The meeting was opened with a quorum present, and Council Member
Sheley led the pledge of allegiance and offered the invocation, after which the

Consider Proposed Ordinance No. 000427 -1 Awarding the 1998 Municipal
Street Rehabilitation Program — Phase III to Angel Brothers Enterprises
Seven potential bidders attended the mandatory prebid meeting and we
received three bids. Angel Brothers Enterprises was the lowest responsible
bidder for $765,559. The scope of work includes 1'/2 to two -inch asphalt overlay
on Oklahoma and Market Streets, including base repairs and drainage
improvements. The engineer's estimated construction cost was $961,381.75.
The construction duration is 180 calendar days and will be funded by 1997
Certificates of Obligation.

ORDINANCE NO. 8890
AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY
MANAGER AND CITY CLERK TO EXECUTE AND ATTEST TO A
CONTRACT WITH ANGEL BROTHERS ENTERPRISES, INC.,
FOR THE 1998 MUNICIPAL STREET REHABILITATION
PROGRAM —PHASE III; AUTHORIZING PAYMENT OF THE SUM
OF SEVEN HUNDRED SIXTY -FIVE THOUSAND FIVE HUNDRED
FIFTY -NINE AND NO /100 DOLLARS ($765,559.00); MAKING
OTHER PROVISIONS RELATED THERETO; AND PROVIDING
FOR THE EFFECTIVE DATE THEREOF.
Consider Proposed Ordinance No. 000427 -2 Authorizing the Purchase of
Emergency Outdoor Siren Warning Units to Acoustic Technical, Inc.
The ordinance authorizes the purchase of three emergency outdoor siren
warning units from Acoustic Technical, Inc., for $76,814. This purchase will
complete Phase IV of the Emergency Outdoor Siren Warning System for the City
of Baytown. Phase IV sirens will be placed in the following areas: East Fayle at
Narcille, West Lynchburg Cedar Bayou at East Road, and West Baker Road at
Emmett Hutto Boulevard. The exact locations will be determined in the near
future. The original Request for Proposal was accepted by City Council on June
11, 1998, for a minimum of two units with the right to increase quantity. Three
units were purchased during the 1998 budget year as Phase I; three additional
units were purchased during the 1999 budget year as Phase II; three units were
purchased during the 2000 budget year as Phase III. Funding for the sirens is
available through the Division of Emergency Management grant for $22,500.
The balance of funding will be from the Capital Replacement Fund and will
require reimbursement in future budgets.

INSTALLATION OF THREE (3) EMERGENCY OUTDOOR SIREN
WARNING UNITS FROM ACOUSTIC TECHNICAL, INC.;
AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE
SUM OF SEVENTY -SIX THOUSAND EIGHT HUNDRED

Items 3, 4 and 5 deal with the Juvenile Curfew Ordinance.
Conduct public hearing at 6:35 p.m. on the need to continue the juvenile
curfew ordinance
Pursuant to Section 370.002 of the Texas Local Government Code, the
curfew ordinance must be reviewed every third year to evaluate its effects on the
community and on problems the ordinance was intended to remedy. The City's
juvenile curfew ordinance was originally passed on April 28, 1994, and last
reviewed on April 10, 1997. Prior to deciding whether to abolish, continue, or
modify the ordinance, the City Council must hold two public hearings. This is the
first public hearing.
Mayor Alfaro called to order the public hearing concerning the need to
continue the juvenile curfew ordinance of the City of Baytown. He asked
everyone desiring to speak at this hearing to sign the list in the foyer as that list
provides the speaking order for the hearing.
Chief Shaffer spoke to Council on the need to continue the juvenile curfew
ordinance. He stated that it not only reduced juvenile crime but reduced the
number of juveniles who became victims of crime.
As no one else had registered to speak, Mayor Alfaro closed the public
hearing.

Consider Proposed Resolution No. 000427 -1 Continuing the Juvenile

The City's juvenile curfew ordinance was originally passed on April 28,
1994, and continued in April 1997. Pursuant to Section 370.002 of the Texas
Local Government Code, the ordinance must be reviewed every third year to
evaluate its effects on the community and on problems the ordinance was
intended to remedy. The City Council has held the requisite public hearings.
This proposed resolution permits the curfew ordinance to continue, rather than to
expire by operation of law.
Council Member Sheley moved to adopt the resolution. Council Member
Almendarez seconded the motion. The vote follows:

RESOLUTION NO. 1439
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF

ARTICLE IV "CURFEW FOR MINORS" OF THE CODE OF
ORDINANCES OF THE CITY OF BAYTOWN, TEXAS; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.

Consent Agenda
Council considered the consent agenda items "a" through "c" and "e"
through "h."
a. Proposed Ordinance No. 000427 -3 authorizes a contract for the
2000 Fourth of July Celebration Entertainment Main Headliner
(Rick Trevino) to Texas Sounds for $13,000. The Fourth of July
Celebration is providing a spectacular afternoon /evening program.
The new millennium will bring in Country Star Rick Trevino as this
year's headliner. Funds will come from the Hotel /Motel Fund.
b. Proposed Ordinance No. 000427 -4 authorizes final payment and
acceptance of the Demolition of Bayway Drive Ground Storage
Tank to Water Tank Service Company for $12,390. The contract
award amount was $12,390.00 and the final contract amount is the
same. The scope of work involved the dismantling and removal of
the Bayway Ground Storage Tank. The contract original duration
was 45 working days and the contractor completed the work in 15
working days. This work was funded by the Utility Department's
Operating Fund.
C. Proposed Ordinance No. 000427 -5 awards the Police Firing Range
Improvements to Nunn Construction, Inc. for $90,572. Six potential
bidders attended the mandatory pre -bid meeting and two bids were
received. The scope of work includes replacement of the existing
two -story wooden tower with a new workshop and restroom, and
construction of a new two -story firing range tower. The engineer's
estimated construction cost was $65,000. The construction
duration is 100 calendar days and will be funded by DEA Funds.
e. Proposed Ordinance No. 000427 -7, authorizes the purchase of
plastic garbage bags through Houston - Galveston Area Council
(HGAC) for $65,999.57. The HGAC fee is $1,168.31. Price per
pound will be $0.39 for 166,234 pounds ($64,831.26). Last year's
price per pound with Arrow Industries was $0.38 per pound, for an
awarded amount of $61,560.00. A quote from Arrow Industries is
$0.625 per pound this year. This year's price is a 2.63 - percent
increase compared to last year's price.
f. Proposed Ordinance No. 000427 -8 rejects bids of March 2, 2000,
and awards the bid of April 11 for the purchase of lighting systems
for three soccer fields to Sports Facilities and Company for
$72,695. Invitations to bid were mailed to eleven bidders and we
received seven bids and one no -bid. This contract was rebid to
include materials, equipment, and installation for all three soccer

' fields. The first bid included Soccer Field Nos. 8 and 9 equipment
only, did not include installation, and the low bid was $75,000.
Neither bid includes electrical work.
g. Proposed Ordinance No. 000427 -9 awards the bid for the purchase
of a thermal imaging camera for the Baytown Fire and Rescue
Services from ADH Marketing, for $13,600. Invitations to Bid were
mailed to four suppliers and we receive two bids. A thermal
imaging camera is a handheld infrared imaging device that will be
used by fire fighters to see through smoke conditions in structure
fires to search the hazard zone and rescue trapped victims. It can
also be used to locate fires in concealed spaces such as walls and
ceilings thereby reducing fire and fire control damage.
h. Proposed Ordinance No. 000427 -10 abandons a sixteen -foot utility
easement that is located in Reserve "A" of Baytown Central
Subdivision and authorizes conveyance of the City's interest in the
property. The easement is located where the new Wal -Mart store
is proposed. The owner of the property on each side of the
easement is SIC Management Company No. 26 LTD. and has
requested the abandonment. The City, Reliant Energy HL &P,
Reliant Energy Entex and Time - Warner Cable have stated that
there are no utilities in the easement. Sufficient easements will be
dedicated with the development of the new store. The easement
will be sold for $5,575.68 ($0.50 per square foot). Upon payment to
the City Clerk's Office, a Quit -Claim Deed will be delivered to SIC
Management Company No. 26 LTD.

Consider Rejecting Bids for the Police Department Pistol Range Surface
Treatment Project
AAA Asphalt Paving, Inc., was the apparent low bidder for $47,362.25.
The engineer's estimated construction cost was $40,000. The administration
recommended rejecting all bids. Council Member Byford moved to reject all bids.

Consider Appointment to the Long -Range Planning Commission
The unexpired term of Mr. Jim Entringer on the Long -Range Planning
Commission needs to be filled. Joe C. Floyd is a resident of District 4 and
possesses the qualifications necessary to complete Mr. Entringer's term. Mr.
Floyd has agreed to serve if appointed. Council Member Byford moved to
appoint Mr. Joe C. Floyd. Council Member Almendarez seconded the motion.

Hold Hearing on the Appeal of the Decision of the Urban Rehabilitation
Standards Review Board Concerning the Property at 112 and 203 Avenue L
Mayor Alfaro called to order the appeal of the decision of the Urban
Rehabilitation Standards Review Board of the City of Baytown to demolish the
duplexes located at 112 and 203 Avenue L, Baytown, Texas. He stated that the
appeal was being held at the request of Carol Young of Young's Homestead
Management, LLC, the owner of the structures. He asked if the parties wished to
pursue the appeal.
Debbie Barnes, Code Enforcement Officer, City of Baytown, presented an
agreed order signed by both parties. Ms. Barnes said the owner agreed to
secure the property in accordance with City code and had thirty days to comply
with other applicable City codes.
Consider Approval of the Agreed Order concerning the property at 112 and
203 Avenue L
Council Member Sheley moved to approve the Agreed Order. Council

City Manager's Report
Baytown Nature Center
David Ondrias was very successful in getting an article in the May 2000
"Southern Living."
State Implementation Program
Fire Chief Bob Leiper spoke to Council on the State Implementation Plan
(SIP) which is Texas' response to the EPA mandate to reduce ozone levels in the
lower atmosphere in non - attainment areas, including the eight - county Houston -
Galveston- Brazoria area.
Harmful ozone is formed when volatile organic compounds (Voc) and
nitrogen oxide (Nox) interact with sunlight. Ozone is the main component of
smog and is primarily a daytime problem in the summer months. Other non -
attainment areas are Dallas -Fort Worth, El Paso, and Beaumont -Port Arthur.
The Clean Air Act requires a reduction in emissions that contribute to
ozone by the year 2007. While many people believe the increases in ozone are
caused solely by industrial emissions, vehicles and off -road equipment are
significant contributors. A clear example is the Dallas -Fort Worth Area. They do
not have a petro - chemical industry yet they are an non - attainment area. In fact if
you eliminated all industrial emissions from the Houston area, closed every
single plant, we would still be a non - attainment area.
Some of the proposed actions are a twenty- percent reduction in driving.
In other words, non - driving days. Reductions in industrial emissions by ninety
percent which appear to be technically impossible to achieve. California was
only able to achieve an average of eighty percent reduction of emissions and that
included a substantial number of plant closings; the use of California -type
gasoline or diesel or low sulfur blends; the installation of catalytic converters on
large trucks or other exemptive equipment such as diesels; a change of the type
of lawn equipment sold such as the conversion to electric power for mowers,
edgers, and trimmer; a ban on outdoor construction activities before noon,
because this type of activity in the morning contributes to ozone formation later in
the day; the mandatory replacement of older construction equipment that is not
environmentally friendly; and the reduction of the maximum speed limit back to
55 miles per hour.
A timetable for the Houston area SIP is not final, but we expect proposed
regulations to be published for comment for June or July of this year. Public
hearings will follow and the SIP and final rules must be submitted to the EPA by
the end of this year. This is a fast moving process that will involve us all. If we
do not meet the EPA requirements, we face severe consequences. There could

be a moratorium in building permits in the eight - county area which would mean
no growth, no new construction of any type, residential or commercial. We could
lose millions of dollars in federal highway funds.
The Baytown SIP Education Committee was formed to inform our
residents on this issue. It includes representatives from the City, the County, H-
GAC, industry, and is led by Mayor Alfaro. We will hold a Community Leadership
Meeting on May 15 in conjunction with the Citizens Advisory Panel or CAP
meeting. We plan to hold at least one public forum in July to gather comments
for possible inclusion in the SIP. The successful reduction of harmful ozone will
take the involvement of our entire community, residential, commercial, industrial,
as well as reasonable regulations that may be attained.
In response to inquiry from Council, Chief Leiper stated that the proposed
rules for Dallas had been published and they are in the comment period at this
time.
Mayor Alfaro Comments
Mayor Alfaro thanked Judge Eckels, industry representatives, and Exxon
for working with the City very closely to get information to the community.
Mayor Alfaro thanked Council Member Byford for his service to the
community and commented that Council Member Byford would attend one more
meeting.
