AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE PAYMENT OF SEVEN HUNDRED THIRTY -EIGHT THOUSAND
EIGHT HUNDRED NIN ETY -SIX AND 56/100 DOLLARS ($738,896.56) TO RELIABLE
CHEVROLET 11, L.P., THROUGH THE STATE COMPTROLLER OF PUBLIC
ACCOUNTS TXSMARTBUY PROGRAM FOR THE PURCHASE OF TWENTY -EIGHT
(28) 2014 CHEVROLET TAHOES FOR THE BAYTOWN POLICE DEPARTMENT;
MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

WHEREAS, the City of Baytown, as a member of the Texas CO -OP Purchasing Program, may use the
TxSmartBuy Program as an alternate purchasing method satisfying the City's competitive bidding obligations;
and
WHEREAS, the purchase of twenty-eight (28) 2014 Chevrolet Taboos for the Baytown Police
Department may be purchased by the City, as a member of the Texas CO -OP Purchasing Program, through the
TxSmartBuy Program; NOW THEREFORE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS:
Section l: That the City Council of the City of Baytown hereby authorizes the payment of
SEVEN HUNDRED THIRTY -EIGHT THOUSAND EIGHT HUNDRED NINETY -SIX AND 56/100
DOLLARS ($738,896.56) to Reliable Chevrolet 11, L.P., through the State Comptroller of Public
Account's TxSmartBuy Program for the purchase of twenty-eight (28) 2014 Chevrolet Tahoes for the Baytown
Police Department.
Section 2: That pursuant to the provisions of Texas Local Government Code Annotated
§252.048, the City Manager is hereby granted general authority to approve any change order involving a
decrease or an increase in costs of FIFTY THOUSAND AND NO /100 DOLLARS ($50,000.00) or less,
provided that the original contract price may not be increased by more than twenty-five percent (25 %) or
decreased by more than twenty-five percent (25 %) without the consent of the contractor to such decrease.
Section 3: This ordinance shall take effect immediately from and after its passage by the City
Council of the City of Baytown.
