The Presentation of the Colors was led by the ROTC members from Robert E. Lee High School. The Pledge of Allegiance, Texas Pledge, and Invocation was led by Pastor Eric Bolenbaucher from The Pentecostals of Baytown and Volunteer Chaplain for the Baytown Police and Fire Departments. 1. MINUTES a. Consider approving the minutes of the City Council Work Session and Regular Meeting held on May 13, 2021. A motion was made by Council Member Jacob Powell and seconded by Council Member Charles Johnson to approve the meeting minutes of the City Council Work Session and Regular Meeting held on May 13, 2021, as submitted. Present a proclamation designating May as Motorcycle Safety Awareness Month in Baytown. Mayor Capetillo presented a proclamation designating May as Motorcycle Safety Awareness Month in Baytown to the Crianza Family, who lost their son, John Anthony Crianza II, in a motorcycle accident in June 2015, and to the Axemen, a group of firefighters and bike enthusiasts. Mayor Capetillo then took a point of privilege and stated that the agenda would be taken out of order to consider item 9.a., from the Manager's Report. 9. MANAGER'S REPORT a. Recognize the winner of the Goose Creek CISD Education Foundation's virtual fundraiser competition event, Singing with our Stars. Mayor Capetillo presented the item and introduced some of the representatives from Goose Creek CISD Education Foundation that were present, Executive Director Erika Foster, Mr. Jim Wadzinski and Ms. Gomez. Mr. Jim Wadzinski co -hosted the fundraiser competition event with Mayor Capetillo and summarized the mission and purpose of the Goose Creek CISD Education Foundation. He stated that the event raised over $79,500, which goes directly into the classrooms in Goose Creek ISD. He further presented a trophy to Council Member Charles Johnson and his sons, who were the winners of the Singing with our Stars virtual lip -syncing competition. Mayor Capetillo returned to the regular order of the agenda with item 3.a. 3. TAX ABATEMENT GUIDELINES AND CRITERIA a. Conduct a public hearing concerning the proposed adoption of guidelines and criteria governing tax abatement agreements by the City of Baytown. At 6:59 P.M., Mayor Capetillo opened and conducted the public hearing concerning the proposed adoption of guidelines and criteria governing tax abatement agreements by the City of Baytown. Assistant City Manager Nick Woolery summarized the subject of the public hearing regarding agenda item 3.a. and noted some of the proposed key changes to the guidelines and criteria governing tax abatement agreements, which is a tool, along with other economic development tools, that the City utilizes to attract new business, as well as, encourage reinvestment in existing businesses. With there being no one registered to speak regarding agenda item 3.a., Mayor Capetillo closed the public hearing at 6:59 P.M. b. Consider a resolution confirming that the City Council of the City of Baytown elects to become eligible to participate in tax abatement pursuant to the Property Redevelopment City Council Regular Meeting Minutes May 27, 2021 Page 4 of 15 and Tax Abatement Act and adopting guidelines and criteria for granting tax abatement in a reinvestment zone created in Harris and/or Chambers Counties. Assistant City Manager Nick Woolery noted that Mr. BJ Simon, President and CEO of the Baytown West Chambers County Economic Development Foundation, typically the first point of contact when businesses come in for these types of agreements, was available to answer any questions from Council and further stated that staff recommended approval of the agenda item. A motion was made by Mayor Pro Tern Heather Betancourth and seconded by Council Member Charles Johnson to approve Resolution No. 2,726, related to Item 3.b. The vote was as follows: Ayes: Mayor Brandon Capetillo, Council Member Laura Alvarado, Council Member Chris Presley, Council Member Charles Johnson, Mayor Pro Tern Heather Betancourth, Council Member Jacob Powell, Council Member Mike Lester Nays: None Approved RESOLUTION NO. 2,726 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ELECTING TO BECOME ELIGIBLE TO PARTICIPATE IN TAX ABATEMENT PURSUANT TO THE PROPERTY REDEVELOPMENT AND TAX ABATEMENT ACT; ADOPTING GUIDELINES AND CRITERIA FOR GRANTING TAX ABATEMENTS IN A REINVESTMENT ZONE CREATED IN HARRIS COUNTY OR CHAMBERS COUNTY; ADOPTING SUCH GUIDELINES AND CRITERIA; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 4. THE CROSSINGS AT BAYTOWN — PUBLIC IMPROVEMENT DISTRICT a. Consider an ordinance amending the official zoning map of the City of Baytown to rezone approximately 140.48 acres, generally located south of Interstate Highway 10 and east of Crosby Cedar Bayou Road, from Open Space/Recreation (OR) Zoning District to Livable Center (LC) Zoning District. Director of Planning and Development Services Martin Scribner presented the item and stated that the first part of the rezone was the map amendment from Open Space/Recreation to Livable Center, as shown on the reap presented, and the second was the designation of the planned unit development. He noted that although the two parts were presented together due to having the same subject matter, they would need to be considered with separate actions. Mr. Scribner noted that items 4.a. and 4.b., were directly related to the following three agenda items, 4.c. through 4.e., which dealt with the development agreement in the Public Improvement City Council Regular Meeting Minutes May 27, 2021 Page 5 of 15 District for a property of approximately 140 acres just south of I- 10, East of Crosby Cedar Bayou Road. On the concept map presented, he noted that the PID would allow for a mixed -use development that includes approximately 120 detached single-family homes, about 185 attached townhomes, 155 detached townhomes, around 350 multi -family units, and approximately 36 acres of commercial. Mr. Scribner further stated that public hearings were held at Planning and Zoning Commission meetings in February and March and the City Council held a public hearing on March 25th. He noted that the items were delayed for a couple of months to work out some of the PID and development agreement details. Additionally, he stated that the recommendation from the Planning and Zoning Commission on both items was for approval and that the applicant, as well as staff, were present to answer any questions. Consider an ordinance approving the detail plan to create The Crossings Planned Unit Development and amending the official zoning map to a Planned Unit Development (" PUD") overlay of approximately 140.48 acres, generally located south of Interstate Highway 10 and east of Crosby Cedar Bayou Road, for a proposed mixed -use project with single-family, attached and detached townhomes, multifamily, open space and commercial components. City Council Regular Meeting Minutes May 27, 2021 Page 6 of 15 A motion was made by Mayor Pro Tem Heather Betancourth and seconded by Council Member Charles Johnson to approve Ordinance No. 14,733, related to Item 4.b. Council Member Chris Presley inquired for clarity regarding this new development seeming to be located within a quarter of a mile of an existing multi -family development on Main Street, across the street, on the fact that Council had previously adopted an ordinance that had certain guidelines in respect to limiting multi -family developments within the City of Baytown, that included distance requirements between multi -family developments. Mr. Scribner and the Development Coordinator Bret Gardella, both indicated that as it pertains to the development agreements for Planned Unit Developments, although they do allow for multi -family development, the developer committed to higher standards that they nonnally would not have to adhere to per the City's nonnal regulations. City Manager Rick Davis encouraged Council to evaluate the entire project in the context of the other elements such as the elevated quality of the product and not solely by the distancing guidelines, and stated that the code indicates that it allows Council the discretion in these particular circumstances. Mr. Scribner assured Council that staff is fairly confident that due to the PUD regulations, it would dictate the higher product in order for the entire project to be financially feasible. CHAMBERS COUNTY IMPROVEMENT DISTRICT NO. 1 a. Consider a resolution expressing the City's intent to change the calculation of the outside -city utility rates for all customers outside the corporate limits of the City of Baytown. Assistant City Manager Nick Woolery presented the item and stated that this item allows for Council to provide guidance to staff on what the out -of -city multiplier should be set at, but in the future, they would bring Council the actual proposed rate ordinance, which would set the rates. Additionally, he stated that staff recommended approval of Council setting the out -of -city multiplier at 1.2. Consider an ordinance authorizing the Third Amendment to the Water Supply Agreement with Chambers County Improvement District No. 1. Assistant City Manager Nick Woolery presented the item and stated that there were five (5) key changes to the agreement from the previous agreement with Chambers County Improvement District No. 1, which consist of. 1) added capacity, 2) adjusted capacity criteria, 3) monthly service charge, 4) future water supply, and 5) the term extended to 2042, which happens to align with the payoff of BAWA's debt for the BAWA East expansion. Additionally, he stated that staff recommended approval. City Council Regular Meeting Minutes May 27, 2021 Page 10 of 15 6. REPORTS a. Receive the Baytown Police Advisory Committee (BPAC) First Quarterly Report to the City Council on its work and progress. Chairperson Raphael Montgomery of the Baytown Police Advisory Committee presented the agenda item and introduced the other committee members that were present: Pastor Eric Bolenbaucher, Dr. June Stansky, Dr. Marissa Moreno, and Mr. Richard Hunsinger. The committee members that were not present were Ms. Yolanda Braxton, Det. Rene Hinojosa, and Cpl. Steve Ocanas. Pastor Montgomery went through a slideshow presentation that provided a brief history on the Community Engagement Advisory Committee and presented the timeline on how it transitioned to the Baytown Police Advisory Committee in October 2020. He noted some of the activity and training that the Committee participated in to date, as well as, their four concerns, which consist o£ 1) Mental Illness, 2) Positive Engagement, 3) Transparency and Accountability, and 4) Training and Development. He stated that the Committee's number one priority was Mental Illness and indicated the three items that were discussed and supported by the BPAC. He stated that their request was for Council to support theirs in these measures and make the necessary arrangements for the following items to come to fruition, which include the: 1) Clinician and Officer Remote Evaluation ("CORE") Program, which consists of officers having an Wad that are connected to a mental health professional so when in a situation with someone who may be having a mental health issue, that a mental health professional could assist them during their engagement with the person. It would require for the City to obtain twenty (20) Wads, which costs about $9,000 per Wad and program training with the Harris Health System each year, however, there may be possible grant funding available from Harris County. 2) Project Guardian Decals, which is a universal decal that identifies individuals with autism and which families can choose to display in their homes and vehicles, however, the Committee is working with staff in creating a decal for all mental health illnesses that is specific to Baytown. 3) Database and Decal for All Mental Illnesses. They are trying to create a self -reporting or voluntary form, and creating a database that would continue to grow through the CORE program where decals for street checks, et cetera, so that our officers see these decals, would know that this is somebody that they may need to reach out to the mental crisis team to help with this situation. The Council commended the Committee for all of their efforts and agreed that mental health is an important issue that need to be focused on, especially since May is Mental Health Awareness Month, and further expressed their support in the various programs that the Committee would like for the City to partake in and bring to fruition. CITY OF BAYTOYVN, CAUSE NO. 20-0309, IN THE SUPREME COURT OF TEXAS, IN AN ADDITIONAL AMOUNT NOT TO EXCEED TWENTY-FIVE THOUSAND AND NO/100 DOLLARS ($25,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. b. APPOINTMENTS a. Consider one (1) appointment to the Baytown Construction Board of Adjustments and Appeals. City Council Regular Meeting Minutes May 27, 2021 Page 13 of 15 Acting City Clerk Angela Jackson presented the item and stated that this was a seven -member board with currently two vacancies. She stated that the City received one application for the Journeyman/Master Plumber position, from Mr. Shane Blackman, in which he met the minimum qualifications for the position and had over 24 years of experience in plumbing. Additionally, she stated that if appointed, Mr. Blackman would complete the unexpired term vacated by Mr. Garry Ruyle in April 2019, and would expire in April 2023. A motion was made by Council Member Charles Johnson and seconded by Mayor Pro Tem Heather Betancourth to appoint Mr. Shane Blackman to the Journeyman/Master Plumber position on the Construction Board of Adjustments and Appeals for the unexpired term, which is set to expire on April 30, 2023. She stated that the City received one application from Mr. Fredrick Harlow, if appointed, would serve for the unexpired term that would begin immediately and expire December 31, 2021. A motion was made by Council Member Jacob Powell and seconded by Council Member Chris Presley to approve the appointment of Mr. Fredrick Harlow to the Planning and Zoning Commission for the District 5 At -Large position for the unexpired term, which is set to expire on December 31, 2021. MANAGER'S REPORT City Manager Rick Davis ceded some time to Assistant Director of Parks and Recreation Clifford Hatch to present items 9.a. through 9.d. a. The June Sunday Funday Pop Up Park will be held at Bergeron Park. Mr. Hatch stated that the upcoming Sunday Funday Pop Up Park would be held on Sunday, June 6111, at Bergeron Park from 2:00 to 5:00 P.M. He stated that there would be a food truck, El Patron, free snow cones from Cone Ice, live perfonnances, a giant inflatable soccer dartboard, fishing demonstrations, and sidewalk chalk art. b. The Summer Meals in the Park program will begin on Monday, June 14, 2021, at five neighborhood parks and the Sterling Municipal Library. Mr. Hatch stated that this program was a partnership with Goose Creek CISD to feed children through the age of 18 all summer at no cost. He stated that the program would operate Monday through Friday from June 14th through July 30th, each day at one of the five neighborhood parks in the area along with the Sterling Municipal Library. For more information go to gccisd.net. C. The Annual Memorial Day Service will be held at the Veterans Memorial Plaza at Bicentennial Park, 1001 Market Street, on Monday, May 31, 2021, at 11:00 A.M. Mr. Hatch stated that the City partnered with the VFW Post 912 to host the Annual Memorial Day Service on Monday, May 31 s' at 11:00 A.M., at the Bicentennial Park, in which there would be a guest speaker, retired US Army Major Al McQueen. He further noted that in case of bad weather, the event would be moved to the Community Center for the same day and time. d. Pirates Bay Water Park and Calypso Cove will be open for the Memorial Day weekend. Lastly, Mr. Hatch stated that Pirates Bay would open for Memorial Day weekend from 10:00 A.M. to 7:00 P.M., on Saturday, Sunday, and Monday, and tickets ranged from $20 to $28, depending on your height. He stated that the Calypso Cove would have two sessions this year: 11:00 A.M. to 2:00 P.M. and 2:30 to 5:00 P.M. each day, and tickets were $5, regardless of your height. Additionally, he stated that both facilities would be open weekends only through June 12"' and since June 11 "' would be the last day of school for Goose Creek, both facilities would be opened 7 days a week until August 15"'.
