Ordinance No. 12,392ORDINANCE NO.12,392 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF BAYTOWN TO REZONE APPROXIMATELY 16.643 ACRES OF LAND LOCATED JUST WEST OF SJOLANDER AND SOUTH OF 1-10,IN BAYTOWN,HARRIS COUNTY,TEXAS,TO REZONE SUCH PROPERTY FROM OPEN SPACE/RECREATION (OR)ZONING DISTRICT TO LIGHT INDUSTRIAL(LI)ZONINGDISTRICT;PRESCRIBING A MAXIMUM PENALTYOFTWOTHOUSANDANDNO/100 DOLLARS ($2,000.00); PROVIDING A REPEALING CLAUSE;CONTAINING A SAVINGS CLAUSE;AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1:ThattheCityCouncil of theCity of Baytown,Texas,herebyamendsthe official zoningmap of theCityof Baytown to effectuate zoning district changes for approximately 16.643 acresofland located justwestof Sjolander andsouthof I-10,in Baytown, Harris County,Texastorezonesuch property from Open Space/Recreation (OR)Zoning District to Light Industrial (LI)Zoning District.The amended portion ofthe official zoning map is attachedheretoasExhibit"A"andincorporatedhereinforallintentsandpurposes. Section2:Anypersonwhofailsto comply withanyprovision of thisordinanceshall be guilty ofa misdemeanor and,upon conviction,shall be punished bya fine not exceeding TWOTHOUSANDANDNO/100DOLLARS($2,000.00).Eachact of violationandeachday upon which any such violation shall occur shall constitute a separate offense.In addition tothe penalty prescribed above,thecity may pursue other remedies such as abatement of nuisances, injunctive relief,administrative adjudication and revocation of licenses or permits. Section3:All ordinances orpartsof ordinances inconsistentwiththetermsofthis ordinance arehereby repealed;provided,however,thatsuchrepealshallbeonlytotheextentof such inconsistency andinallother respects this ordinance shallbe cumulative ofother ordinances regulating and governing thesubjectmattercoveredbythisordinance. Section4:Ifanyprovision,section,exception,subsection,paragraph,sentence, clause or phrase ofthis ordinance orthe application of same toany person orthesetof circumstances,shallforanyreasonbeheld unconstitutional,voidorinvalid,suchinvalidityshall notaffectthevalidity of the remaining provisions ofthisordinanceortheir application toother persons orsetsof circumstances andtothisendall provisions ofthis ordinance are declared tobe severable. Section 5:This ordinance shalltakeeffectfromand after ten(10)daysfromits passage bytheCity Council.TheCityClerkis hereby directed togivenoticehereofby causing the caption of this ordinance tobe published in the official newspaper of the City of Baytown at leasttwicewithinten (10)daysafterpassage of this ordinance.
