The City Council of the City of Baytown, Texas, met in special session on September 15, 2005,
at 6:30 p.m. in the Council Chamber of Baytown City Hall with the following in attendance:

The meeting was opened with a quorum present and the following business was conducted:
Conduct the Public Hearing on the proposed 2005 -2006 Fiscal Year Budget.
Texas Local Government Code, Section 102.006 requires City Council to hold a public hearing
on the proposed budget. Any taxpayer of the municipality may attend and may participate in the
public hearing.
The public hearing must be held after the 15`h day after the date the proposed budget is filed with
the City Clerk, but before the date the governing body makes its tax levy. The proposed budget
was filed with the City Clerk on July 28, 2005. The date proposed for Council to set the tax rate
is September 22nd, 2005. Notice of the public hearing was published in The Baytown Sun on
August 23, 2005.
The public hearing was called to order at 6:32 p.m.
No one appeared to speak at the public hearing.

Receive the revised effective tax rate and rollback rate calculation from the Harris County
Appraisal District for the 2005 Tax Year (Fiscal Year 2005 -06).
In accordance with Section 26.04 of the Texas Property Tax Code, the Finance Department
submits the effective tax rate and the rollback tax rate of $0.77021 and $0.79581 per $100
valuation, respectively. These rates and the method of calculation shall be published in
accordance with Section 26.04 of the Texas Property Tax Code. The City has historically used
100% of its collection rate for calculation of its effective tax. There were errors in the
information received from HCAD, which affected the previously calculations that were
presented to Council on September 8, 2005.
Consider Resolution No. 050915 -1 to establish the CDBG- funded Aid to Victims of
Hurricane Katrina Program that will provide various public services to those who
currently reside within the city limits.
City Manager Jackson explained that staff is confident of the remaining expenditures to be made
in each category of the approved Community Development Block Grant budget in the Annual
Action Plan before the end of the fiscal year. He said approximately $25,000 in unexpended
funds will remain. Considering the needs of the victims of Hurricane Katrina, he said staff feels
that there are eligible expenditures that can be funded by the Community Development Block
Grant program. The list includes Homeownership Assistance, Transportation Services,
Childcare Expenses, Utility Assistance, and funding to maintain and operate the Service Center
at San Jacinto Mall. Mr. Jackson said that notice of the proposed amendment to the Annual
Action Plan had been published in The Baytown Sun.
Tiffany Foster, Community Development Planner, informed Council that HUD had waived the
public services cap and the public notice to change the budget at the, end of the fiscal year.
The following person registered to speak to Council on this item:
Peggy Schifano, 2100 Baker Road
Ms. Schifano, an evacuee from Louisiana, explained the hardships she and her family had
endured following Hurricane Katrina. She said that Baytown and its citizens had provided much
needed support and assistance during the ordeal. She thanked Council for its consideration of
this resolution.
Council Member Mahan moved adoption of the proposed resolution. Council Member Sheley
seconded the motion. The vote follows:
Ayes: Council Members Capetillo, Mahan, Murray, and Sheley.

RESOLUTION NO. 1741
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
ESTABLISHING THE CDBG - FUNDED AID TO VICTIMS OF HURRICANE KATRINA
PROGRAM THAT WILL PROVIDE VARIOUS PUBLIC SERVICES TO THOSE
DISPLACED BY HURRICANE KATRINA AND CURRENTLY RESIDING WITHIN THE
CITY OF BAYTOWN; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
Consider Resolution No. 050915 -2 authorizing the City Manager to accept up to forty -five
thousand and no /100 dollars ($45,000.00) from Southeast Texas Housing Finance
Corporation to supplement the CDBG funded Aid to Victims of Hurricane Katrina
Program for furniture and essential household items for persons displaced by Hurricane
Katrina and locating within the city limits or in the Chambers County portion of
Baytown's ETJ.
Mr. Jackson said that when those displaced by Hurricane Katrina find intermediate housing
under the FEMA Public Assistance Program, in order to provide basic needs for independent
living, items such as mattresses and beds will be needed.
Mr. Jackson informed Council that, should Council approve this item, the Housing Trust had
scheduled a telephone conference that evening to consider Council's action and an additional
conference the next day to consider approval.
Council Member Sheley moved adoption of the proposed resolution. Council Member Capetillo
seconded the motion. The vote follows:
Ayes: Council Members Capetillo, Mahan, Murray, and Shirley.

RESOLUTION NO. 1742
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS,
AUTHORIZING THE CITY MANAGER TO ACCEPT UP TO FORTY -FIVE THOUSAND
AND NO /100 DOLLARS ($45,000.00) FROM SOUTHEAST TEXAS HOUSING FINANCE
CORPORATION TO SUPPLEMENT THE CDBG - FUNDED AID TO VICTIMS OF
HURRICANE KATRINA PROGRAM FOR FURNITURE AND ESSENTIAL HOUSEHOLD
ITEMS FOR PERSONS DISPLACED BY HURRICANE KATRINA AND LOCATING
WITHIN THE CITY LIMITS OR IN THE CHAMBERS COUNTY PORTION OF THE CITY
OF BAYTOWN'S EXTRATERRITORIAL JURISDICTION; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.

Consider Proposed Resolution No. 050915 -3, establishing a Hurricane Katrina Relief
Homebuyers Assistance Program.
Mr. Jackson noted that this revision would change the following elements of the Homebuyers
Assistance Program, applicable to former residents of the affected areas of Louisiana, Alabama
ands Mississippi:
• Waive the requirement for previous Baytown residency; and,
• Waive the prohibition on previous homeownership.
Council Member Sheley moved adoption of the proposed resolution. Council Member Capetillo
seconded the motion. The vote follows:
