2001 08 29 CC Minutes, SpecialMINUTES OF THE SPECIAL SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN August 29, 2001 The City Council of the City of Baytown, Texas, met in special session on August 29, 2001, at 10:00 a.m. in the White's Park Building of White's Park, Anahuac, Texas with the following in attendance: Mercedes Renteria, III Council Member Ronnie Anderson Council Member Calvin Mundinger Council Member Don Murray Council Member Coleman Godwin Council Member Pete C. Alfaro Mayor Monte Mercer City Manager Ignacio Ramirez, Sr. City Attorney Gary W. Smith City Clerk Absent was: Scott Sheley Council Member The meeting was opened with a quorum present after which the following business was conducted: The Administrative Law Judges explained the purpose and schedule for the meeting concerning the permit applications related to the TSP Development Limited of Kingwood proposed landfill in Chambers County. The judges conducted the hearing to determine whether jurisdiction existed over SOAH 58201346, air quality permit. The Executive Director of the Texas Natural Resource Conservation Commission presented evidence of jurisdiction. The judges found that a defect existed, but that it was a clerical error. The exhibits were admitted and tentative jurisdiction was found. The Executive Director was directed to submit a supplemental affidavit to cure the clerical error. The nature of party status was reviewed and all persons interested in seeking party status were allowed to complete the necessary forms. The judges next considered Hams County's Motion for Reconsideration. After argument was presented, the judges took the matter under advisement and recessed the hearing for lunch. The hearing reconvened at 2:00 p.m. Page 2 of 2 Minutes of the Special Session — August 29, 2001 00� Liberty County presented testimony seeking party status. Reba Eichelberger argued her Motion for Reconsideration. Goose Creek Consolidated Independent School District presented evidence for party status. The City of Baytown, through the testimony of Mayor Pete C. Alfaro, presented evidence for party status. At the conclusion of Baytown's presentation for party status, the hearing was recessed. Members of the City Council departed the meeting, leaving less than a quorum. The meeting adjourned at 3:35 p.m. /C G W. Smith, City Clerk or
