2000 04 20 CC Minutes, SpecialMINUTES OF THE SPECIAL SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN April 20, 2000 The City Council of the City of Baytown, Texas, met in special session on April 20, 2000, at 8:45 a.m., in the Don M. Hullum Conference Room of the Baytown City Hall with the following in attendance: Victor Almendarez David Byford Calvin Mundinger Coleman Godwin Scott Sheley Pete C. Alfaro Monte Mercer Ignacio Ramirez Gary W. Smith Council Member Council Member Council Member Council Member Council Member Mayor City Manager City Attorney City Clerk The meeting was opened with a quorum present after which the following business was conducted: Consider Proposed Resolution No. 000420 -1 Concerning Collective Bargaining The proposed resolution opposes the adoption of state law that establishes collective bargaining for the firefighters of the City of Baytown and urges the citizens to vote against the firefighters' collective bargaining proposition in the election on May 6, 2000. Mr. Marshall Hutton, Baytown Professional Firefighters Association, spoke in favor of collective bargaining and in opposition to the resolution. The City Manager read the proposed resolution and recommended adoption of the resolution. Council Member Almendarez moved to adopt the resolution. Council Member Mundinger seconded the motion. 20000420 -2 Minutes of Special Session — April 20, 2000 Discussion ensued in which the members of Council spoke in support of the Fire Department but against collective bargaining as it could affect the ability of Council and the administration to make decision concerning the City. The vote follows: Ayes: Council Members Almendarez, Byford, Mundinger, Godwin, and Sheley Mayor Alfaro Nays: None The motion carried. RESOLUTION NO. 1438 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, OPPOSING THE ADOPTION OF STATE LAW THAT ESTABLISHES COLLECTIVE BARGAINING FOR THE FIREFIGHTERS OF THE CITY OF BAYTOWN AND URGING THE CITIZENS TO VOTE AGAINST THE FIREFIGHTERS' COLLECTIVE BARGAINING PROPOSITION IN THE ELECTION ON MAY 6,2000; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Disbanding Committee for Voter Information on Collective Bargaining The committee asked Council to disband the committee. The Firefighters Association declined to meet with the Committee; therefore, the purpose of the Committee could not be attained. Council Member Godwin moved to disband the committee. Council Member Byford seconded the motion. Council Member Sheley spoke against the motion in the event the Association would meet with the Committee. The vote follows: Ayes: Council Members Almendarez, Byford, Mundinger, and Godwin Mayor Alfaro Nays: Council Member Sheley The motion carried. Consider Confirmation of City Manager's Appointments of Assistant City Manager and Public Works Director The City Manager asked Council to affirm his appointment of Ignacio Ramirez as Assistant City Manager and Fred Pack as Public Works Director. The City Manager reviewed the duties of the Public Works Director and the background and experience of Fred Pack. Council Member Mundinger moved to confirm the appointment of Fred Pack as Public Works Director. Council Member Byford seconded the motion. The vote follows: Ayes: Council Members Almendarez, Byford, Mundinger, Godwin, and Sheley Mayor Alfaro Nays: None The motion carried. The City Manager reviewed the duties of the Assistant City Manager over internal services and the background and experience of Ignacio Ramirez. Council Member Mundinger moved to confirm the appointment of Ignacio Ramirez as Assistant City Manager. Council Member Byford seconded the motion. Discussion ensued with Council Member Almendarez inquiring about the working relationship between Mr. Ramirez and the City Manager. Mayor Alfaro spoke in support of the confirmation as did Council Member Byford, Sheley, and Godwin. The vote follows: Ayes: Council Members Byford, Mundinger, Godwin, and Sheley Mayor Alfaro Nays: Council Member Almendarez The motion carried.
