CC Resolution No. 2,729 - Harris County MUD 213-A RESOLUTION NO. 2,729 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, GRANTING CONSENT TO HARRIS COUNTY MUNICIPAL UTILITY DISTRICT NO.213-A'S PROVIDING WATER AND WASTEWATER SERVICE TO APPROXIMATELY 19.24-ACRES LOCATED OUTSIDE ITS SERVICE AREA;AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. WHEREAS, Harris County Municipal Utility District No. 213-A (tile "District") is a municipal utility district organized and existing under Article 111, Section 52 and Article XVI, Section 59 of the Constitution of the State of Texas, created by an act of the Texas Legislature in 2013, and operating pursuant to Chapters 49 and 54 of the Texas Water Code and Chapter 8478 of the Texas Special District Local Laws Code, as amended, located in the extraterritorial jurisdiction of the City; and WHEREAS, the City and the District entered into that certain Water Supply and Waste Disposal Agreement dated July 2, 2019, as amended on April 23, 2021 (the "Agreement"), which provided for, among other things, the District to purchase from the City (i) water for the Service Area (defined therein) and (ii) treatment and disposal of waste generated within the Service Area; and WHEREAS, pursuant to Section 4.03 of the Agreement, the District may not pen-nit any entity located outside the Service Area to connect to the District's System during the term of the Agreement without the express prior written consent of the City; and WHEREAS, the City has received a request from the District for its written consent to serve that certain property containing 19.24 acres of land, more or less, located within the extraterritorial jurisdiction of the City and Harris County, Texas, and more particularly described in Exhibit "A" attached hereto and incorporated herein for all intents and purposes (tile "Property"); NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: That, in accordance with Section 4.03 of the Agreement, the City of Baytown,Texas, hereby consents to the District's provision of water and wastewater service to the Property and connection of water and wastewater facilities to provide such service to the Property, which is located outside the Service Area (defined in the Agreement). Section 2: This resolution shall take effect immediately from and after its passage by the City Council of the City of Baytown.
