2000 10 12 CC MinutesMINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN October 12, 2000 The City Council of the City of Baytown, Texas, met in regular session on October 12, 2000, at 6:30 p.m., in the Council Chamber of the Baytown City Hall with the following in attendance: Victor Almendarez Council Member Calvin Mundinger Council Member Don Murray Council Member Coleman Godwin Council Member Pete C. Alfaro Mayor Monte Mercer City Manager Ignacio Ramirez City Attorney Gary W. Smith City Clerk Absent: Ronnie Anderson Council Member Scott Sheley Council Member The meeting was opened with a quorum present, and Council Member Godwin led the pledge of allegiance and offered the invocation, after which the following business was conducted: Consider Approval of Minutes for the Regular Meeting held on September 28, 2000 Council Member Almendarez moved to approve the minutes. Minutes of Regular Session — October 12, 2000 Presentations L. Fuller for his service on the Board of Directors, Ba ..lL . 20001012 -2 Mown Area Water Mayor Alfaro presented a plaque to Roy L. Fuller who was appointed as a Director of the Baytown Area Water Authority on July 12, 1990, and faithfully served his community in that capacity until August 15, 2000. Mayor Alfaro expressed the City of Baytown's appreciation for Mr. Fuller's dedicated, selfless service. John Brown Mayor Alfaro presented a plaque to John Brown for his unselfish bravery in rescuing a 55 -year old man from his burning apartment at 305 West Baker Road on October 4, 2000. Consider Proposed Ordinance No. 001012 -1 Approving an Interlocal Agreement for the Regional Retention Basin Construction with Harris County Flood Control District (HCFCD) This agreement allows the HCFCD to design and construct a retention basin using the eight -acre tract owned by the City next to the Animal Shelter. HCFCD's maximum cost contribution is $500,000. This retention basin makes use of an existing borrow pit and will be constructed to retain approximately four to eleven feet of water. Upon completion, the site is proposed for recreational use. Council Member Almendarez moved to adopt the ordinance. Council Member Murray seconded the motion. The vote follows: Ayes: Council Members Almendarez, Mundinger, Murray, and Godwin Mayor Alfaro Nays: None The motion carried. 20001012 -3 Minutes of Regular Session — October 12, 2000 ORDINANCE NO. 9014 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER TO EXECUTE AND THE CITY CLERK TO ATTEST TO AN INTERLOCAL AGREEMENT WITH HARRIS COUNTY FLOOD CONTROL DISTRICT FOR THE REGIONAL RETENTION BASIN CONSTRUCTION; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 001012 -2 Authorizing Payment to Harris County Treasurer for Additional Work for Utility Conflicts on Harris County's Tri- Cities Beach Road Improvement Project The ordinance authorizes payment for $10,026 for additional work for utility conflicts on Harris County's Tri- Cities Beach Road Improvement Project. During construction of the road improvements, the contractor encountered City utilities in the way of their proposed storm drainage structure. The contractor had to install four junction boxes to avoid the obstructions. Previously, the City has paid Harris County $18,978 for the added drainage structure at Evergreen Road and the relocation of an existing eight -inch ductile iron sanitary sewer pipe. Recently, the City paid another $29,810 for the extension of the added drainage structure and guardrails. While three developers shared the expense of two payments, this expense will be borne solely by the City. Funding is available from the Water and Sewer Operating Fund. The City has always paid the costs of utility relocations on County road projects. The project is scheduled for completion in January 2001. Council Member Mundinger moved to adopt the ordinance. The vote follows: Ayes: Council Members Almendarez, Mundinger, Murray, and Godwin Mayor Alfaro Nays: None The motion carried. 20001012 -4 Minutes of Regular Session — October 12, 2000 ORDINANCE NO. 9015 AN ORDINANCE AUTHORIZING THE PAYMENT OF TEN THOUSAND TWENTY -SIX AND NO1100 DOLLARS ($10,026.00) TO HARRIS COUNTY TREASURER AS THE COST FOR ADDITIONAL WORK DUE TO UTILITY CONFLICTS ON HARRIS COUNTY'S TRI- CITIES BEACH ROAD IMPROVEMENT PROJECT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance 001012 -3 Authorizes a Contract with Harris County for Fire Protection in an Unincorporated Portion of Harris County This item will be considered at a future time. Consider Proposed Resolution No. 001012 -1 Designating the City of Baytown's Representative and Alternate to the General Assembly of the Houston - Galveston Area Council for the year 2001 Council Member Godwin nominated Council Member Murray as the representative and Mayor Alfaro as his alternate. Council Member Mundinger seconded the motion. The vote follows: Ayes: Council Members Almendarez, Mundinger, Murray, and Godwin Mayor Alfaro Nays: None The motion carried. RESOLUTION NO. 1457 A RESOLUTION APPOINTING D. C. (DON) MURRAY AS REPRESENTATIVE OF THE CITY OF BAYTOWN TO THE BOARD OF DIRECTORS AND THE GENERAL ASSEMBLY OF THE HOUSTON - GALVESTON AREA COUNCIL FOR THE YEAR 2001 AND PETE C. ALFARO AS ALTERNATE SHOULD D. C. (DON) MURRAY BECOME INELIGIBLE OR RESIGN; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 20001012 -5 Minutes of Regular Session — October 12, 2000 Consent Agenda Council considered the consent agenda items "a" through "e." a. Consider Proposed Resolution No. 001012 -2 accepting the award of the Local Law Enforcement Block Grant 2000 -LB -BX -1739 and authorizes additional actions related to said grant. The Baytown Police Department has received notice of the award of the grant funds from the Bureau of Justice Assistance, Office of Justice Programs, United States Department of Justice (Local Law Enforcement Block Grant) for 2000 -2002, in the amount of $82,831 including a local match of $8,283 to be provided by the Police Department's seized funds. The proposed resolution also authorizes the City Manager to serve as the City's representative for all purposes under the grant and to take all further actions necessary for acceptance of the grant. b. Proposed Ordinance No. 001012 -4 granting an easement to Reliant Energy, Inc., for the purpose of extending electric service to the City's new Municipal Court facility. This easement extends electric distribution as shown on the attached sketch. Existing electric distribution locations were not adequate. C. Proposed Ordinance 001012 -5 authorizes renewal of the annual sulfur dioxide contract with AOC — Acetylene Oxygen Company for $39,000. AOC submitted a written request to renew the current contract for the same pricing, terms and conditions. Quantities remain the same this year as last year. This product is used for dechlorination in the Wastewater Treatment Plants. d. Proposed Ordinance 001012 -6 awards the purchase of eleven vehicles from H -GAC for Engineering, Public Works /Utilities, Utility Billing, Parks and Recreation, and the Library for $221,856.42. The trucks will be purchased from Triangle Chevrolet, Inc. Ten vehicles are replacements for light duty trucks in the 2000 -01 budget. One vehicle is a new purchase for use by the Parks and Recreation litter crew. e. Proposed Ordinance 001012 -7 awards the sole source purchase of Eyewitness Industrial Grade Patrol Car Surveillance Systems for the Police Department from Kustom Signal, Inc. for $22,800. All surveillance systems are new. Kustom Signals, Inc., has the patent for this in -car video system and is the only manufacturer that makes this equipment. These systems include a video camera that sits on the front of the car and a locked recorder system in the trunk. These systems are used as a security measure to record the 20001012 -6 Minutes of Regular Session — October 12, 2000 events involving officers and any situations that may occur. Each in -car video system is $4,560.00. Funds will come from 2001 General Fund Capital Outlay. Council Member Almendarez moved to adopt the consent agenda items "a" through "e." Council Member Murray seconded the motion. In response to inquiry from Council on item "d," the City Manager stated that the budget approved a full -time litter crew and they would need the use of the vehicle. RESOLUTION NO. 1458 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING THE CITY MANAGER TO ACCEPT A GRANT AWARD IN THE AMOUNT OF EIGHTY -TWO THOUSAND EIGHT HUNDRED THIRTY -ONE AND N01100 DOLLARS ($82,831.00) FROM THE UNITED STATES DEPARTMENT OF JUSTICE; DESIGNATING AN AUTHORIZED REPRESENTATIVE; AUTHORIZING CREATION OF AN ADVISORY BOARD; PROVIDING FOR A PUBLIC HEARING; AUTHORIZING A CASH MATCH OF EIGHT THOUSAND TWO HUNDRED EIGHTY -THREE AND N01100 DOLLARS ($8,283.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
