2021 08 05 CC Minutes, SpecialMINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE CITY OF BAYTOWN August 5, 2021 The City Council of the City of Baytown, Texas, met in a Special Meeting on Thursday, August 5, 2021, at 5:30 P.M. in the Council Chamber of the Baytown City Hall, 2401 Market Street, Baytown, Texas with the following in attendance: Laura Alvarado Mayor Pro Tern Chris Presley Council Member Charles Johnson Council Member Heather Betancourth Council Member Mike Lester Council Member Rick Davis City Manager Karen Homer City Attorney Angela Jackson Acting City Clerk Mike Holden Interim Sergeant at Arms Mayor Pro Tern Laura Alvarado convened the August 5, 2021, City Council Special Meeting with a quorum present at 5:33 P.M., all members were present with the exception of Mayor Brandon Capetillo and Council Member Jacob Powell. Due to the COVID 19 Disaster the meeting allowed for two-way communications for members of the public who were not allowed to be physically present at this meeting. 1. PROPOSED RESOLUTIONS a. Consider a resolution granting the consent for the inclusion of an additional 0.3867 acres within the extraterritorial jurisdiction of the City of Baytown into Spring Meadows Municipal Utility District. City Attorney Karen Horner presented the item and noted that the City received a petition for an annexation into the Spring Meadows Municipal Utility District ("MUD"). It is part of the property that is being developed adjacent to it as a hotel and grants their consent to be able to go into the MUD and receive utilities from the MUD. Ms. Homer further noted that the City is working on a Strategic Partnership Agreement with Spring Meadows MUD and this is one of the conditions of this annexation or consent to annexation. A motion was made by Council Member Charles Johnson, and seconded by Council Member Chris Presley to approve Resolution No. 2,737, related to item La. The vote was as follows: Ayes: Mayor Pro Tern Laura Alvarado, Council Member Chris Presley, Council Member Charles Johnson, Council Member Heather Betancourth, Council Member Mike Lester City Council Special Meeting Minutes August 5, 2021 Page 2 of 4 Nays: None Other: Mayor Brandon Capetillo (Absent) and Council Member Jacob Powell (Absent) Approved RESOLUTION NO. 21737 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, GRANTING CONSENT TO THE INCLUSION OF 0.3867 ACRES WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF BAYTOWN INTO SPRING MEADOWS MUNICIPAL UTILITY DISTRICT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 2. MUNICIPAL BUDGET FISCAL YEAR 2021-22 a. Consider a resolution setting two budget work sessions to discuss the Fiscal Year 2021-22 Municipal Budget. Director of Finance Victor Brownlees presented the item and noted that at the July 22" d Council meeting they had a discussion as to when Council would like to schedule two budget work sessions. Council agreed to hold the two budget work sessions after the public hearing scheduled for Thursday, August 12"', and the preferred dates were for Wednesday, August IV', at 5:30 P.M., and Thursday, August 19`" at 4:00 P.M, if needed. A motion was made by Council Member Heather Betancourth, and seconded by Council Member Chris Presley to approve Resolution No. 2,738, related to item 2.a. The vote was as follows: Ayes: Mayor Pro Tern Laura Alvarado, Council Member Chris Presley, Council Member Charles Johnson, Council Member Heather Betancourth, Council Member Mike Lester Nays: None Other: Mayor Brandon Capetillo (Absent) and Council Member Jacob Powell (Absent) Approved RESOLUTION NO. 21738 City Council Special Meeting Minutes August 5, 2021 Page 3 of 4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CALLING TWO (2) SPECIAL COUNCIL MEETINGS TO BE HELD ON AUGUST 18, 2021, BEGINNING AT 5:30 P.M., AND AUGUST 19, 2021, BEGINNING AT 4:00 P.M., IN THE COUNCIL CHAMBER OF CITY HALL OF THE CITY OF BAYTOWN; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 3. EXECUTIVE SESSION a. Recess into and conduct an executive session pursuant to Sections 551.071 of the Texas Government Code to seek the advice of the City's attorneys on legal matters related to the Baytown Hotel and Convention Center Project. Mayor Pro Tern Alvarado noted that no further discussion was needed regarding this item. 4. PROPOSED ORDINANCE a. Consider an ordinance approving documents related to the issuance of bonds and the Baytown Hotel and Convention Center Project, including a Ground Lease Agreement, a City Facilities Unit Lease Agreement, a Booking Agreement, a Marina Site Parking Agreement, an Interlocal Agreement, a Condominium Declaration, and Deed Restrictions. Mayor Pro Tern Alvarado noted that they removed the Deed Restrictions from the list of approving documents related to the issuance of bonds and the Baytown Hotel and Convention Center Project. A motion was made by Council Member Chris Presley, and seconded by Council Member Lester to approve Ordinance No. 14,786, related to item 4.a. The vote was as follows: Ayes: Mayor Pro Tern Laura Alvarado, Council Member Chris Presley, Council Member Charles Johnson, Council Member Heather Betancourth, Council Member Mike Lester Nays: None Other: Mayor Brandon Capetillo (Absent) and Council Member Jacob Powell (Absent) Approved ORDINANCE NO. 149786 City Council Special Meeting Minutes August 5, 2021 Page 4 of 4 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING A GROUND LEASE AGREEMENT, CITY FACILITIES UNIT LEASE AGREEMENT, BOOKING AGREEMENT, MARINA SITE PARKING AGREEMENT, INTERLOCAL AGREEMENT, AND A CONDOMINIUM DECLARATION, RELATING TO THE BAYTOWN HOTEL AND CONVENTION CENTER PROJECT; AUTHORIZING THE CITY MANAGER TO EXECUTE CERTAIN DOCUMENTS RELATED TO THE PROJECT; APPROVING OTHER MATTERS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 5. ADJOURN With there being no further business to discuss, a motion was made by Council Member Mike Lester, and seconded by Council Member Charles Johnson to adjourn the August 5, 2021, City Council Special Meeting at 5:39 P.M.
