AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS, PRESCRIBING THE NUMBER OF POSITIONS IN EACH
CLASSIFICATION IN THE FIRE DEPARTMENT; PROVIDING A
REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.

WHEREAS, on January 13, 2013, the emergency medical services operations and
personnel were transferred into the Fire Department via Ordinance No. 12,130, which provided
for the classification of the EMS employees in the Fire Department and the number of current
employees in each such new classification; and
WHEREAS, the number of positions in the Fire Department was thereafter established by
the City Council on the 28`h day of March, 2013, via Ordinance No. 12,223 wherein the number
of persons in each classification of the Fire Department was provided as follows:

WHEREAS, Ordinance No. 12,223 did not account for the positions in the EMS prior
such merger that were vacant at the time of its passage; and
WHEREAS, the City Council now desires to update the number of positions in each
classification to account for such positions and those created in the Fiscal Year 2013 -2014
budget; NOW THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN,
TEXAS:
Section 1: That the number of positions in each classification in the Fire Department
shall be as follows:

In accordance with Ordinance No. 12,130, if the person in the classification EMS Coordinator
obtains his fire fighter certification, a new position in the classification Assistant Chief shall be
created and the classification and such person's position in the classification of EMS
Coordinator shall be abolished.
In accordance with Ordinance No. 12,130, if a person in the classification Non -Fire Paramedic
Supervisor obtains his fire fighter certification, a new position in the classification Battalion
Chief shall be created and such person's position in the classification of Non -Fire Paramedic
Supervisor shall be abolished.
In accordance with Ordinance No. 12,130, if a person in the classification Non -Fire Paramedic
obtains his firefighter certification, a new position in the classification Fire Fighter shall be
created and the classification and such person's position in the classification of Non -Fire
Paramedic shall be abolished.
Section 2: All ordinances or parts of ordinances inconsistent with the terms of this
ordinance are hereby repealed; provided, however, that such repeal shall be only to the extent of
such inconsistency and in all other respects this ordinance shall be cumulative of other
ordinances regulating and governing the subject matter covered by this ordinance.
Section 3: If any provision, section, exception, subsection, paragraph, sentence,
clause or phrase of this ordinance or the application of same to any person or the set of
circumstances, shall for any reason be held unconstitutional, void or invalid, such invalidity shall
not affect the validity of the remaining provisions of this ordinance or their application to other
persons or sets of circumstances and to this end all provisions of this ordinance are declared to be
severable.
Section 4: This ordinance shall take effect immediately from and after its passage by
the City Council of the City of Baytown.
