The City Council of the City of Baytown, Texas, met in regular session on
September 28, 2000, at 6:30 p.m., in the Council Chamber of the Baytown City

The meeting was opened with a quorum present, and Council Member
Murray led the pledge of allegiance and offered the invocation, after which the

Citizen Communications
Nancy S. Cannon, 101 Bayou Drive, appeared to request road humps or a
stop sign near her home.
Ronnie Duncan, 2607 Cedar Bayou Road, appeared to request changes
to Sec. 14 -8 of the Code of Ordinances regarding swine in the city limits to
enable FFA members to raise swine.
Mark Fuqua, 7414 Lone Oak, appeared on behalf of the Pinehurst
Homeowners to request that the Fire Station specifically designated for Highway
146 be placed in the 2001 bond package.
Consider Appointment of a Collective Bargaining Representative
Council Member Mundinger moved to appoint the firm of Karger Key
Barnes & Springer, LLP. Council Member Murray seconded the motion. Council
Member Sheley urged vote against the motion in order to consider the firm that
would employ local council. The vote follows:

Receive Financial Statements and Management Letter for the Harris County
Organized Crime and Narcotics Task Force for the Grant Year ending
May 31, 2000
The independent audit of the financial statements was conducted by Tiller
and Company, a public accounting firm. Mr. Mark Tiller presented the report to
Council and stated that there were no exceptions to procedures as outlined and
no findings in compliance.

Consider Proposed Resolution No. 000928 -1 Supporting the Foreign Trade
Zone Subzone Designation for Project Superior
The proposed project will include a 750,000 — 1,000,000 square foot
building, creating 250 new jobs and a $25,000,000 initial investment. Foreign
Trade Zone designation is necessary for the project locating at Cedar Crossing.
The initial investment will be taxable. The requested designation is similar to the
designation approved for SAW Pipes USA, Inc. and Jindal Steel.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, SUPPORTING A FOREIGN TRADE ZONE
SUBZONE DESIGNATION FOR PROJECT SUPERIOR BY THE
PORT OF HOUSTON AUTHORITY; AND PROVIDING FOR THE
EFFECTIVE DATE THEREOF.
Consider Proposed Ordinance No. 000928 -1 Adopting a Water
Conservation/Drought Contingency Plan for the City of Baytown
The Texas Natural Resource Conservation Commission requested that all
water districts and cities review their drought contingency plans and include
greater details in the plans. The plan provides the required details for water
conservation. The ordinance provides for fines and penalties for violations,
should mandatory water conservation be required.

Consider Proposed Ordinance No. 000928 -2 Setting the Date, Time, and
Location for a Public Hearing on the Request of Voice Stream Wireless
Services for a Special Use Permit to locate a 180 -foot Monopole Tower and
Antenna at 4210 Highway 146
The ordinance sets the public hearing for October 26, 2000, at 6:45 p.m.
Section 21 -125 requires notice of public hearing be published in a newspaper of
general circulation at least sixteen days before the date of the public hearing.

Consider Proposed Ordinance No. 000928 -3 Setting the Date, Time, and
Location for a Public Hearing on a Proposed Amendment to the
Subdivision Ordinance relating to Curbs
The proposed ordinance sets the public hearing for October 26, 2000, at
6:55 p.m. Texas Local Government Code, Section 212.002 requires that a public
hearing be held prior to an amendment of the Subdivision Ordinance
Council Member Almendarez moved to adopt the ordinance. Council
Member Sheley seconded the motion. Council Member Murray moved that the
motion be amended to start the public hearing at 7:00 p.m. instead of 6:55 p.m.
in order that the public hearings be scheduled further apart. Council Member
Mundinger seconded the amendment. The vote on the amendment to the motion
follows:

ORDINANCE NO. 9004
AN ORDINANCE SETTING A DATE, TIME, AND PLACE FOR
THE PUBLIC HEARING ON THE PROPOSED AMENDMENT TO
CHAPTER 126 "SUBDIVISIONS" OF THE CODE OF
ORDINANCES OF THE CITY OF BAYTOWN, TEXAS, TO
ALLOW THE USE OF MOUNTABLE CURBS IN RESIDENTIAL
SUBDIVISIONS; AUTHORIZING AND DIRECTING THE CITY
CLERK TO PUBLISH NOTICE OF SUCH PUBLIC HEARING;
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
Consider Proposed Ordinance No. 000928 -4 Authorizing Renewal of
Liability and Property Insurance Programs with Texas Municipal League
Intergovernmental Risk Pool (TML) and Authorizing Payment
The ordinance authorizes renewal and authorizes payment in the amount
of $330,536 for premiums, reimbursable losses, and administrative fees at an
estimated decrease of $4,386 or 1.3 percent from last year's cost of $334,922.
Depending on how the pool performs, the City may receive experience credit.
The 1999/2000 liability premium amount included $30,686 in experience credits.
Council Member Murray moved to adopt the ordinance. Council Member
Anderson seconded the motion. In response to inquiry from Council, the City
Manager said the deductible was lower than previous years. The vote follows:

AN ORDINANCE RENEWING THE INTERLOCAL AGREEMENT
WITH TEXAS MUNICIPAL LEAGUE FOR THE ANNUAL
LIABILITY AND PROPERTY INSURANCE PROGRAM,
AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE
SUM OF THREE HUNDRED THIRTY THOUSAND FIVE
HUNDRED THIRTY -SIX AND NO/100 DOLLARS ($330,536.00)
AND THE SUM OF ONE HUNDRED THOUSAND AND N01100
DOLLARS ($100,000.00) FOR DEDUCTIBLES; MAKING OTHER

Consider Proposed Ordinance No. 000928 -5 Awarding the Specific and
Aggregate Stop Loss Coverage for the City's Health Benefit Program to
American Stop Loss Insurance Brokerage, Inc., and Authorizing Payment
The ordinance awards the City's Health Benefit Program and authorizes
payment for $224,870. The City received three bids and American Stop Loss
Insurance Brokerage, Inc., is the lowest responsible bidder. Both specific stop
loss and aggregate stop loss coverage are based on per employee, per month
rate; therefore, actual enrollment will dictate the total amount. The estimated
premium of $224,870 represents an 8.5- percent increase over the current year's
estimated cost of $207,332. Our current carrier, Sun Life of Canada, increased
their rates by 100 percent. One bid was received after the deadline. HCC, our
insurance consultant, reviewed the bids and concluded that the recommended
bid is competitive in the market.
Council Member Almendarez moved to adopt the ordinance. Council
Member Mundinger seconded the motion. In response to inquiry from Council
Member Almendarez, the City Manager stated that Sun Life of Canada increased
their rates by 100 percent because they had lost money the last two years and
wanted out of the market. The vote follows:

Limits on Portions of State Highway 146 and Business 146 within the
Corporate Limits of the City of Baytown
The ordinance alters the speed limits and authorizes and directs the
placement of signs by the Texas Department of Transportation Project Director
The ordinance directs the posting of signs and establishes fines for violations.

AUTHORIZING AND DIRECTING THE PLACEMENT OF SIGNS
BY THE TEXAS DEPARTMENT OF TRANSPORTATION
PROJECT DIRECTOR; REPEALING ORDINANCES
INCONSISTENT HEREWITH; CONTAINING A SAVINGS
CLAUSE; PRESCRIBING A MAXIMUM PENALTY OF TWO
HUNDRED AND NO /100 DOLLARS ($200.00); AND PROVIDING
FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF.
Consider Approval of Plans and Specifications and Approval to Award
Contract for the Central District Wastewater Treatment Plant Chlorination
Header Repairs Project to Whitelak, Inc.
The repairs will be for $98,420. The scope of work is to remove and
replace existing 36 -inch and 42 -inch piping with C905 PVC to repair the leaking
chlorination header. This is being done as an emergency repair due to
unforeseen failure of the equipment. Chlorinated water is leaking onto the plant
site and is not being contained within the treatment process for final
dechlorination as is required by the permit for operation of the plant. However,
none of the chlorinated water is escaping from the plant site and no threat is
posed to any property or body of water at this time. Four potential bidders
attended the prebid meeting and we received four bids. The project will be

funded by 1991 bond funds interest earnings. The construction duration is 45
calendar days.

specifications and to adopt the ordinance to award the contract for the Central
District Wastewater Treatment Plant Chlorination Header Repairs Project to

AN ORDINANCE DECLARING THAT AN EMERGENCY

Ruby Pinson, Director of the Baytown Opportunity Center, has
reviewed and approved the contract.
b. Proposed Ordinance No. 000928 -8 authorizes a professional
services agreement for the Houston High Intensity Drug Trafficking
Area (HIDTA) Program with Stanley E. Furce, Individually and d /b /a
Research International. Since September 1990, the City has
administered federal funds designated for the operation of the
HIDTA Major Offender Project. This agreement is similar to that
which was entered into last year and is contingent on funding by
Grant/Award made available through the Office of the National
Drug Control Policy ( "ONDCP "). The agreement obligates the
contractor to provide professional services as directed by HIDTA
Executive Committee and ONDCP. No City funds will be used.
C. Proposed Ordinance No. 000928 -9 authorizes the sole source
payment for the annual software maintenance agreement to
Versaterm, Inc. for the Police and Fire Departments Maxi -CAD,
mapping and document - imaging software to Versaterm, Inc., for
$29,100. This agreement for a period of September 1, 2000, through
August 31, 2001. These are annual software maintenance
agreements that provide support in the event of programming
upgrades, bug fixes, telephone support, etc.
d. Proposed Ordinance No. 000928 -10 authorizes purchase of one
2000 Ford Crown Victoria for the Police Department through
Houston Galveston Area Council (H -GAC) for $20,986.64. This
includes the H -GAC fee.
e. Proposed Ordinance No. 000928 -11 awards the annual heating,
ventilation, and air - conditioning (HVAC) contract to Bay
Temperature Control, Inc., for $103,081.16. Invitations to bid were
mailed to eight bidders and we received four bids and two no -bids.
Young's Plumbing does not have enough staff to bid such a large
contract. HVAC Mechanical Services out of Houston no -bid because
they did not have enough time to prepare a bid. This company
picked up a bid shortly before opening deadline. Roy Blackwell plans
to retire next year and did not bid. This contract includes two
sections: Section I— Monthly Preventative Maintenance for 33 City
locations includes changing and /or cleaning of filters, and Section II - --
Repairs and replacement of HVAC equipment and materials. All
material and equipment will be priced at actual cost plus 15 percent.

Hourly service call labor rate will be $42.50. Included in this contract
will be the new jail and court facilities, which were not reflected, in
previous cost history.
Locations included in the monthly preventative maintenance portion
of this contract include the Parks and Recreation Communication
Building, Bayland Ship Store, Ninfa's Restaurant, Park's Service
Center and Green House, Gray Center, Wetlands Center, Health
Department, Police Department Administration Building, Jail Facility
(new facility), Police Department Police Academy, Police Sub -
Station, Animal Control, Police Range, Police Garage, Police Blue
Storage Building, Police 911 Building, Radio Shop, Sterling
Municipal Library, Municipal Service Center and MSC Utilities
Building, Traffic Department, Fire Department Administration
Building, Fire Stations No's. 1 -5, City Hall, Tax and Utility Billing
Department, EMS Department, West, East, and Central District
Wastewater Treatment Plants, and Municipal Court (new facility).
Council Member Sheley moved to adopt the consent agenda items "a"
through "e." Council Member Godwin seconded the motion. In response to inquiry
from Council, the City Manager said that on item "a" in the Wayne Gray Sports
Complex, November and December were skipped because they are low utilization
months. Mayor Alfaro asked about item "e" where the low bidder was significantly
lower than the other bidders. The City Manager responded that maintenance was
$60,581.16 and repair was $42,500.00 for a total of $103,081.16. He said that the
city had put safeguards in place in the maintenance section to assure that the city
did not have more costs than it should. The preventive maintenance work will be
audited. The vote follows:

Consider Appointment to the Baytown Area Water Authority Board
Roy L. Fuller has submitted his resignation to the BAWA Board. He was
appointed as a director residing outside the city limits but within the boundaries of
the Authority and he has moved. This appointment will be to fill his term, which
expires September 1, 2001. Sam T. Shulze, a resident of Highlands, meets the
qualifications for this position and has agreed to serve if appointed.
Council Member Sheley moved to appoint Sam T. Shulze to the Baytown
Area Water Authority Board. Council Member Murray seconded the motion. The

Consider Appointments to the Building Ordinance Review Committee
The City Manager stated that the Building Ordinance Review Committee
was charged to review the local building codes and ordinances (but not the
national or standard codes) to determine the reasonableness of the codes, to
determine if the codes or ordinances are out -dated or unnecessary to protect the
public health, safety, and well being. The Council expects that the Committee's
review will be done in an analytical, unbiased method to assist City Council in
adopting reasonable building ordinances that protect the public health, safety,
and well being.
The Committee is to solicit information from the public concerning the local
building codes and ordinances. After receiving the information from the public,
the Committee shall meet to discuss the issues raised by the public that are
related to the codes and ordinances. The Committee shall seek assistance in
this task from persons with technical expertise in the area, including architects,
engineers, developers, builders, contractors, and members of the city staff.
Upon conclusion of its study, the Committee shall submit a written report
to the City Council with its recommended changes or alterations concerning local
building codes and ordinances. This review and report should be completed and
delivered to City Council by December 8, 2000.
The committee will be composed of members of the community. The
committee will be an ad hoc committee to review the local building ordinances
and make recommendations thereon.
Council Member Almendarez moved to nominate Carl Herring, Kenneth
Mayo, John Urban, Douglas Relyea, Darrell Friermood, Robert Crunk, and
Gilbert Chambers to the Building Ordinance Review Committee. Council
Member Anderson seconded the motion. After a brief discussion regarding
Council's desire that builders who obtain permits from the Inspection Department
not be included on the Committee, Council Member Almendarez amended his
motion to nominate Carl Herring, Kenneth Mayo, John Urban, Douglas Relyea,
Robert Crunk, and Gilbert Chambers with Carl Herring serving as Chairman.
Council Member Anderson accepted the amendment. The vote follows:

r City Manager's Report
National Leadership Grant
The National Leadership Grant has been awarded to Sterling Municipal
Library in conjunction with Partnership with Lee College, Exxon, The Baytown
Sun, and Baytown Historical Museum. The grant is for $258,290 for two years.
This is to develop a digitization project on the history and inception of the oil
industry in the state of Texas and the United States.
Texshare Borrower's Card
This card will allow Library members to use the libraries at Rice, University
of Houston, Lamar, Lee College, and special libraries such as, M. D. Anderson
Cancer Center Library.
Departmental Tour — Public Works— October 12
The departmental tour of Public Works is scheduled for the next Council
meeting on October 12.
Customer Service Training
The City has been performing customer service training throughout the
organization. We had some training in the Neighborhood Protection
Organization and awarded Maria Mora, Kathryn Shepherd, and Edward Branch
certificates in that training.
Ninth Annual Texas Tactical Peace Officers Association Training Symposium
and Competition
All members of the Police Force that participated in the Ninth Annual
Texas Tactical Peace Officers Association Training Symposium and Competition
were commended.
