PROPOSED RESOLUTION a. Consider a resolution granting consent to the inclusion of 0.9414 acres out of the George Ellis League, A-21, in Harris County, Texas, being located South of Wallisville Road, East of Garth Road, North of I-10 and West of N. Main Street, into Spring Meadows Municipal Utility District. City Attorney Karen Horner presented the item and noted that the requirement in order to be able to annex property into its territory, is that they have to get the consent of the City since it is located in its ETJ. She noted that the consent is contingent on the normal things as far as bonds and different things of that nature, and it also is contingent upon them entering into a Strategic Partnership Agreement with the City, which will be brought to Council hopefully very soon. APPOINTMENTS a. Consider confirmation of the City Manager's appointment of the City Clerk. Acting City Manager Kevin Troller presented the item and noted that Ms. Angela Jackson was the best qualified and the best fit for the City Clerk position. He acknowledged that Ms. Jackson's husband, Stefan, and her father, Mr. Earl Lowry were also present at the meeting. Mr. Troller proceeded to provide a brief biography of Ms. Jackson by noting that she was born in Milwaukee, Wisconsin, raised in McComb, Mississippi, lived a while in Slidell, Louisiana. She has over 30 years of experience in all phases of office administration and management. She started working for the City part-time in July of 2015 and was permanently hired in November of 2015 and went through a series of promotions because she earned it. She was a Records Supervisor, Deputy City Clerk, and in March of this year, she became the Acting City Clerk. Mr. Troller further noted that Ms. Jackson had been married to Stefan Jackson for 35 years. They have two amazing children, Tiffany and Chris, and six precious grandchildren. They could not be City Council Regular Meeting Minutes September 9, 2021 Page 16 of 17 any prouder of Ms. Angela Jackson and staff would ask Council to confine that appointment. A motion was made by Mayor Pro Tern Laura Alvarado and seconded by Council Member Chris Presley to confine the City Manager's appointment of Ms. Angela Jackson as City Clerk. MANAGER'S REPORT Acting City Manager Kevin Troller noted that he wanted to bring three items forward in his report tonight. First of all, he always appreciates it when people take the time and effort to write letters to the City and thank our employees. They received a letter from Dr. Demetrius McCall, with Goose Creek CISD, who talked about a series of months and meetings with the City on capital improvement projects and people in the City that have gone above and beyond, which include in the Planning Department, Martin Scribner, Nathan Dietrich, RJ Davison, and Zachary Stark, to Engineering, Mr. Matt Johnson, and in Fire, Fred Spencer and Lieutenant Victor Medina. We thank GCCISD for taking the time to write a letter to really appreciate the work our staff has done with theirs. Secondly, Mr. Troller noted that staff does a really good job, and they at least try to thank city employees throughout the Departments for everything that they do. There is a lot of time and effort and awful a lot of things that go on behind the scenes to get ready for Council meetings and to try and support you all the way that we do. He'd like to take tonight, to thank some of the people here that go above and beyond helping Rick, supporting Rick, and supporting Council, which includes our City Clerk, Angie; our City Attorney, Karen; our Assistant City Manager, Nick; and our Assistant to the City Manager, Brian, as they rarely stop and thank the people that are up here, but they really appreciate all that they do and they could not do it without you all. Lastly, Mr. Troller noted he was looking forward to Saturday, which would be the 20th anniversary of 9/11, and he is very appreciative across the City as there are a lot of events that will take place, but he just wanted to take a second before talking about our event in the City, to look back 20 years at the four coordinated terrorist attacks: American Airlines Flight 11 in the World Trade Center hit the first Tower at 8:46 in the morning, United Airlines Flight 175 hit the second tower at 9:03 in the morning, American Airlines Flight 77 hit the Pentagon at 9:37 in the morning, and United Airlines Flight 93 crashed in Shanksville, Pennsylvania at 10:03 because of the historic and Herculean efforts of people on that plane. In all, he noted that there were 2,977 fatalities, over 25,000 injuries, 10 billion dollars in infrastructure and property damage, the deadliest terrorist attack in history, and the single deadliest incident for firefighters and law City Council Regular Meeting Minutes September 9, 2021 Page 17 of 17 enforcement losing 340 and 72, respectively. He believes that is a day that we should never forget, being attacked on our soil, and so he was thankful for everyone that was having remembrance ceremonies this week and he wanted to inform them of the City Ceremony, which would be held on Saturday, September 1 lth, at 8:30 in the morning at the Firefighter Memorial. Mr. Troller encouraged anybody that could, to come out to do that as they would love to see many people there Saturday and remembering a day, that all of us should never forget. 12. a.
