2002 05 23 CC MinutesMINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN May 23, 2002 6:30 p.m. The City Council of the City of Baytown, Texas, met in regular session on May 23, 2002, at 6:30 p.m. in the Council Chamber of the Baytown City Hall with the following in attendance: Ronnie Anderson Council Member Coleman Godwin Council Member Calvin Mundinger Council Member Don Murray Council Member Mercedes Renteria III Council Member Scott Sheley Council Member Pete C. Alfaro Mayor Monte Mercer City Manager Ignacio Ramirez, Sr. City Attorney Gary W. Smith City Clerk The meeting was opened with a quorum present and a representative of Boy Scout Troop 93 led the pledge of allegiance. Council Member Godwin offered the invocation after which the following business was conducted: Consider approval of minutes of the work session and regular meeting held on May 9, 2002. Council Member Mundinger moved approval of the minutes of the regular meeting held on May 9, 2002. Council Member Murray seconded the motion. The vote follows: Ayes: Council Members Anderson, Godwin, Mundinger, Murray, Renteria, and Sheley. Mayor Alfaro. Nays: None. The motion carried. Consider approval of minutes for the special meeting held on May 18, 2002. Council Member Godwin moved approval of the minutes of the special meeting held on May 18, 2002. Council Member Anderson seconded the motion. The vote follows: Ayes: Council Members Anderson, Godwin, Mundinger, Murray, Renteria, and Sheley. Mayor Alfaro. Nays: None. The motion carried. Page 2 of 2 Minutes of the Regular Session — May 23, 2002 Consider Proposed Ordinance No. 020523 -1, authorizing procurement of software, software licensing, computers, and accessories for Networked Computer Communications for Houston High Intensity Drug Traffic Area. Proposed Ordinance No. 020523 -1 awards procurement of software, software licensing, computers and accessories for Networked Computer Communications for Houston High Intensity Drug Traffic Area to Dell Computer Corporation, a QISV vendor, in the amount of $147,826.95. This procurement of networked computer communications among all HIDTA Initiatives in Houston via the RISSNet (Regional Information Sharing System Network) will meet the requirement for a mandated law- enforcement sharing network through Dell Computer Corporation. RISSNet is a nationwide linkage that connects every state's Department of Public Safety with all other state departments and is mandated by ONDCP (Office of National Drug Control Policy). A local government that participates in the cooperative purchasing program established under sections 271.082 and 271.083 of the Local Government Code satisfies otherwise applicable competitive bidding requirements when it makes a purchase through the catalogue purchasing procedure established by article 6701b, section 3.081, V.T.C.S. The purpose of the QISV (Qualified Information Systems Vendors) Catalogue Purchasing Program is to allow for qualified entities (state agencies and political subdivisions) to purchase automated information systems products and/or services in an efficient, cost effective, and competitive procurement method. Council Member Murray moved adoption of the proposed ordinance. Council Member Anderson seconded the motion. ORDINANCE NO. 9358 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE PAYMENTOF ONE HUNDRED FORTY -SEVEN THOUSAND EIGHT HUNDRED TWENTY -SIX AND 95/100 DOLLARS ($147,826.95) TO DELL COMPUTER CORPORATION FOR THE PROCUREMENT OF SOFTWARE, SOFTWARE LICENSING, COMPUTERS AND ACCESSORITES FOR NETWORKED COMPUTER COMMUNICATIONS; MAKING OTHE RPROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Page 3 of 3 Minutes of the Regular Session — May 23, 2002 Consider Proposed Resolution No. 020523 -1, appointing the election officials for the Mayoral Runoff election to be held on June 1, 2002. Proposed Resolution 020523 -1 appoints the election officials for the Mayoral Runoff election. The proposed election officials have agreed to serve for the runoff election. For the precincts without named judges, emergency appointments will be made prior to the election. Detailed training will be provided through an election school held prior to the election. Each judge that has volunteered to serve has previous experience in conducting a City election. Each official not named will be appointed by the Mayor's emergency appointment. Council Member Sheley moved adoption of the proposed resolution. Council Member Godwin seconded the motion. RESOLUTION NO. 1546 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, NAMING THE ELECTION OFFICIALS FOR THE MAYORAL RUNOFF ELECTION OF THE CITY OF BAYTOWN, TEXAS, TO BE HELD ON JUNE 1, 2002; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider appointment of an interim City Manager. Monte Mercer submitted his resignation as City Manager, effective June 14, 2002. It is necessary to appoint an interim City Manager to fill the vacancy until the new City Manager can be selected. This item is scheduled for discussion during the work session. Council Member Godwin moved appointment of Gary Jackson as the interim city manager. Council Member Renteria seconded the motion. The vote follows: Ayes: Council Members Anderson, Godwin, Mundinger, Murray, Renteria, and Sheley. Mayor Alfaro. Nays: None. The motion carried. Sam Schulze has tendered his resignation as a director of the Baytown Area Water Authority Board. Mr. Schulze served the position outside the City, but within the authority's boundaries. The appointment is for the unexpired term. City Council is authorized to make the appointment. Council was not ready for action on this item. Consider appointment to the Board of Adjustment. William J. Reineke has tendered his resignation as a member of the Board of Adjustment. The appointment is for the unexpired term. City Council is authorized to make the appointment. Council was not ready for action on this item. Consider appointment to the Community Development Advisory Committee. The representative for District 6 no longer resides within the City. The appointment will be for the balance of the unexpired term. Council Member Godwin moved appointment of Joe Frank Robins to the Community Development Advisory Committee. Council Member Mundinger seconded the motion. Ayes: Council Members Anderson, Godwin, Mundinger, Murray, Renteria, and Sheley. Mayor Alfaro. Nays: None. The motion carried. Consider approval of appointment to the Baytown Police Reserve Force. Consider appointment of Mark Earl Smith to the Baytown Police Reserve Force. Chapter 50 of the Code of Ordinances provides that membership on the Police Reserve Force is at the discretion of the Chief of Police. Section 50 -30 requires Council's approval of the Chief's appointment before the reserve officer can carry a weapon or act as a peace officer. Mr. Smith is a certified peace officer and previously served with the Baytown Police Department from May 15, 2001 to February 24, 2002. He left the Department in good standing. Mr. Smith has a BS in Criminal Justice from Sam Houston State University. Chief Jones has appointed Mr. Smith to the Reserve Force, subject to Council's approval. Council Member Sheley moved approval of Chief Jones appointment of Mark Earl Smith to the Police Reserve Force. Council Member Mundinger seconded the motion. City Manager's Report. The Memorial Day Ceremony will be held on Monday, May 27 at I I Nair, at Bicentennial Park The City of Baytown was announced as the winner ofdnc Environmental Protection Agency Gulf Guardian Award. This award is for the five state region that borders the Gulf of Mexico and is awarded to recognize efforts to protect and preserve the Gulf. Adjourn.
