A RESOLUTION CANVASSING THE RETURNS OF THE SPECIAL ELECTION
OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT HELD
WITHIN THE TERRITORY OF THE DISTRICT ON THE 2ND DAY OF
FEBRUARY, 2002; DECLARING THE RESULTS OF SAID ELECTION;
FINDING THAT NOTICE OF SAID ELECTION WAS PROPERLY HELD AND
THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN
ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS,pursuant to Chapter 67 of the Texas Election Code, the Board of Directors of
the Baytown Crime Control and Prevention District(the"Board"),at a meeting held on the 6`h day of
February,2002,proceeded,as required bylaw,to canvass the returns of the Baytown Crime Control
and Prevention District(the"District")special election held within the territory of the District on the
2nd day of February, 2002, for the purpose of deciding whether the Baytown Crime Control and
Prevention District should be continued for 10 years and the Crime Control and Prevention District
sales tax should be continued for 10 years; and
WHEREAS, the Board finds as follows:
(i) the District's special election was duly ordered and held pursuant to Resolution No.
22 and all applicable laws;
(ii) the election returns were duly made;
(iii) the Election Judges certified the results of the election, as hereinafter set out; and
(iv) the Board duly canvassed the returns of the election; and
WHEREAS,the Board further finds that the total votes cast at the special election to decide
whether the Baytown Crime Control and Prevention District should be continued for 10 years and the
Crime Control and Prevention District sales tax should be continued for 10 years as follows,to-wit:
PROPOSITION NO. 1
Whether the Baytown Crime Control and Prevention District should be continued for
10 years and the Crime Control and Prevention District sales tax should be continued
for 10 years.
For 578 votes
Against 712 votes
AND WHEREAS, the Board finds the election returns set out above to be accurate and
correct and no election protest or contest having been filed with said board or instituted in
connection with said election returns; NOW THEREFORE
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN CRIME
CONTROL AND PREVENTION DISTRICT:
Section 1: That a majority of the voles cast at the District's special election were not in
favor of continuing the District for 10 years nor continuing the Crime Control and Prevention
District sales tax for 10 years.
Section2: That the Board of the Baytown Crime Control and Prevention District further
finds that the notice of the election was duty and properly given as required by law and as provided
in the resolution calling the election and that the election was duly and regularly held and the returns
thereof duly and regularly made by the proper officials of said Election and in all things according to
law.
Section 3: This resolution shall take effect immediately from and after its passage by the
Board of the Baytown Crime Control and Prevention District.
INTRODUCED,READ and PASSED by the affirmative vote of the Board of the Baytown
Crime Control and Prevention District, this the 6"day of February, 2002.
