The Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Heather Betancourth. 1. MINUTES a. Consider approving the minutes of the City Council Work Session and Regular Meeting held on June 10, 2021. A motion was made by Mayor Pro Tern Laura Alvarado and seconded Council Member Charles Johnson to approve the meeting minutes of the City Council Work Session and Regular Meeting held on June 10, 2021, as submitted. REZONING OF APPROXIMATELY 13.32 ACRES NORTH OF BLUE HERON AND EAST OF BARKULOO a. Conduct a public hearing concerning a request to amend the official zoning map to rezone approximately 13.32 acres generally located north of Blue Heron Pkwy and approximately 1200 feet east of Barkuloo Road from an Open Space/Recreation (OR) Zoning District to a Medium Density Mixed Residential (MFI) Zoning District. At 6:32 P.M., Mayor Capetillo opened and conducted the public hearing concerning a request to amend the official zoning map to rezone approximately 13.32 acres generally located north of Blue Heron Pkwy and approximately 1200 feet east of Barkuloo Road from an Open Space/Recreation (OR) Zoning District to a Medium Density Mixed Residential (MF 1) Zoning District. Director of Planning and Development Services Martin Scribner summarized the subject of the public hearing regarding agenda item 2.a., which is to rezone approximately 13 acres from OR to MFI, located on Blue Heron Parkway about 1,200 feet east of Barkuloo Road adjacent to the David Crockett Elementary School. He noted on the map presented that the area nearby to the subject property is zoned mostly OR and is surrounded by unincorporated areas that are either vacant or Low -Density Residential. He stated that the development will consist of 126 one-story Senior Living Multifamily Units and noted that the staff review found that the proposal is generally consistent with the Comprehensive Plan and the Future Land Use Plan. Additionally, he stated that the Planning and Zoning Commission held public hearings pertaining to this item in May and June and recommended approval. The applicant and staff were available to answer questions. Mayor Capetillo had the two individuals that had signed up to speak to come forward to snake their comments. Mr. Patrick Petty, who lives just to the north of the subject property, stated that when the property was annexed, the owner applied for an MF2 zoning designation to develop an apartment complex, but it did not go through and since then, the owner made changes. He noted that several of the properties around them were residential homes on two acres minimum or a little less than that in size. Mr. Petty stated that in reading the 2025 Comprehensive Plan he read that when the City annexes property, it's with the reasoning to bring a focal point between old Baytown and the new Baytown, which is considered north of I-10 and we was not sure if the active senior living facility would be a good focal point, although they like it better than the apartment complex being that it would be single -story which would not overlook the neighboring homes. He also noted that their only concern was the uncertainty that if the property was rezoned to MFI, what else could be built there. Mayor Capetillo noted that he agreed that the single-family MF 1 designation was less intrusive, obviously to the neighbors. Mr. Gerald Grissom with BGE, the applicant, noted that he had only signed up to speak in case Council had any questions and had no further comments to make at the time. At 6:41 P.M., Mayor Capetillo opened and conducted the public hearing concerning a request for a Special Use Permit (SUP) to allow for a 130-foot tall monopole within 497.7 feet from property located within a Mid -rise Density Mixed Residential Dwellings (SF2) Zoning District City Council Regular Meeting Minutes July 8, 2021 Page 4 of 14 and an adjustment from the fall zone regulation(s) for a 60' x 60' leased area out of approximately 10 acres generally located south of Decker Drive and east of Avenue J. Director of Planning and Development Services Martin Scribner summarized the subject of the public hearing regarding agenda item 3.a. and noted that the applicant requested an adjustment to the fall zone regulations, which would only affect the utility lines along the northern property line. He noted that the building technology for this kind of tower has kind of evolved over the last couple of decades and were really designed now to collapse more downward rather than to just fall flat. Mr. Scribner indicated that there was also a requirement that the tower be located at least 525 feet from a single-family zoning district and as proposed this tower was about 27 feet short of that but the nearby SF2 district was currently vacant and is not believed that this variance from the requirement would cause any detriment to that property. He stated that the Planning and Zoning Commission held public hearings pertaining to this item in May and June and recommended approval with the adjustment to the fall zone requirements and the distancing requirements to the nearby SF2 District subject to the conditions listed in the staff report. IMPACT FEES a. Review and evaluate the current land use assumptions and receive update of the land use assumptions, capital improvements plan and impact fees. Director of Public Works and Engineering Frank Simoneaux presented the item to receive an update regarding the calculation of impact fees, including land use assumptions and the capital improvements plan used in those calculations. He then introduced Ms. Jennifer Ivey, Vice President of Carollo Engineers, who presented a summary of the impact fees. Ms. Ivey provided an overview of impact fees as it related to what they are, the calculations, and what they can be used for. She mentioned the three components of the study with the first one being the land use assumptions plan then discussed the Capital Improvements Plan followed by the calculation of the maximum allowable impact fees. Lastly, she gave an overview of a comparison to some other utilities in the area and how the proposed impact fees compared to those utilities. Consider an ordinance setting a public hearing to discuss and review the update of the land use assumptions, capital improvements plan and impact fees. Mayor Capetillo then took a point of privilege and stated that the agenda would be taken out of order to consider item 8.a., concerning the Baytown Animal Control Committee appointments. 8. APPOINTMENTS a. Consider the appointment of two (2) members to the Baytown Animal Control Advisory Committee. Chair of the Ad Hoc Committee, Laura Alvarado, presented the item and noted that as a result of their previous meeting, they respected the Council's voice and input to appoint a new representative to the Animal Welfare position. She stated that they also took the opportunity to place another candidate to fill the third spot of the Interested Citizen position, thus completing the Advisory Board. She further stated that they recommended to appoint Ms. Lou Sisk for the Animal Welfare Organization Representative and Mr. Alberto Contreras for the Interested Citizen position, who attended the meeting this evening. Council Member Johnson noted that the Ad Hoc Committee took this opportunity very seriously and thanked everyone who applied to serve on a committee, as well as, Council Member Alvarado and Council Member Betancourth. Additionally, he noted that the Animal Control Advisory Committee will set a great path going forward for animals and the safety of the citizens in the City of Baytown. City Council Regular Meeting Minutes July 8, 2021 Page 9 of 14 Mayor Capetillo noted that he would like the Ad Hoc Committee to stay intact until the bylaws and some other administrative actions were taken to ensure everything is intact with the Baytown Animal Advisory Committee and then they could decommission the Ad Hoc Committee. A motion was made by Mayor Pro Tern Laura Alvarado and seconded by Council Member Heather Betancourth to appoint Ms. Lou Sisk to the Animal Welfare Representative position, and Mr. Alberto Contreras to the third Interested Citizen position, on the Animal Control Advisory Board. PROPOSED ORDINANCES a. Consider an ordinance authorizing the First Amendment to the Development Agreement with Chambers County Municipal Utility District No. 3 Director of Planning and Development Services Martin Scribner summarized the subject of the agenda item 6.a., which is to amend the Development Agreement for the Heights of Baytown, a 223-acre mixed -use development in Chambers County in the City's ETJ, south of I-10 along the west side of State Highway 99. He stated that the development consisted of 565 single-family lots, 22 acres of multifamily units, and 35 acres of commercial use. He noted that although the original agreement was done about a year ago, the applicant requested the amendment to account for a change in their single-family home builder, which basically adjusted the configuration of the single-family lots, moved the location of the detention as it was proposed, raised the level of the landscaping requirements, and added more connectivity in the way of additional trails and sidewalks. He stated that the staff worked extensively with the applicant to ensure that the overall level of quality for this project is actually heightened by the amendment request and noted that staff recommended approval. Mayor Capetillo noted that two individuals had signed up to speak on this item that were connected via Zoom and requested they present their comments. (Zoom) Mr. Greg Clutter noted he was with Meritage Homes, the developer of the single-family lots. He provided an overview of the current configuration as it relates to the single-family residential development, the detention basin, and landscape requirements. MANAGER'S REPORT City Manager Rick Davis ceded some time to the Director of Parks and Recreation Scott Johnson to present item 9.a. a. The July Sunday Funday Pop Up Park will be held at Pelly Park. Mr. Scott Johnson noted that the July Sunday Funday Pop Up Park was scheduled to take place at Pelly Park and that the date was moved to Sunday, July 18"', due to inclement weather. City Manager Rick Davis then presented kudos to several staff members in Police, Public Works and Engineering, Parks and Recreation, and the Health Department. 10. CITY MANAGER'S PERFORMANCE EVALUATION a. Recess into and conduct an executive session pursuant to Texas Government Code, Section 551.074 to deliberate the annual performance evaluation of the City Manager. At 7:19 P.M., Mayor Capetillo recessed into and convened an executive session pursuant to Texas Government Code, Section 551.074 to deliberate the annual perfonnance evaluation of the City Manager. At 9:59 P.M. Mayor Capetillo reconvened the regular meeting and announced that in accordance with Section 551.102 of the Texas Government Code, no action was taken in the executive sessions. b. Discuss and take appropriate action regarding the City Manager's annual performance evaluation. City Council Regular Meeting Minutes July 8, 2021 Page 14 of 14 Council Member Presley noted that Council discussed with the City Manager that they would like to continue some discussions on certain aspects of his contract in the near future, and overall, as a whole was very pleased with Mr. Davis' performance. A motion was made by Council Member Chris Presley and seconded by Mayor Pro Tern Laura Alvarado that the City Manager's contract be extended for an additional year beyond the current term which expires in 2022 and that the City Manager receive a three percent increase in base salary.
