A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN AREA
WATER AUTHORITY SELECTING THE ALTERNATIVE DELIVERY METHOD
THAT WILL YIELD THE BEST VALUE TO THE BAYTOWN AREA WATER
AUTHORITY FOR THE CONSTRUCTION OF THE BAWA FILTER AIR SCOUR
IMPROVEMENTS PROJECT; AUTHORIZING THE ISSUANCE OF A REQUEST
FOR COMPETITIVE SEALED PROPOSALS; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
WHEREAS, Section 2269.056 of the Texas Government Code provides that before using a
construction delivery method other than competitive bidding, the Board of Directors of the Baytown Area
Water Authority ("BAWA") must determine which method provides the best value for BAWA; and
WHEREAS, the Board of Directors of the Baytown Area Water Authority believes that a
construction delivery method other than competitive bidding for the construction of the BAWA Filter Air
Scour Improvements Project will yield a better value to BAWA; and
WHEREAS, after considering each of the construction delivery methods, which are authorized in
Chapter 2269 of the Texas Government Code, the Board of Directors of the Baytown Area Water Authority
believes that the issuance of a request for competitive sealed proposals method will yield the best value;
NOW THEREFORE,
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA WATER
AUTHORITY:
Section 1: The recitals contained in the preamble of this resolution are true and correct and
are adopted as findings of the Board of Directors of the Baytown Area Water Authority.
Section 2: The Board of Directors of the Baytown Area Water Authority hereby detennines
that the competitive sealed proposal method will yield the best value to BAWA for the construction of the
BAWA Filter Air Scour Improvements Project and selects that alternative delivery method to be used for
such project.
Section 3: The Board of Directors of the Baytown Area Water Authority hereby authorizes
issuance of a request for competitive sealed proposals for construction of the BAWA Filter Air Scour
Improvements Project.
Section 4: This resolution shall take effect immediately from and after its passage by the
Board of Directors of the Baytown Area Water Authority.
