CCPD Resolution No. 18 RESOLUTION NO. 18 A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT AUTHORIZING AND DIRECTING THE PRESIDENT TO EXECUTE AND THE SECRETARY TO ATTEST TO AMENDMENT NO. 1 TO THE AGREEMENT FOR JAIL,TRAFFIC AND INVESTIGATION SERVICES AND JAIL AND COMMUNICATIONS IMPROVEMENTS WITH THE CITY OF BAYTOWN TO AUTHORIZE THE HIRING OF FIVE JAILER SUPERVISORS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. ifiititt!lttiprtWkrtt#rt#tittittttptWWWWWWkrtrtrtiiiii#tWt4Htiilggttlfitiipltirt#i BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT: Section 1: That the Board of Directors of the Baytown Crime Control and Prevention District hereby authorizes and directs the President to execute and the Secretary to attest to Amendment No. I to the Agreement for Jail, Traffic and Investigation Services and Jail and Communications Improvements with the City of Baytown to authorize the hiring of five jailer supervisors. A copy of said Agreement is attached hereto, marked Exhibit"A," and made a part hereof for all intents and purposes. Section 2: This resolution shall take effect immediately from and after its passage by the Board of Directors of the Baytown Crime Control and Prevention District. MITI, Secretary APPROVED AS TO FORM: 4M /^ eMACIO RAMIREZ, ., General Counsel • "klh27"oumiR imnccsWCPWma i4leilcn •''''i-� f',%S !. �� .s_ , ,.. ..- � -, of � � � � , AMENDMENT NO. 1 TO THE AGREEMENT FOR JAIL, TRAFFIC AND INVESTIGATION SERVICES AND JAIL AND COMMUNICATIONS IMPROVEMENTS STATE OF TEXAS § COUNTY OF HARRIS § This Amendment("Amendment")to that certain Agreement for Jail,Traffic and Investigation Services and Jail and Communications Improvements"by and between the CITY OF BAYTOWN, a municipal corporation located in Harris and Chambers Counties, Texas, (the "City,") and the BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT, a crime control and prevention district created under Chapter 363 of the Texas Local Government Code, located in Harris and Chambers Counties,Texas,(the"District"), is made by and between the same parties on the date hereinafter last specified. For and in consideration of the mutual covenants and agreements herein contained,the parties hereto do hereby mutually agree as follows: I. Unless a different meaning clearly appears from the context, words and phrases as used in this Amendment shall have the same meanings as in the Agreement. II. Section 2 "Description of Programs" is hereby amended, in part, to read as follows: The City, with the assistance of the District as herein specified, agrees to develop, organize and manage the following programs, including entering into and administering all contracts incident thereto: c) Jail Operations. This program will provide operating costs for the new jail and will create fourteen(14)new jail personnel positions in the City's police department,thus providing the needed personnel to better manage the current and expanded jail facilities. III. Section 5 "Funds to be provided by the District" is hereby amended, in part, to read as follows: EXHIBIT A Amendment No. 1, Page I For and in consideration of the services to be provided by the City in furtherance of the District's programs listed in Section 2, the District shall provide the following funds to the City in the amounts and for the programs hereinbelow listed: Description Expenditure O erations Jail Operations -- $381,100 1 $342,460 1 $586,420 1 $600,597 IV. The provisions of this Amendment and the Agreement should be read together and construed as one agreement provided that, in the event of any conflict or inconsistency between the provisions of this Amendment and the provisions of the Agreement, the provisions of this Amendment shall control.
