Ordinance No. 12,435ORDINANCE NO. 12,435 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENT OF ONE HUNDRED FORTY -FOUR THOUSAND FIVE HUNDRED SEVENTY -THREE AND NO /100 DOLLARS ($144,573.00) TO CALDWELL AUTOMOTIVE PARTNERS, LLC, THROUGH THE HOUSTON - GALVESTON AREA COUNCIL FOR THE PURCHASE OF THREE (3) 2014 CHEVROLET 3500 UTILITY TRUCKS FOR THE PUBLIC WORKS DEPARTMENT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. rraraarrrrr» wrtttrrrrrrr»» rr + + + + + +t+t »aarrarrrr »w + ++tttta +tars» »rwrtww »t+aa »aa »aaaaara» WHEREAS, the City Council of the City of Baytown has approved an Interlocal Agreement which authorizes the Houston - Galveston Area Council to take bids for certain items on behalf of the City of Baytown; and WHEREAS, pursuant to such agreement, the Houston - Galveston Area Council has taken bids for three (3) 2014 Chevrolet 3500 Utility Trucks for the Public Works Department; NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section I: That the City Council of the City of Baytown hereby authorizes the payment of ONE HUNDRED FORTY -FOUR THOUSAND FIVE HUNDRED SEVENTY -THREE AND NO /I00 DOLLARS ($144,573.00) to Caldwell Automotive Partners, LLC, through the Houston - Galveston Area Council for the purchase of three (3) 2014 Chevrolet 3500 Utility Trucks for the Public Works Department. Section 2: That pursuant to the provisions of Texas Local Government Code Annotated §252.048, the City Manager is hereby granted general authority to approve any change order involving a decrease or an increase in costs of FIFTY TI IOUSAND AND NO /100 DOLLARS ($50,000.00) or less, provided that the original contract price may not be increased by more than twenty-five percent (25 %) or decreased by more than twenty-five percent (25 %) without the consent of the contractor to such decrease. Section 3: This ordinance shall take effect immediately fr/and er its passage by the City Council of the City of Baytown.
