CCPD Resolution No. 4Resolution No. 4 A RESOLUTION CANVASSING THE RETURNS OF THE CREATION AND TAX ELECTION OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT HELD WITHIN THE TERRITORY OF THE DISTRICT ON THE 17"' DAY OF JANUARY, 1998; DECLARING THE RESULTS OF SAID ELECTION; FINDING THAT NOTICE OF SAID ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. *********************************************** * * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** WHEREAS, pursuant to Chapter 67 of the Texas Election Code, the Temporary Board of the Baytown Crime Control and Prevention District (the "Board "), at a meeting held on the 22 "d day of January, 1998, proceeded, as required by law, to canvass the returns of the Baytown Crime Control and Prevention District (the "District ") held within the territory of the District on the 17`h day of January, 1998, for the purpose of creating the Baytown Crime Control and Prevention District, authorizing a one -half of one percent sales and use tax; and appointing the membership of the City Council of the City of Baytown as members of the Board of Directors of the District; and WHEREAS, the Board finds as follows: (i) District's creation and tax election was duly ordered and held pursuant to Resolution No. 3 and all applicable laws; (ii) the election returns were duly made; (iii) the Election Judges certified the results of the election, as hereinafter set out; and (iv) the Board duly canvassed the returns of the election; and WHEREAS, the Board further finds that the total votes cast at the creation and tax election were as follows, to -wit: PROPOSITION NO. 1 The creation of the Baytown Crime Control and Prevention District dedicated to crime reduction; the adoption of a proposed local sales and use tax at a rate of one -half percent (' /2 %); and the appointment of the Mayor and Council Members of the City of Baytown as the Board of Directors for the Baytown Crime Control and Prevention District. For 1,133 votes Against 371 votes AND WHEREAS, the Board finds the election returns set out above to be accurate and correct and no election protest or contest having been filed with said board or instituted in connection with said election returns; NOW THEREFORE 1 BE IT RESOLVED BY THE TEMPORARY BOARD OF DIRECTORS OF THE BAYTOWN CRIME CONTROL AND PREVENTION DISTRICT: Section 1: That a majority of the votes cast at the District's creation and tax election were in favor of creating the District; authorizing a one -half of one percent sales and use tax for the purpose of financing the District; and appointing the membership of the City Council of the City of Baytown as the Board of Directors of the District; therefore, the District is hereby created; the one - half of one percent sales and use tax is hereby authorized to be adopted by the City Council of the City of Baytown; and the members of the City Council may hereinafter be appointed by the City Council to serve as members of the Board of Directors of the District. Section 2: That the Temporary Board of the City of Baytown further funds that the notice of the election was duly and properly given as required by law and as provided in the resolution calling the election and that the election was duly and regularly held and the returns thereof duly and regularly made by the proper officials of said Election and in all things according to law. Section 3: This resolution shall take effect immediately from and after its passage by the Temporary Board of the Baytown Crime Control and Prevention District.
