Ordinance No. 14,769ORDINANCE NO.14,769 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS, SETTING A TIME,DATE AND PLACE FOR A PUBLIC HEARING TO DISCUSS AND REVIEW THE PROPOSED UPDATED LAND USE ASSUMPTIONS,CAPITAL IMPROVEMENTS PLAN,MAXIMUM IMPACT FEE PER SERVICE UNIT AND THE CORRESPONDING ORDINANCE;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, on May 28, 2020, the City of Baytown caused an update of the land use assumptions and capital improvements plan to be prepared by Carollo Engineers,Inc., a qualified professional,using generally accepted engineering and planning practices; and WHEREAS, on July 8, 2021, the City received the update of the land use assumptions and capital improvements plan;and WHEREAS,withinsixty (60) days of receipt of the update,the City Council is required to set a public hearing to discuss and review the update andshall detemiine whether to amendtheplan;NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,TEXAS: Section 1:That all matters and facts set forth in the recitals hereinabove are found to be true and are approved by the City Council of the City of Baytown,Texas. Section 2: At 6:45p.m.on the 26"'day of August,2021,inthe Council Chambers of theCity Hall ot theCityof Baytown,located at 2401 Market Street,Baytown,Texas,theCity Council will holdapublichearing to considerthe amendment of the land use assumptions and capital improvements plan and the imposition of an impact feeandtogiveany member of thepublictherighttoappearandpresent evidence fororagainstthe update. Section 3: The City Clerk of the City of Baytown is hereby authorized and directed to cause notice of such public hearing to be sent by certified mail and published in a newspaper of general circulation in Harris and Chambers Counties before the thirtieth (30"')day before the date set for the hearing, which notice shall conform to the standards specified in Section 395.055 of the Texas Local Government Code. Section 4: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
