July 16, 2004
2:00 p.m.
The City Council of the City of Baytown, Texas, met in special session on July 16, 2004, at 2:00
p.m. in the Council Chamber of Baytown City Hall with the following in attendance:

The meeting was opened with a quorum present after which the following business was conducted:
Consider selection of Council Member, District 3.
Mayor Mundinger recognized the persons who had expressed interest in serving the community as
candidates for the position of Council Member, District 3. He then outlined the procedures to be
followed in the nomination and voting. After a person is nominated, the person's name will be
placed in a uniform size cylinder and then placed in a box. After nominations cease, the names will
be randomly selected from the box and as each name is selected, a vote will be taken. City
Manager, Gary Jackson, suggested that Council suspend their rules that prohibit the procedure.
Council Member Murray moved to suspend the rules that prohibit the proposed procedure. Council
Member Sheley seconded the motion. The vote follows:
Ayes: Mayor Members Anderson, Mahan, Murray, Renteria, and Sheley.
Mayor Mundinger.
Nays: None.
The motion carved.
Council Member Renteria offered to and did lead the Pledge of Allegiance and offer an invocation.
Tim Quinton had signed to speak. Mr. Quinton stated that he appreciated the efforts of the Council.
Mayor Mundinger then opened the floor for nominations.

Council Member Mahan nominated Charles Shaffer.
Council Member Anderson nominated Lisa Urban.
Council Member Renteria nominated Brandon Capetillo.
Charles Shaffer's name was drawn first. The vote follows:
For: Council Members Mahan, Renteria, and Sheley.
Against: Council Members Anderson and Murray and Mayor Mundinger.
Mr. Shaffer was not elected.
Brandon Capetillo's name was drawn second. The vote follows:
For: Council Members Renteria, and Sheley.
Against: Council Members Anderson, Mahan and Murray and Mayor Mundinger.
Mr. Capetillo was not elected.
Lisa Urban's name was drawn last. The vote follows:
For: Council Members Anderson and Murray and Mayor Mundinger.
Against: Council Members Mahan, Renteria, and Sheley.
Ms. Urban was not elected.
The Council discussed how to proceed. Council Members made statements of support for
candidates. Mayor Mundinger opened the floor for nominations.
Council Member Murray nominated Lisa Urban.
Council Member Sheley nominated Charles Shaffer.
Council Member Renteria nominated Brandon Capetillo.
Charles Shaffer's name was drawn first. The vote follows:
For: Council Members Mahan, Renteria, and Sheley.
Against: Council Members Anderson and Murray and Mayor Mundinger.
Mr. Shaffer was not elected.

Brandon Capetillo's name was drawn second. The vote follows:
For: Council Member Renteria.
Against: Council Members Anderson, Mahan, Murray, and Sheley and Mayor
Mundinger.
Mr. Capetillo was not elected.
Lisa Urban's name was drawn last. The vote follows:
For: Council Members Anderson and Murray and Mayor Mundinger.
Against: Council Members Mahan, Renteria, and Sheley.
Ms. Urban was not elected.
Council discussed the possibility of finding a means of breaking the deadlock. Mayor Mundinger
ended the discussion by suggesting that he would move for deadlock and leaving the position vacant
until the May election. He then called for nominations.
Council Member Mahan nominated Charles Shaffer.
Council Member Anderson nominated Lisa Urban.
Council Member Renteria nominated Brandon Capetillo.
Mayor Mundinger nominated Martha Barnett.
Lisa Urban's name was drawn first. The vote follows:
For: Council Members Anderson and Murray and Mayor Mundinger.
Against: Council Members Mahan, Renteria, and Sheley.
Ms. Urban was not elected.
Charles Shaffer's name was drawn second. The vote follows:
For: Council Members Mahan, Renteria, and Sheley.
Against: Council Members Anderson and Murray and Mayor Mundinger.
Mr. Shaffer was not elected.
Martha Barnett's name was drawn third. The vote follows:

For: Mayor Mundinger.
Against: Council Members Anderson, Mahan, Murray and Renteria.
Abstaining: Council Member Sheley.
Ms. Barnett was not elected.
Brandon Capetillo's name was drawn last. The vote follows:
For: Council Member Renteria.
Against: Council Members Anderson, Mahan, Murray and Mayor Mundinger.
Abstaining: Council Member Sheley.
Mr. Capetillo was not elected.
Council Member Anderson asked if any of the candidates would like to withdraw from
consideration. Ms. Barnett then withdrew.
Mayor Mundinger recessed the meeting at 3:30 p.m.
The meeting reconvened at 3:45 p.m.
Mayor Mundinger stated that the Council appeared to be deadlocked and a special election was not
possible. Mr. Jackson explained staff's concerns about staff conducting a straw poll.
Brandon Capetillo withdrew his name from consideration.
Council Member Sheley moved to table the item until the regular Council meeting on Thursday,
July 22, 2004, with the item being the first action item with the second item for swearing in the
appointee. Council Member Mahan seconded the motion. Council discussed whether those who
had withdrawn could be considered on Thursday. The vote follows:
Ayes: Council Members Anderson, Mahan, Murray, Renteria, and Sheley
Mayor Mundinger.
Nays: None.
The motion carried.
Adjourn.
Mayor Mundinger moved that the meeting adjourn. Council Member Sheley seconded the motion.
