CCPD Resolution No. 27 RESOLUTION NO. 27 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT AUTHORIZING AND DIRECTING THE PRESIDENT TO EXECUTE AND THE SECRETARY TO ATTEST TO AMENDMENT NO.2 TO THE AGREEMENT FOR JAIL,TRAFFIC AND INVESTIGATION SERVICES AND JAIL AND COMMUNICATIONS IMPROVEMENTS WITH THE CITY OF BAYTOWN TO AUTHORIZE INCREASED FUNDING IN YEAR 4 TO PAY FOR THE CAPITAL OUTLAY FOR TI IE JAIL FACILITY AND RADIO SYSTEM FOR YEARS 5 THROUGH 10 IN THE AMOUNT OF FOUR MILLION FOUR HUNDRED EIGHTY-TWO THOUSAND ONE HUNDRED SEVENTY-TWO AND 501100 DOLLARS ($4,482,172.50); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ********************************************************************************* BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT: Section 1: That the Board of Directors of the Baytown Crime Control and Prevention District hereby authorizes and directs the President to execute and the Secretary to attest to Amendment No. 2 to the Agreement for Jail, Traffic and Investigation Services and Jail and Communications Improvements with the City of Baytown to authorize increased funding in year 4 to pay for the capital outlay for the jail facility and radio system for years 5 through 10 in the amount of "` FOUR MILLION FOUR HUNDRED EIGHTY-TWO THOUSAND ONE HUNDRED SEVENTY- TWO AND 501100 DOLLARS ($4,482,172.50). A copy of said Agreement is attached hereto, marked Exhibit"A," and made a part hereof for all intents and purposes. Section 2: This resolution shall take effect immediately from and after its passage by the Board of Directors of the Baytown Crime Control and Prevention District. For and in consideration of the mutual covenants and agreements herein contained,the parties hereto do hereby mutually agree as follows: I. Unless a different meaning clearly appears from the context,words and phrases as used in this Amendment shall have the same meanings as in the Agreement. Il. Section 5 "Funds to be provided by the District" is hereby amended, in part, to read as follows: For and in consideration of the services to be provided by the City in furtherance of the District's programs listed in Section 2, (d) and (e) of the Agreement For Jail,Traffic and Investigation Services and Jail and Communications Improvements approved by the District and the City on May 14, 1998,and amended on June 29, 2001, the District shall provide the following funds to the City in the amounts and for the programs hereinbelow listed: Description of' Yea r 4 Expenditure Capital Outlay Jail Facility $2 827,200 Radio System $2,408,356 Amendment No.2.Page 1 E=ff A `* IV. The provisions of this Amendment and the Agreement should be read together and construed as one agreement provided that,in the event of any conflict or inconsistency between the provisions of this Amendment and the provisions of the Agreement, the provisions of this Amendment shall control.
