The Pledge of Allegiance, Texas Pledge, and Invocation was led by Mayor Pro Tern Laura Alvarado. 1. MINUTES a. Consider approving the minutes of the City Council Work Session and Regular Meeting held on July 22, 2021. A motion was made by Council Member Charles Johnson and seconded Mayor Pro Tern Laura Alvarado to approve the meeting minutes of the City Council Work Session and Regular Meeting held on July 22, 2021, as submitted. RECOGNITIONS AND CITIZEN COMMUNICATIONS a. Recognize the Baytown Engage Civic Academy participants. Mayor Capetillo noted that a citizen had signed up to speak on this item and had her come forward to present her comments. Dr. Victoria Marron noted that she is a lifelong Baytown resident, and wanted to clarify for the record that she was not speaking on behalf of her employers, but wanted to take this opportunity to thank the Baytown Engage Civic Academy for all the work that they have done. Library Director Jamie Eustace presented the item and stated that it was an honor to present to Council some of the members of the first -ever Baytown Civic Academy. The group first got together back in May, and since then, they have been busy learning about municipal government and touring behind the scenes. They have been fortunate enough to meet with all levels of City of Baytown employees, including the Mayor, the City Manager, and both Assistant City Managers. Ms. Eustace noted some of the things they were able to experience and participate in, which included a tour the Fire Training Field, the 911 Center, viewed the inside of a SWAT vehicle, played with some of the big equipment at the Public Works Yard, planned a park event, and volunteered at a Hearts and Hands event. On behalf of Sabrina, Lesley, and herself, she thanked everybody in the organization that made these experiences come to life as without their support, it would not have come into fruition. Ms. Eustace asked Mayor Capetillo to present certificates to the members of the Baytown Engage Civic Academy that were present, out of a total of seventeen participants. As Ms. Eustace proceeded to call the members' names, they came forward to accept their certificate and took a photo with the Mayor. The members then took a group photo with all of Council. A few of the members came forward to address Council, which included Ms. Rhonda Lopez, Phylicia Barnes, Marga Matthews, and Lillian Sockwell. City Council Regular Meeting Minutes August 26, 2021 Page 3 of 22 Mayor Capetillo provided closing comments and thanked the current graduates of the Baytown Engage Civic Academy for their service and asked them to spread the word as they are receiving applications from citizens at this time for a second group in the Fall 2021. He noted that Council is very proud of the dedicated City employees and glad that the members of the Academy had the opportunity to gain a better understanding to see how the city operates. Assistant City Manager Nick Woolery complimented the Library staff: Jamie Eustace, Sabrina Martin, and Lesley Kohles, for putting so much time and dedication into the program. They had talked about this program in Baytown since 2010, and it has taken talented people, such as them, to actually put the program together and made it successful. He wanted to take this opportunity to thank them, as this is absolutely the best Civic Academy probably throughout the country, and it is due to Jamie, Sabrina, and Lesley. b. Recognize the City of Baytown Employees for their Years of Service. Human Resources Manager Lionel Williams presented the agenda item and recognized the City of Baytown employees for their years of service for the month of August. 5 YEAR Grey Scott, Human Resources Talent Development Manager Jason Stover, Police Patrol Office 10 YEAR Joshua Young, Fire Equipment Operator Maria Elena Garcia, Police Administrative Assistant Andrew Richter, Police Patrol Officer 15 YEAR Michelle Singleton, Library Administrative Assistant 20 YEAR Guadalupe Gonzalez, Police Patrol Officer 25 YEAR Shannon Hedger, Police Patrol Officer C. Receive and Discuss the 2020 - 2021 Baytown Parks and Recreation Annual Report. The Chairperson of the Parks and Recreation Board, Ms. Cannen Torres, noted that the Parks and Recreation had an excellent year and looked forward to doing even better the next year. She thanked all of the people that participated and the citizens, just as herself, that invest their time in making it possible for the citizens to enjoy all the beautiful parks in Baytown, such as the Baytown Nature Center. It is a beautiful place to visit and more people are becoming aware of the beauty that surrounds Baytown and the waterways that they are so fortunate to have, and stated that it was her pleasure to be the chairperson for this advisory committee. City Council Regular Meeting Minutes August 26, 2021 Page 4 of 22 Parks and Recreation Director Scott Johnson recognized the Parks staff that were present and noted that this was definitely a very different year for them as they had to cancel several events at the beginning of the year due to COVID-19, but went full speed ahead the second half of year and made it count, so overall, it was a great year. 3. AMENDMENTS TO THE LAND USE ASSUMPTIONS, CAPITAL IMPROVEMENTS PLAN AND IMPACT FEES a. Conduct a public hearing at 6:45 p.m. regarding amendments to the land use assumptions, the capital improvements plan, and the maximum allowable water and wastewater impact fees. At 6:52 P.M., Mayor Capetillo opened and conducted the public hearing regarding amendments to the land use assumptions, the capital improvements plan, and the maximum allowable water and wastewater impact fees. Director of Public Works and Engineering Frank Simoneaux summarized the subject of the public hearing regarding agenda item 3.a., and noted that they continue with the process of trying to implement a revised impact fee. He introduced Ms. Jennifer Ivey, with Carollo Engineers, who provided a brief presentation via Zoom. Ms. Ivey noted that the City is required to conduct a public hearing that allows the public the opportunity to provide comments on the recommendations, and then in the next agenda item, Council will be asked to vote on those recommendations and to vote on whether or not to adopt those impact fees that do not exceed the updated maximum impact fees from the study. With there being no one registered to speak regarding agenda item 3.a., Mayor Capetillo closed the public hearing at 6:58 P.M. b. Consider an ordinance approving amendments to the land use assumptions, the Capital Improvements Plan (CIP), and the maximum allowable water and wastewater impact fees. Finance Director Victor Brownlees noted that nothing had changed on the budget since the public hearing. Assistant City Manager Nick Woolery indicated that staff would recommend approval of the City of Baytown's Fiscal Year 2021-22 Budget with Exhibit A, of which a printed copy of it was at their place on the dais, that included some technical adjustments to the budget. A motion was made by Council Member Mike Lester and seconded by Council Member Charles Johnson to approve Ordinance No. 14,805, related to Item 6.b. However, there was further discussion prior to the vote. Council Member Presley inquired on the new contractor, CMC Development & Construction, as he had not heard of them before, and Assistant Director of Public Works and Engineering Andrea Brinkley clarified that they did perform a reference check with other public agencies, with Harris County being the largest public agency that they have done work for and they are satisfactory in their recommendation and their reference. Mayor Capetillo asked for a tentative date that they will begin construction on the project and Ms. Brinkley noted that they typically like to begin within 10 or 15 days of the approval of the contract, so the notice of receipt will be issued fairly quickly and it will be completed in about a year's time. Assistant City Manager Woolery indicated that Items 6.c. and 6.d., could be taken together as they relate to the same subject matter, which is the Strategic Plan for the Evergreen area and the Preliminary Engineering Report for West Main and Lee Drive, that were approved by the Municipal Development District at their last meeting. Staff recommends approval at this time. A motion was made by Council Member Mike Lester and seconded by Council Member Chris Presley to approve Items 6.c. and 6.d. ORDINANCE NO. 141807 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING A CONSULTING SERVICES AGREEMENT WITH KIMLEY-HORN AND ASSOCIATES, INC., FOR THE EVERGREEN STRATEGIC PLAN, LEE DRIVE PRELIMINARY ENGINEERING REPORT AND THE WEST MAIN STREET PRELIMINARY ENGINEERING REPORT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN AN AMOUNT NOT TO EXCEED FOUR HUNDRED NINETY-NINE THOUSAND EIGHT HUNDRED AND NO/100 DOLLARS ($499,800.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. C. Consider an ordinance granting Breckenridge Geophysical, LLC, a variance to Sections 62-5(1)(3) and 62-6 of the Code of Ordinances, Baytown, Texas, for dynoseis operations in Scott Bay. Fire Chief Kenneth Dobson provided a summarized report of the subject related to Item 6.e. He noted that Breckenridge Geophysical, LLC, had submitted an application for a pen -nit to conduct seismic testing within the city's jurisdiction and just outside the city limits in Scott Bay. He indicated that the seismic testing process utilizes sound waves to identify subsurface rock structures that may contain hydrocarbons. The two processes that they use to create the sound waves are dynoseis operations, which utilize dynamite to create the sound waves and vibroseis operations, which utilize vibration tracks. The Baytown Code of Ordinances prohibits dynoseis operations within the corporate limits of the city, and 5,000 feet outside such limits and the extraterritorial jurisdiction. Chief Dobson noted that the applicant would utilize the vibroseis operations to conduct the testing on land but is requesting a variance that would allow them to conduct the dynoseis operations in Scott Bay, and listed the four conditions that the City would require the applicant to follow if the variance is approved. Mayor Capetillo asked if it is outside the city's limits, how does it fall under the City's jurisdiction and City Attorney Karen Horner answered that the City has the right to regulate City Council Regular Meeting Minutes August 26, 2021 Page 11 of 22 nuisances within 5,000 feet of its existing city limit. Mayor Capetillo then had Mr. George Henderson, the applicant, to provide an overview of the extent of their operations in Scott Bay. Mr. Henderson introduced himself and provided a brief overview of the dynoseis operations proposed in Scott Bay, and answered the questions of the Council. However, in regards to Item 2 of the conditions required by the applicant, which stated, "The applicant should complete such an operation within 24 hours," they would require an extension of time from "24 hours" to "36 to 48 hours with exceptions for weather or equipment problems." He noted that the operations would take place during daylight hours between 9:00 a.m. to 6:00 p.m., because you cannot shoot dynamite at night in the state of Texas. City Attorney Karen Horner indicated that tonight Council is voting to grant a variance from the ordinance to be able to use the dynamite or explosives in the bay in order to move forward with the permitting process. The applicant will be sending out notifications to the homeowners in the surrounding area as required by City ordinance. Mr. Henderson noted that they plan to perform the dynoseis operations in Scott Bay around the second or third week in September, weather pennitting. A motion was made by Council Member Charles Johnson and seconded by Mayor Pro Tern Laura Alvarado to approve Ordinance No. 14,808, related to Item 6.e., which grants the variance with the amendment to extend the completion time to 36 hours, subject to unforeseen causes such as weather and equipment problems. Finance Director Brownlees presented the final certified values from both Harris County and Chambers County, and noted that the average appraisal values had gone up by 4.4% over the last year throughout the City. b. Receive the no -new revenue tax rate and voter -approval tax rate. Finance Director Brownlees indicated that the no -new revenue tax rate for the forthcoming year is 82.557 cents and the voter approval rate is 81.761 cents, however the budget that Council just adopted proposed a tax rate of 78.5 cents, which is significantly below the voter -approval rate. C. Receive the Baytown Police Advisory Committee's Quarterly Report to the City Council on its work and progress. Vice -Chairperson Eric Bolenbaucher provided a presentation to Council regarding the Baytown Police Advisory Committee's Quarterly Report on its work and progress. He noted that the Committee had held four (4) meetings this past quarter, participated in a use -of -force simulation training exercise at the Police Academy, toured and received an overview of Baytown's Public Safety and Emergency Communications facility, and participated in the interviews for the Police Chief. The Committee will focus on four areas — police outreach, community policing, officer training, and policy and procedures. Mr. Bolenbaucher indicated that they have held two public input sessions, and will continue to include an agenda item every meeting to create an opportunity for the citizens of Baytown to express their concerns and provide a voice to the community. He proceeded to provide the three primary subject areas that came to the forefront during the public hearing held on July 27"', which were: l) the importance of open dialogue, understanding culture and the diversity of the cultures that are in Baytown, and redefining public service in the schools and community, also hiring practices and community relations and involvement; 2) the need for officers to be physically fit as well as mentally fit and their need for training, care, and peer support along with mental fitness; and 3) the role of the Baytown Citizen Police Academy in educating the public on what the officers do and how to get more citizens involved. And I do believe that the Citizen's Police Academy is a vital part of understanding police operations. In order to reiterate the importance of mental health, Mr. Bolenbaucher indicated that one of the programs that Chief Holden and Lieutenant Steve Dorris have brought to their attention is the Clinician and Officer Remote Evaluation ("Core") Program from the Harris County Sheriffs Office, and proceeded to show a video put together by Harris County that gave a quick overview of this program. He noted that the Harris County Sheriff's Department had secured funding through a grant that would provide this resource to the officers in the City of Baytown in the Harris County jurisdiction. As of their last meeting, Ms. Horner informed them that they are just waiting on some of the legal components in the interlocal agreement with Harris County. However, they would like to encourage Council that once the final decision comes for them to approve the program, that they do so, as that would provide as many as twenty (20) iPads to be City Council Regular Meeting Minutes August 26, 2021 Page 13 of 22 issued to the patrol officers on various shifts throughout the city to be able to participate in the program. At this time, the Committee has also finalized the two decals for mental health awareness, one of which focuses specifically on autism, which he proceeded to show Council the final designs and noted that the white area of the sticker is going to be highly reflective. Further, the final aspect of this is not only just the decal, but is also going to be the self -reporting form that will have to be signed off by a mental health professional in order for these decals to be given out, and the forms will be available at various clinician offices throughout the City. Family members will be able to bring the forms to the Police Department on behalf of their loved one. Mayor Capetillo noted that one citizen had signed up to speak on this item, and proceeded to have her come forward to present her comments. Dr. Victoria Marron noted that in regards to the core program, she thinks it is really great and wanted to reiterate that she was one of those that spoke at the previous open forum conversations with the BPAC group. She thanked the Committee for all their work, and for supporting the mental health sticker and she was glad that it had finally come to fruition at this time. The other part that she wanted to share is that it can be very intimidating for the community to come in and talk to them in this type of setting in the Council Chamber. One of the things that they did in the first group was they met in the churches and other places in the community, in a more welcoming environment, so that it was not as intimidating. She asked the Baytown Police Advisory Committee to do the same in order to provide opportunity for more open dialogue and comfort for the community. Mayor Capetillo opened the floor for Council Members to provide comments and they asked questions in regards to the Core Program and its jurisdiction limitations, which Interim Chief Holden was able to answer. MANAGER'S REPORT a. Consider the confirmation of the City Manager's appointment of the Chief of Police. City Manager Rick Davis noted that he had never been a part of a process as extensive and inclusive as it was for the hiring of the Chief of Police, and although it was a difficult decision, he had many people, including the public, that helped him make the decision. He was proud to present Mr. John Stringer as his appointment of Chief of Police, who was also present at the meeting. Mayor Capetillo noted that one citizen had signed up to speak on this item, and proceeded to have her come forward to present her comments. Ms. Daryl James, a resident of Baytown, noted that she was standing before Council today to support the hiring of Mr. John Stringer and welcome his family to the City of Baytown. Although she had not had the opportunity to speak with Mr. Stringer, many of her family members, friends, and peers within law enforcement had, and the most consistent thing they said is that they believe that he presents his genuine self. It has been said that Mr. Stringer makes you feel like you are meeting a good neighbor, he is easygoing, and it makes you want to get to know him better. Mr. Stringer's conversation mirrors his resume in teens of implementing and heading programs that invest in his community. It is a reminder that diversity is people with different opinions and backgrounds and life experiences and how Mr. Stringer's character will promote new ideas and experiences that will benefit them all. Attitude is a direct reflection of leadership and Mr. Stringer's attitude will encourage many to embrace those ideas that will create an open dialogue. Ms. James further noted that they are looking forward to police and community relationships, and choose the word "relationship" because many of them do not require or desire to be policed. They are hopeful for an environment where more people understand their responsibility to the community because it takes all to promote a functional society. On behalf of those who are not able to be here this evening, they embrace Mr. Stringer and his family with the same open heart, spirit, and dialogue that he had the opportunity to meet and interact with during the interview process. He also thanked the men and women of the Baytown Police Department who have reached out to him, who have been so gracious and accepting, and in particular, the Command Staff and Mike Holden, who has been incredibly gracious to me. He has gone out of his way to provide me infonnation and offer help. He understands exactly how he feels because he has been there, but he promised this - he will always act with integrity, with honor, and everything that he does will be to support the mission of the Baytown Police Department. Everything they do will be on mission because, if the mission is successful, then we are successful, and what we do has to be about the mission and not about any one person or any one group of people, but it has to be about that mission of the Police Department. Ultimately, what that mission leads to is a higher better quality of life for the citizens that we take care of, the citizens that we work with, and the citizens that we protect. Mr. Stringer stated that is him in a nutshell, he is humbled, lie is honored, and he is thankful. He understands that he still has a lot of training that he has to do in order to get certified through Texas. He noted Texas is a very professional organization on this commission on law enforcement and was very impressed with it and wished he had come to Texas a long time ago in his career, so he was very excited to be here and cannot wait to get started. To Chief Holden, again, Mr. Stringer thanked him from the bottom of his heart. City Manager Davis echoed the sentiments of Mr. Stringer in regards to wishing he had come to Texas earlier in his career, but he also expressed his deep appreciation and respect for Chief Holden. Mr. Davis then presented kudos to several officers for achieving new certifications. He also touched base on staff monitoring Hurricane Ida snaking landfall and the possible activation of the EOC, but will continue to provide timely updates.
