Mayor Capetillo convened the April 22, 2021, City Council Regular Meeting with a quorum
present at 6:34 P.M., all members were present.
Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Jacob Powell.
1. MINUTES
a. Consider approving the minutes of the City Council and the Baytown Area Water
Authority Joint Meeting held on March 17, 2021.
b. Consider approving the minutes of the City Council Retreat held on March 19,
2021.
C. Consider approving the minutes of the City Council Work Session and Regular
Meeting held on March 25, 2021.
A motion was made by Mayor Pro Tem. Heather Betancourth and seconded by Council Member
Laura Alvarado to approve the meeting minutes with regards to agenda items La. through l .c., as
submitted. The vote was as follows:

Director of Parks and Recreation Scott Johnson presented a short commercial of the schedule and
entertainment for the 3rd and 4"' of July Celebration for 2021, which will air on Channel 16 and
be placed on the City's website.
3. VOLUNTARY ANNEXATION OF APPROXIMATELY 71.66 ACRES
a. Conduct a first public hearing regarding the proposed annexation of approximately
71.66 acres consisting of approximately 69.50 acres of land, legally described as Tract 37A-
5, Abstract 21, G. Ellis Survey, Baytown, Harris County, Texas, along with approximately
2.16 acres being the entire width of N. Main Street right-of-way extending northwards
approximately 1335.01 feet from the current city limits.
At 6:40 P.M., Mayor Capetillo opened and conducted the first public hearing regarding the
proposed annexation of approximately 71.66 acres consisting of approximately 69.50 acres of
land, legally described as Tract 37A-5, Abstract 21, G. Ellis Survey, Baytown, Harris County,

Texas, along with approximately 2.16 acres being the entire width of N. Main Street right-of-
way extending northwards approximately 1335.01 feet from the current city limits.
Director of Planning and Community Development Services, Martin Scribner presented a
summary of the public hearing regarding agenda item 3.a. He stated that approximately 72 acres
on North Main would go through the annexation and the rezoning process to allow for a
proposed single-family detached home development of 266 lots.
With there being no one registered to speak regarding agenda item 3.a., Mayor Capetillo closed
the public hearing at 6:41 P.M.
b. Consider an ordinance authorizing a Service Agreement with Earl W. Wilburn, Jr.,
concerning approximately 71.66 acres consisting of approximately 69.50 acres of land,
legally described as Tract 37A-5, Abstract 21, G. Ellis Survey, Baytown, Harris County,
Texas.
Director of Planning and Community Development Services, Martin Scribner stated that
Ordinance No. 14,704, authorizes the nonnal agreement for services for the aforementioned
annexation, which is located in Council District 4.
A motion was made by Mayor Pro Tern Heather Betancourth and seconded by Council Member
Charles Johnson to approve Ordinance No. 14,704, related to Item 3.a. The vote was as follows:

EXECUTE AND THE CITY CLERK TO ATTEST TO A SERVICES
AGREEMENT WITH EARL W. WILBURN, JR.; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
4. JUVENILE CURFEW
a. Conduct a second public hearing giving all interested persons the right to appear
and be heard on the need to continue the City's juvenile curfew ordinance.

At 6:43 P.M., Mayor Capetillo opened and conducted the second public hearing regarding the
need to continue the City's juvenile curfew ordinance.
Interim Police Chief Mike Holden summarized the subject of the second public hearing
regarding agenda item 4.a. and stated that the curfew was a beneficial enforcement tool for the
City of Baytown that should continue for the next few years and noted that it must come before
council for approval.
With there being no one registered to speak regarding agenda item 4.a., Mayor Capetillo closed
the public hearing at 6:44 P.M.
b. Consider an ordinance continuing the juvenile curfew ordinance found in Chapter
66 "Offenses," Article IV "Curfew for Minors" of the Code of Ordinances, Baytown,
Texas.
A motion was made by Council Member Laura Alvarado and seconded by Council Member
Chris Presley to approve Ordinance No. 14,705, related to Item 4.b. The vote was as follows:

ORDINANCE NO. 141705
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN,

FOR MINORS" OF THE CODE OF ORDINANCES OF THE CITY OF
BAYTOWN, TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
5. PROPOSED ORDINANCES
a. Consider an ordinance authorizing the award of the Annual Mosquito Control
Chemicals Contract to multiple vendors.
Health Department Director, Tony Gray presented the item and stated that Ordinance No.
14,706, authorizes the award of the Mosquito Control Chemicals Contract in the amount of
$187,000 for mosquito control within the City of Baytown. He stated that the bid opening
occurred on March 02, 2021, at 2:00 P.M., whereas, four (4) bids were received by suppliers and
fifteen items were bid. He acknowledged the vendors that were selected for eleven of the items.

There were four out of the fifteen items with regulating pricing set by the manufacturer that were
bid on which required council's assistance to draw, or break the ties.
Council Members Powell, Betancourth, Johnson, and Alvarado volunteered to take one of the
ping-pong balls out of each bag and read out the name of the vendor. The results were as
follows:

b. Consider an ordinance amending the Code of Ordinances, Baytown, Texas, by
(i) amending certain sections within Chapter 98, "Utilities", (ii) amending certain sections

within Chapter 109, "Engineering and Construction Standards, and (iii) amending certain
sections within Chapter 110, "Floods".
City Engineer, Erwin Burden presented the item and stated that City Manager Rick Davis
requested to table most of this item, therefore, they reduced the amendments specifically to
Sections 110-67 and 1 10-102. The council members were provided a red -line copy at the dais
with the proposed changes, in which there was a discussion seeking clarification, regarding
amendments six and nine listed on the red -line copy.
Mayor Capetillo called the two individuals registered to speak on this item, Mr. Michael Rusk
and Mr. Mark Helms.
Mr. Mark Helms, representative of DR Horton, stated that the two amendments wouldn't have a
negative impact on them as home builders, but wanted to bring attention some of the scenarios
that could occur if they maintain the stance of coastal 500-year floodplain versus the variance
between a 500-year riverine being that there was a large discrepancy between the two. He stated
that if they were to maintain the stance to date, it could put them in a situation where they would
actually build on piers and stilts right next to a home that is built on slab -on -grade, which would
deem the homes on the slab -on -grade as worthless, further losing all value. He stated there were
some ordinances within Baytown on the construction of the homes and the usage of the materials
on the homes, in which building on stilts would not meet the material usage ordinances. Mr.
Helms noted that staff was very good at listened to concerns.
At the Council's request, Mr. Michael Rusk, with LJA Engineering, proceeded to explain the
difference between the 500-year coastal floodplain versus riverine and the drastic differences in
the elevations as mandated by FEMA. It was also noted that Harris County, as well as, other
communities in the surrounding area were dealing with this issue as well.
Council Member Betancourth requested for staffs perspective on the assessment provided,
whereas, Director of Public Works and Engineering Frank Simoneaux mentioned some of the
challenges and the steps staff were taking to resolve the issue.

A motion was made by Council Member Mike Lester and seconded by Council Member Chris
Presley to approve Items 5.a. through 5.c., in conjunction, but there was further discussion before
the vote.
a. Consider a resolution adopting the revised Community Development Block Grant
(CDBG) Operation Paintbrush Program Guidelines.
Community Development Manager, Christopher Chavis presented the item and stated that the
CDBG funds were to support low to moderate -income residents inside the City of Baytown, in
particular, Item 6.a., the Paintbrush Program. He stated that staff sought to update the guidelines,
clarify the language, expand the boundaries to which the paintbrush program would be
applicable. He stated that currently, the neighborhood improvement program was operating
inside of the Pelly area, the area in red on the map that was provided, but staff was looking to
extend it to the older areas as well, being Middleton and the West Baytown area. He stated that
with regards to the Paintbrush Program, that the intent was to extend the lien that was going to be
placed on the property once said improvements were done. He further stated that currently, there
was a one-year lien placed on the property, in which they were looking to extend to five years,
which is consistent with all the other housing programs.
There was a brief discussion in regards to the extension time of the lien placed on the improved
property, in which there was a consensus from Council for it to remain as a one-year lien versus
a five-year.
A motion was then made by Council Member Charles Johnson and seconded by Council
Member Chris Presley to amend the motion on the table and for the Operation Paintbrush
Guidelines to state that the lien agreement remain at one-year, as it relates to Item 6.a. The vote
was as follows:

7. DISCUSSIONS
a. Discuss possible amendments to Resolution No. 2236 adopted on March 28, 2013, to
expand the rules to govern conduct of the City Council when acting in an official capacity.
City Attorney Karen Horner presented the item and stated that at the last city council work
session, Council discussed possible amendments to the rules regarding to expand the rules to
include the council's actions when acting in their official capacity. She stated that there are the
two amendments were as follows: 1) Section 1.2, which expands not only to the Council
Chamber, but also when in the Council meeting, as it states "by the members of the city council
when acting in their official capacity."; 2) Section 3, Code of Conduct, in regards to the conduct
of Council and it just as proposed, it states that "council members shall conduct business of the
City in a reasonable respectful manner, and shall refrain from indulging in personal attacks,

using offensive language, and making derogatory remarks." She noted that she visited with
Council Member Presley, as well as, Council Member Lester and there should be a discussion at
a council meeting and therefore, could not be voted on until the next council meeting.

PROGRAM; AUTHORIZING THE BAYTOWN POLICE DEPARTMENT TO
PARTICIPATE IN THE 2021 "CLICK IT OR TICKET" TRAFFIC
ENFORCEMENT INITIATIVE ADMINISTERED BY THE TEXAS
DEPARTMENT OF TRANSPORTATION; AND PROVIDING FOR THE

9. APPOINTMENTS
a. Consider two (2) appointments to the Baytown Library Board.
Acting City Clerk, Angela Jackson presented the two appointments of Mr. Jerry Shafer and Ms.
LaToya Washington for consideration to the Baytown Library Board. She stated that, if
appointed the terms would start immediately and expire on February 28, 2023. Additionally, she
clarified that one of the three applicants did not qualify as she was already serving on two
boards.
A motion was made by Council Member Laura Alvarado and seconded by Council Member
Charles Johnson to approve the appointment so of Mr. Jerry Shafer and Ms. LaToya Washington
to the Baytown Library Board for an unexpired two-year term. The vote was as follows:

Member Chris Presley, Council Member Charles Johnson, Council

At 7:37 P.M., Mayor Capetillo recessed into and convened an executive session pursuant to
Section 551.071 of the Texas Government Code to seek the advice of the City's attorneys
regarding regarding pending or contemplated litigation involving the City of Baytown, and
regarding short-term and long-term rentals and group housing.
At 8:20 P.M. Mayor Capetillo reconvened the meeting and announced that in accordance with
Section 551.102 of the Texas Government Code, no action was taken in executive session.
