OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
September 4, 2001
The City Council of the City of Baytown, Texas, met in special session on September 4,
2001, at 6:30 p.m. in the Council Chamber of Baytown City Hall, 2401 Market Street,
Baytown, Texas with the following in attendance:

Conduct a public hearing on the proposed Crime Control & Prevention District
2001 -2002 budget at 6:30 p.m.
Prior to adoption of a budget, CCPD Resolution No. 2 requires that a public hearing on
the proposed budget be held and any resident of the District may attend and may
participate. Notice of the public hearing was published in the Baytown Sun on Monday,
August 27, 2001, more than seven days before the public hearing.
Mayor Alfaro called the public hearing to order at 6:30 p.m.
Mayor Alfaro asked City Manager, Monte Mercer, to review the proposed budget.
The projected revenues are $3,366,000. Operating expenditures are $1,470,848 to
include:
• $50,529 increases in personnel services to provide market adjustments, merit
increases and health care cost increases.
• $41,747 for maintenance of the radio infrastructure.
• $33,786 for one -half year funding for a full -time municipal court judge.
• $34,529 for a Property Room Disposal Technician.
• $35,000 for a Lieutenant.
• $205,751 to provide five new jailers.

Capital expenditures are $566,088 and include:
• $480,100 for vehicle replacements.
• $51,956 for additional radios and testing equipment.
• $34,032 for Municipal Court Imaging Software.
Working capital is projected to be $1,050,723 (113 days).
No one requested to speak and the public hearing was closed at 6:32 p.m.
Consider Proposed Ordinance No. 010904 -1, approving Change Order No. 5 to the
2000 Municipal Street Rehabilitation Project to D & W Contractors, Inc.
Proposed Ordinance No. 010904 -1 approves Change Order No. 5 in the amount of
$21,450 to D & W Contractors, Inc. This change order includes 200 linear feet of 24"
reinforced concrete pipe, 300 linear feet of flex beam guardrail, 2 guardrail safety end
terminal assemblies, backfill and grading. These items are to be constructed in the curve
where Ferry Road and Cedar Bayou Roads intersect. The contract award amount was
$1,577,753.00 and this change order plus change orders 1, 2, 3 and 4 represent a total
increase of $239,756.17 or a 15.2% cost growth. The contract's original duration was
200 working days and change orders 1, 2, 3 and 4 added 95 total working days for a
current contract total of 295 working days.
Council Member Anderson moved approval of the proposed resolution. Council Member
Mundinger seconded the motion. Council Member Anderson supported adoption of the
Change Order due to the improvements being requested by area residents for safety and
to eliminate the use of the area as a place to hide stolen automobiles. The vote follows:

ORDINANCE NO. 9212
AN ORDINANCE AUTHORIZING CHANGE ORDER NO. 5 WITH D & W
CONTRACTORS, INC., FOR THE 2000 MUNICIPAL STREET REHABILITATION
PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN IN THE
AMOUNT OF TWENTY -ONE THOUSAND FOUR HUNDRED FIFTY AND NO /100
DOLLARS ($21,450.00); MAKING OTHER PROVISIONS RELATED THERETO;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

Announcement of additional appointments to the Board of Directors, Reinvestment
Zone Number One, City of Baytown.
City Manager, Monte Mercer, announced that Lee College had appointed Dr. Jackson
Sasser as its director to the Board. Dr. Sasser will occupy position 7 for an initial one-
year term. Mr. Mercer also related that Hams County will delay their appointment until
the end of the year.
Council Member Murray moved confirmation of Lee College's appointment of Dr.
Sasser to the Board of Directors, Reinvestment Zone Number One, City of Baytown.
Council Member Renteria seconded the motion. The Council requested staff research the
question of a taxing entity's authority to appoint a director prior to committing to
participate in the zone. The vote follows:
Ayes: Council Members Anderson, Godwin, Mundinger, Murray, and Renteria

The motion carried.
Conduct the public hearing on the proposed tax rate for tax year 2001 at 6:45 p.m.
Prior to adoption of proposed tax rate, Texas Tax Code, Sections 26.05 and 26.06 require
the City Council to hold a public hearing prior to the final vote on the tax rate when the
proposed rate exceeds the lower of the roll back rate or 103% of the effective tax rate.
Due to the increased appraised values of property within the City, the proposed rate,
which is the same rate as last year, exceeds the effective tax rate by more than 103 %.
Any resident of the City may attend and may participate. Notice of the public hearing
was published in the Baytown Sun on Monday, August 27, 2001, more than seven days
before the public hearing.
Mayor Alfaro called the public hearing to order at 6:45 p.m.
Mayor Alfaro requested that City Manager, Monte Mercer, review the proposed tax rate
Mr. Mercer explained that the proposed tax rate is $0.73703 per $100 valuation. On
August 23, City Council voted to preliminarily approve the proposed tax rate. The final
vote is scheduled for the regular Council meeting of September 13, 2001. The tax rate
has been the same since the 1992 tax year.
No one requested to speak. The public hearing was closed at 6:47 p.m.

Council Member Mundinger moved that the meeting adjourn. Council Member Murray
seconded the motion. The vote follows:
