A RESOLUTION OF THE BOARD OF DIRECTORS OF THE BAYTOWN
AREA WATER AUTHORITY ESTABLISHING THE DATE, TIME AND
PLACE FOR A PUBLIC HEARING ON THE LAND USE ASSUMPTIONS
AND CAPITAL IMPROVEMENTS PLAN RELATING TO THE POSSIBLE
ADOPTION OF IMPACT FEES; AND PROVIDING FOR THE EFFECTIVE
DATE THEREOF.
WHEREAS, on April 21, 2021, the Board of Directors of the Baytown Area Water
Authority (the "Board") approved a Consulting Services Agreement with Carollo Engineers, Inc.,
a qualified professional, for the development of(i) a capital improvements plan using generally
accepted engineering and planning practices, (ii) land use assumptions and (iii) associated impact
fees; and
WHEREAS, on July 20, 2021, the Board received a report from Carollo Engineers, Inc.,
concerning the land use assumptions, capital improvements plan and possible imposition of
impact fees; and
WHEREAS, the Board desires to hold a public hearing to consider the land use
assumptions and capital improvements plan; NOW THEREFORE,
BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE BAYTOWN AREA
WATER AUTHORITY:
Section 1: That all matters and facts set forth in the recitals hereinabove are found to
be true and arc approved by the Board of Directors of the Baytown Area Water Authority.
Section 2: At 4:35 p.m. on the 15t1' day of September, 2021, in the Council Chambers
of the City Hall of the City of Baytown, located at 2401 Market Street, Baytown, Texas, the
Board will hold a public hearing on the land use assumptions and capital improvements plan
relating to the possible adoption of impact fees to give any member of the public the right to
appear and present evidence for or against the land use assumptions and capital improvements
plan.
Section 3: The Assistant Secretary of the Baytown Area Water Authority is hereby
authorized and directed to cause notice of such public hearing to be sent by certified mail and
published in a newspaper of general circulation in Harris and Chambers Counties before the
thirtieth (30111) day before the date set for the hearing, which notice shall conform to the standards
specified in Sections 395.044 of the Texas Local Government Code.
Section 4: This resolution shall take effect immediately from and after its passage by
the Board of Directors of the Baytown Area Water Authority.
INTRODUCED, READ and PASSED by the affirmative vote of the Board of Directors
