The vote follows: Ayes: Council Members Almendarez, Mundinger, Murray, Godwin, and Sheley Mayor Alfaro Nays: None Abstained: Council Member Anderson Consider Proposed Ordinance No. 000608 -1 Setting the Time, Date, and Place for a Public Hearing Concerning Amending the Rules Governing Plats and Subdivisions of Land within the City for 6:35 p.m. on June 22, 2000 This public hearing is required by Section 212.002 of the Texas Local Government Code and must occur prior to council adopting or amending rules governing plats and subdivisions of land. The proposed change to the city's current subdivision ordinance pertains to changing the lot size for large lot developments. This proposed change is designed to promote the health, safety, morals, and general welfare of the city and the safe, orderly, and healthful development of the city. The Growth Management and Development Advisory Commission reviewed this issue at its meetings held on March 15, 2000. Prior to Council's consideration of the ordinance incorporating the proposed change, both the City's administration as well as the Growth Management and Development Advisory Commission will make a recommendation to the City Council. Consider Proposed Ordinance No. 000608 -2 Approving Deduct Change Order No. 2 to Adjust Final Quantities and Approving Final Payment for and Accepting Completion of the Tri- Cities Beach Road Sanitary Sewer Improvements, Evergreen Lift Station, Contract A, to T & C Construction, Inc. The ordinance approves Deduct Change Order No. 2 for $6,895 to adjust final quantities and approves final payment for and acceptance of completion of the Tri- Cities Beach Road Sanitary Sewer Improvements, Evergreen Lift Station, Contract A, for $27,485.50 to T & C Construction, Inc. The contract award amount was $281,750 and the final contract amount is $274,855, representing a 2.5- percent cost reduction. The cost reduction was largely due to the reduction in quantity of eighteen -inch force main and twenty -four inch gravity sewer line. This quantity of pipe was installed on Contract B instead of this contract. The contract original duration was 120 working days and Change Order No. 1 increased the contract time by 64 days. Change Order No. 2 increases the contract time by 26 workdays, at our request, for a total of 210 workdays. The contractor completed the work in 210 work days. The vote follows: Ayes: Council Members Almendarez, Anderson, Mundinger, Murray, Godwin, and Sheley Mayor Alfaro Nays: None 20000608 -4 Minutes of the Regular Session — June 8, 2000 ORDINANCE NO. 8922 AN ORDINANCE AUTHORIZING DEDUCT CHANGE ORDER NO. 2 WITH T &C CONSTRUCTION, INC., TO ADJUST THE FINAL UNIT BID QUANTITIES FOR TRI- CITIES BEACH ROAD SANITARY SEWER IMPROVEMENTS, EVERGREEN LIFT STATION, CONTRACT A; AUTHORIZING FINAL PAYMENT OF THE SUM OF TWENTY -SEVEN THOUSAND FOUR HUNDRED EIGHTY -FIVE AND 501100 DOLLARS ($27,485.50) TO T &C CONSTRUCTION, INC., FOR SAID PROJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 000608 -3 Approving Change Order No. 2 to the Tri- Cities Beach Road Sanitary Sewer Improvements, Eighteen -Inch Force Main, Contract B, to Elliott Contracting, Inc. The ordinance approves Change Order No. 2 for $18,159.46 to the Tri - Cities Beach Road Sanitary Sewer Improvements, eighteen -inch Force Main, Contract B, to Elliott Contracting, Inc. The Change Order is largely due to the addition of an eighteen -inch Force Main that was required to avoid conflict with a fiber -optic cable and a future storm sewer box culvert at the intersection of Evergreen Road and Tri- Cities Beach Road. An additional twenty -four inch gravity sewer line and pavement removal /replacement were required at the James Street Lift Station due to an unexpected concrete obstruction at the wet well. Additionally, the manhole was offset to allow coring of the wet well. The contract award amount was $624,907. Change Order No. 1 was a deduction of $18,451.80 caused by reducing the pipe wall thickness of the eighteen -inch force main. Change Order No. 2 adds $18,159.46 for a net deduction of $292.34. Therefore, the revised contract amount is $624.614.66, representing a 0.05 - percent cost reduction. The contract original duration of sixty working days remains the same. This work is funded by 1998 Certificates of Obligation. The City Manager said that there were contracts A, B, and C on the tri- Cities Beach Road Project for a total of $1,499,774. The final total was $1,446,828 which is 3.5 percent below on all three contracts. He commended Herb Thomas and his staff for their work on this project. Consider Proposed Ordinance No. 000608 -4 Awarding the Annual Sanitary Sewer Rehabilitation Contract—Year 2000 to P M Construction and Rehab, L.P. The ordinance awards the Annual Sanitary Sewer Rehabilitation Contract — Year 2000 for $848,800 to P M Construction and Rehab, L.P. Seven potential bidders attended the mandatory prebid meeting and we received six bids. The scope of work includes rehabilitation of the existing sanitary sewer conveyance system primarily using the pipe bursting method and includes some removal and replacement by open- trench methods as needed. The contract has flexibility for use on unforeseen or emergency projects. The engineer's estimated construction cost was $1,000,000 for the first year and another $1,000,000 for the second year. The construction duration is one calendar year with an option to renew for one additional year. This construction will be funded by 2000 Certificates of Obligation. Consider Proposed Ordinance No. 000608 -5 Amending the Engineering Service Contract with 3D /International Environmental Group (3D /1) to Implement a Texas Natural Resources Conservation Commission (TNRCC) LPST, Corrective Action Response, dated May 18, 2000, for 1200 Lee Drive and 3200 North Main Street sites The ordinance amends the engineering service contract with 3D /International Environmental Group (3D /1) to implement a Texas Natural Resources Conservation Commission (TNRCC) LPST, Corrective Action Response, dated May 18, 2000, for 1200 Lee Drive and 3200 North Main Street sites. The TNRCC approved both "Risk Based Assessment Plan A's" for LPST Nos. 113491 and 113265. This proposed amendment will authorize 3D /I to continue monitoring wells at 1200 Lee Drive for another twelve months and at 3200 North Main for another six months to further determine whether the contaminants, if left in place, pose a health risk. 3D /I will dispose purged groundwater and provide a Field Assessment Report. TNRCC has pre- approved reimbursement up to $13,618. This is funded by the 1991 bond program. Council Member Almendarez moved to adopt the ordinance. Council Member Mundinger seconded the motion. The vote follows: Ayes: Council Members Almendarez, Anderson, Mundinger, Murray, Godwin, and Sheley Mayor Alfaro Nays: None 20000608 -7 Minutes of the Regular Session — June 8, 2000 ORDINANCE NO. 8925 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING AMENDMENT NO. 4 TO THE AGREEMENT FOR ENGINEERING SERVICES BETWEEN THE CITY OF BAYTOWN AND =INTERNATIONAL ENVIRONMENTAL GROUP FOR THE IMPLEMENTATION OF TNRCC LPST CORRECTIVE ACTION RESPONSE FOR 1200 LEE DRIVE AND 3200 NORTH MAIN STREET SITES IN THE AMOUNT OF FOURTEEN THOUSAND ONE HUNDRED ELEVEN AND NO1100 DOLLARS ($14,111.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 000608 -6 Approving Deduct Change Order No. 5 to Adjust Final Quantities and Approving Final Payment to Craig, Sheffield & Austin, Inc., and Accepting Completion of the East District Sewage Treatment Plant 1.5 Million Gallons a Day (MGD) Expansion Contract The ordinance approves Deduct Change Order No. 5 to adjust final quantities in the amount of $25,654, and approves final payment in the amount of $132,776.29 to Craig, Sheffield & Austin, Inc., and accepts completion of the East District Sewage Treatment Plant 1.5 million gallons a day (MGD) Expansion contract The contract award amount was $2,610,900 and the final contract amount is $2,655,525.70, representing a 1.7- percent cost growth. The cost growth was largely due to hauling and stockpiling of excavated material, a pedestrian bridge connecting the existing clarifier to the new clarifier, and an operator platform with stairs to the splitterbox sluice gates. The contract original duration was 260 working days and Change Order No. 3 added 85 working days, for a total of 345 working days. The contractor completed the work in 345 working days. This work is funded by the Texas Water Development Board. This eliminates the EPA administrative order. Council Member Mundinger moved to adopt the ordinance. Consider Proposed Ordinance No. 000608 -7 Amending, in part, Ordinance No. 8912 to Impose Certain Conditions for Consent of the Transfer of Control of the Baytown, Texas, Cable Television Franchise, Initially Granted to TCI Cablevision of Texas, Inc., and Subsequently Transferred to Texas Cable Partners, L.P., from Time Warner, Inc., to AOL Time Warner, Inc. TWI expressed strong objections to the language contained in Ordinance No. 8912 concerning the conditions of the transfer consent. Specifically, the following issues objected to by TWI were addressed and resolved Being required to pay franchise fees on Internet service provided by its parent, subsidiaries or affiliates because those entities may have direct relationship with the customer. In such instances, billing and collections for the services would not be through the cable company. Classifying "access" to its lines as a cable service. TWI agreed that if internet services were provided through its cable facilities or if a third party were allowed access to its facilities to provide such services, franchise fees would be calculated on revenues received from such services and access. Consent Agenda Council considered the consent agenda items "a" through "f." a. Proposed Ordinance No. 000608 -8, authorizes an earnest money contract with Kathryn Bayne, Cliff and Kim Nickel, and Robert and Dorothy Jean Edmundson for the purchase of property along Goose Creek Stream. Pursuant to the proposed contract, the City will pay $5,100 for the property, which represents the property's appraised value as determined by Harris County Appraisal District. Specifically, this ordinance authorizes the City to purchase a total of 0.9447 acres along the stream. This acquisition is funded by the 1991 bond program. b. Proposed Ordinance No. 000608 -9, authorizes the installation of a traffic control signal at the intersection of Business 146 with Spur 55. Based on the traffic engineering study done by TxDOT, the Growth Management and Development Advisory Commission unanimously recommended approval of this installation. Upon approval, a contract traffic engineer will prepare plans and specifications. C. Proposed Ordinance No. 000608 -10, authorizes a contract with Spindlemedia, Inc., to provide software licensing for a Property Tax Application for $20,000 for six licenses and an internet browser for 20000608 -10 Minutes of the Regular Session — June 8, 2000 '' $9,995 and adds and a maintenance agreement in the amount of $6,000. Installation, training, and out -of- pocket expenses are estimated at $6,020. A Request for Proposal was prepared and published soliciting information on property tax applications. Five proposals were mailed and three were submitted. After a review of the proposals, site visits, and reference checks, Spindlemedia was recommended. The Finance Committee recommends approval. The new software will: • Allow an unlimited number of users to have view only access to property tax records; • Eliminate the need for costly view only software license; • Make public information more accessible via the Internet; • Point and click technology is very user friendly; • Provide real -time 24 -hour access to public information for mortgage companies, title companies, and real estate professions; • Allow the general public to query their tax records at their leisure reducing walk -in and call -in traffic; and • Provides a great enhancement to the current City Web Site. This project is funded by the Capital Replacement Fund. d. Proposed Ordinance No. 000608 -11, authorizes a contract with Porta Target, Inc., for $21,595 for the installation of twenty pneumatic turning target actuators for the Baytown Police Pistol Range. Invitations to bid were mailed to three suppliers and we received three bids. Funding is from DEA. e. Proposed Ordinance No. 000608 -12, awards the sale of Tract 1A, Abstract 65; W. Scott; Dayton Goose Creek Drive (adjacent to 1102 N. Main) to Casa Del Alfarero Church for $2,500. A deed without warranty will be issued by the Legal Department after payment is made to the City Clerk's Office. An invitation to bid was mailed to one bidder and we received one bid. f. Proposed Resolution No. 000608 -1, supports the Conservation and Reinvestment Act and requests that the United States Senate consider approval of the Act. Recently, the United States House of Representatives approved H.R. 701, the Conservation and Reinvestment Act (CARA), by an overwhelming vote of 315 to 108. CARA will provide funds to state and local governments to preserve open spaces, wildlife and historic facilities via the reinvestment of Outer Continental Shelf oil and gas revenues. If approved, the State of Texas will be allocated over $236 million for various programs, including the Land and Water Conservation Funds 20000608 -11 Minutes of the Regular Session — June 8, 2000 (LWCF) from which the City of Baytown has benefited. The LWCF was originally conceived in 1964 as a federal -state partnership program created to expand the nations park and recreation system via funds received from off -shore oil leasing fees. The City of Baytown received grants from the State of Texas via the LWCF in the 1970's for the acquisition and development of numerous parks that serve our citizens today. The LWCF was the original grants program for park land acquisition and development but no allocations have been made to the fund since 1995. In the past, these federal funds were administered through the Texas Parks and Wildlife Department. Should these funds become available again, the resulting grants will be administered through the Texas Parks and Wildlife Department in a similar manner as the Texas Local Park Fund Grants, from which the City has benefited in recent years.
