2002 10 22 CC Minutes, EmergencyMINUTES OF THE EMERGENCY SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN October 22, 2002 4:30 p.m. The City Council of the City of Baytown, Texas, met in emergency session on October 22, 2002, at 4:30 p.m. in the Council Chamber of the Baytown City Hall with the following in attendance: Ronnie Anderson Coleman Godwin Calvin Mundinger Don Murray Mercedes Renteria III Pete C. Alfaro Absent: Scott Sheley Gary M. Jackson Karen Horner Gary W. Smith Council Member Council Member Council Member Council Member Council Member Mayor Council Member Interim City Manager First Assistant City Attorney City Clerk The meeting was opened with a quorum present. The following business was conducted: Consider proposed settlement offer in Cause No. 2000 - 41613; City of Baytown v Senterra Development, L.L.C., Wilson Architectural Group, Inc., and Turner Construction Company of Texas, concerning the restaurant and ship store facilities. Interim City Manager Gary Jackson introduced Rick Peebles and Roger McCabe, attorneys for the City of Baytown in the litigation. Mr. Peebles explained that the three defendants have offered the sum of $1,200,000 for a full and complete release of all claims of the City in the above -cited lawsuit. Mr. Peebles recommended approval of the settlement offer. Mayor Alfaro related that he had attended the Court sessions. The settlement proposal was made after the opening statements were presented to the jury. Mayor Alfaro urged approval of the settlement offer. In response to an inquiry about the amount that the City would net from the settlement, Mr. McCabe stated that it would be approximately $730,000. Mr. Peebles explained, that upon approval of the offer by Council, the parties would meet at Court on Wednesday morning and read the terms of the agreement into the record. Council. Member Anderson moved approval of the offer of the defendants in Cause No. 2000 -41613 in the amount of $1,200,000. Council Member Renteria seconded the motion. The vote follows: Ayes: Council Members Anderson, Godwin, Mundinger, Murray, and Renteria. Mayor Alfaro. Nays: None. The motion carried.
