A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN
CRIME CONTROL AND PREVENTION DISTRICT ESTABLISHING THE
FISCAL YEAR FOR THE DISTRICT; SETTING FORTH PROCEDURES FOR
ADOPTING THE DISTRICT'S BUDGET; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN CRIME
CONTROL AND PREVENTION DISTRICT:
Section 1: The fiscal year of the Baytown Crime Control and Prevention District shall
begin on the first day of October and shall end on the last day of September of each calendar year.
Such fiscal year shall also constitute the budget and accounting year.
Section 2: The following are the procedures which shall govern the adoption of a budget
for the Baytown Crime Control and Prevention District (the "District ") by its Board of Directors (the
"Board "):
Public hearing before the Board required. Not later than the 15th day of the last
month of each fiscal year of the District, the Board shall hold a public hearing on the
proposed annual budget for the upcoming fiscal year.
b. Publication of time, date and place of public hearing. The Board shall publish notice
of the time, date and place of the public hearing on the proposed budget in a
newspaper with general circulation in the District not later than the seventh day
before the date of the hearing.
C. Public hearing before the Board held. At the public hearing conducted by the Board,
all residents of the District are entitled to be present and participate in the hearing.
d. Adoption of budget by the Board. After the public hearing on the proposed budget,
the Board shall adopt a budget for the upcoming fiscal year. The Board may make
any changes in the proposed budget that in its judgment the interests of the taxpayers
demand. Should the Board take no final action on or prior to the 15th day of the last
month of the then current fiscal year of the District, the budget as originally proposed
for the upcoming fiscal year shall be deemed to have been finally adopted by the
Board.
e. Submission of budget to the City Council of the City of Baytown. Within 10 days
after the budget is adopted or deemed adopted by the Board, the Board shall submit
the budget to the City Council of the City of Baytown, Texas (the "City Council ").
f. Public hearing before the City Council required. Not later than the 27`h day of the last
month of each fiscal year of the District, the City Council shall hold a public hearing
on the budget for the upcoming fiscal year adopted by the Board.
g. Publication of time, date and place of public hearing. The City Council shall publish
notice of the time, date and place of the public hearing on the budget adopted by the
District in a newspaper with general circulation in the District not later than the
seventh day before the date of the hearing.
h. Public hearing before the City Council held. At the public hearing conducted by the
City Council of the City of Baytown, all residents of the District are entitled to be
present and participate in the hearing.
Approval of budget by the City Council. After the public hearing on the District's
budget, the City Council shall approve or reject the budget submitted by the Board.
The City Council may not, on its own accord, amend the submitted budget. If the
City Council rejects the submitted budget, the City Council and the Board shall meet
and together amend and approve a budget for the District on or before the 27`h day of
the last month of the then current fiscal year of the District. Should the City Council
take no final action or otherwise fail to approve a budget for the District for the
upcoming fiscal year on or before the 27th day of the last month of the then current
fiscal year, the budget as originally submitted by the Board to the City Council for
the upcoming fiscal year shall be deemed to have been finally approved by the City
Council.
Amendment of the budget. The District's budget may be amended after the
beginning of the fiscal year on approval by the Board and the City Council.
Section 3: This resolution shall take cf ect immediately from and after its passage by the
Board of Directors of the Baytown Crime Control and Prevention District.
