AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE PAYMENT OF FIFTY -EIGHT THOUSAND EIGHT HUNDRED
FIFTY AND NO /100 DOLLARS ($58,850.00) TO LONE STAR UNIFORMS, INC.,
THROUGH FEDERAL SUPPLY SCHEDULE 71 OF THE UNITED STATE'S GENERAL
SERVICES ADMINISTRATION FOR THE PURCHASE OF UNIFORMS FOR THE FIRE
DEPARTMENT; MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
WHEREAS, the Local Preparedness Acquisition Act (P.L. 110 -248) amended the Federal Property
and Administrative Services Act to authorize the use of Federal Supply Schedule 71 contracts by state and
local entities under the GSA Cooperative Purchasing Program; and
WHEREAS, based upon the Act, the City of Baytown qualifies as a local government entity and is
qualified to participate in the GSA Cooperative Purchasing Program as an alternate purchasing method
satisfying the City's competitive bidding obligations; and
WHEREAS, the purchase of uniforms for the Fire Department may be purchased by the City through
the Cooperative Purchasing Program of the United State's General Services Administration; NOW
THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section I: That the City Council of the City of Baytown hereby authorizes the payment of
FIFTY -EIGHT THOUSAND EIGHT HUNDRED FIFTY AND NO /100 DOLLARS ($58,850.00) to Lone
Star Uniforms, Inc., through the Federal Supply Schedule 71 of the United State's General Services
Administration for the purchase of uniforms for the Fire Department.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND NO /100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25 %) or
decreased by more than twenty-five percent (25 %) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
