A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN
AREA WATER AUTHORITY APPOINTING THE BAYTOWN PLANNING
AND ZONING COMMISSION AS THE BAYTOWN AREA WATER
AUTHORITY'S CAPITAL IMPROVEMENT ADVISORY COMMITTEE
PURSUANT TO SECTION 395.058 OF THE TEXAS LOCAL GOVERNMENT
CODE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, on July 21, 2021, the Board of Directors (the "Directors") of the Baytown
Area Water Authority ("BIWA") adopted a resolution to establish a public hearing date to
consider the land use assumptions and capital improvements plan; and
WHEREAS, on or before such date, the Board is required to establish an advisory
committee (the "Committee") to perform the functions and duties specified in Chapter 395 of the
Texas Local Government Code,which include:
1. advising and assisting BAWA in adopting land use assumptions;
2. reviewing the capital improvements plan and filing written comments;
3. monitoring and evaluating implementation of the capital improvements plan;
4. filing semiannual reports with respect to the progress of the capital improvements
plan and report to BAWA any perceived inequities in implementing the plan or
imposing the impact fee; and
5. advising BAWA of the need to update or revise the land use assumptions, capital
improvements plan, and impact fee; and
WHEREAS, the Board has determined that the Baytown Planning and Zoning
Commission meets the statutory requirements of Section 395.058 of the Texas Local
Government Code, which requires that not less than 40 percent of the membership of the
advisory committee be representatives of the real estate, development, or building industries who
are not employees or officials of a political subdivision or governmental entity; NOW
THEREFORE,
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA
WATER AUTHORITY:
Section 1: That all matters and facts set forth in the recitals hereinabove are found to
be true and are approved by the Board of Directors of the Baytown Area Water Authority.
Section 2: That pursuant to Section 395.058 of the Texas Local Government Code,
the Board of Directors of the Baytown Area Water Authority hereby appoints the Baytown
Planning and Zoning Commission as the Baytown Area Water Authority's Capital Improvement
Advisory Committee,
Section 3: This resolution shall take effect immediately from and after its passage by
the Board of Directors of the Baytown Area Water Authority.
INTRODUCED, READ and PASSED by the affirmative vote of the Board of Directors
