2001 06 05 CC Minutes, SpecialIm MINUTES OF THE SPECIAL SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN June 5, 2001 The City Council of the City of Baytown, Texas, met in special session on June 5, 2001, at 8:00 a.m. in the Council Chamber of the Baytown City Hall with the following in attendance: Scott Sheley Council Member Ronnie Anderson Council Member Calvin Mundinger Council Member Don Murray Council Member Coleman Godwin Council Member Pete C. Alfaro Mayor Monte Mercer City Manager Ignacio Ramirez, Sr. City Attorney Gary W. Smith City Clerk Absent was: Victor Almendarez Council Member The meeting was opened with a quorum present and Council Member Anderson led the pledge of allegiance and offered the invocation after which the following business was conducted: Consider Proposed Resolution No. 010605 -1 canvassing the returns of the run -off election held on June 2, 2001. The returns of the Runoff Election held on June 2, 2001 were canvassed by City Council. The Election Code requires the Council to canvass the returns of an election no sooner than two days, nor more than six days, after the date of the election. Council Member Sheley moved adoption of the resolution. Council Member Mundinger seconded the motion. The vote follows: Ayes: Council Members Anderson, Godwin, Mundinger, Murray and Sheley Mayor Alfaro. Nays: None. The motion carried. Im Page 2 of 2 Minutes of the Special Session —June 5, 2001 RESOLUTION NO. 1491 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CANVASSING THE RETURNS OF THE RUNOFF ELECTION HELD WITHIN THE CITY OF BAYTOWN ON THE 2ND DAY OF JUNE, 2001, FOR THE PURPOSE OF ELECTING ONE COUNCILMEMBER FROM DISTRICT NO. ONE; DECLARING THE RESULTS OF THE RUNOFF ELECTION; FINDING THAT NOTICE OF THE RUNOFF ELECTION WAS PROPERLY HELD AND THE RETURNS THEREOF MADE BY THE PROPER OFFICIALS IN ACCORDANCE WITH THE LAWS OF THE STATE OF TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Administer Oath of Office to the newly elected Council Member. Assistant City Manager /City Attorney Ignacio Ramirez administered the oath of office to Mercedes Renteria III. Mayor Pete C. Alfaro delivered the certificate of election to Council Member Renteria. Council Member Renteria introduced members of his family present in the audience. Consider Proposed Ordinance No. 010605 -1 authorizing an interlocal agreement with the Texas Department of Transportation for the relocation of a waterline along Spur 330 near West Baker Road. Proposed Ordinance No. 010605 -1, authorizes an interlocal agreement with the Texas Department of Transportation for the relocation of a waterline along Spur 330 with payment in the amount of $26,484.67. The City's 16 -inch waterline is in conflict with the construction of a new storm sewer system being installed just west of the intersection of Spur 330 (Decker Drive) and West Baker Road. TxDOT is proposing to issue a change order under their current contract with Balfour Beatty. This ordinance authorizes an interlocal agreement with TxDOT to reimburse the expenses to be incurred with the change order. The scope of work includes removal and replacement of approximately 58 linear feet of 16 -inch waterline (believed to be asbestos cement pipe) with a 16 -inch rolled offset welded steel section. This price includes $1,273.30 to dispose of the asbestos pipe, if necessary. Funding is available from the 1991 water bonds. Council Member Anderson moved approval of the ordinance. Minutes of the Special Session —June 5, 2001 ORDINANCE NO. 9170 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AN INTERLOCAL AGREEMENT WITH THE TEXAS DEPARTMENT OF TRANSPORTATION FOR THE RELOCATION AND DISPOSAL OF APPROXIMATELY 58 LINEAR FEET OF THE CITY'S 16-INCH WATER LINE ALONG SPUR 330 NEAR ITS INTERSECTION WITH WEST BAKER ROAD; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Adjourn. There being no further business, Council Member Godwin moved adjournment of the meeting. Council Member Mundinger seconded the motion.
