Frank Hinds, Jr., commemorating his service to the City of Baytown as Council Member for District No. 4 from June 10, 1983, through March 22, 2000. Consider Proposed Resolution No. 000309 -1 Amending Resolution No. 947, Section 1(h), to Delete the Requirement that the Result of Each Vote be Announced by the City Clerk. Robert's Rules of Order Provide that the Chair shall Announce the Result of Each Vote Taken The procedure adopted by Council, requiring the City Clerk to announce each result, is at variance with Robert's Rules. This amendment will leave the rules of procedure intact while deleting the requirement that the City Clerk announce the result of each vote. The Chair would be required to announce the result. Council Member Mundinger moved to adopt the resolution. Council Member Hinds seconded the motion. RESOLUTION NO. 1429 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AMENDING RESOLUTION NO. 947, ENACTED ON APRIL 24, 1986, TO DELETE THE REQUIREMENT THAT THE CITY CLERK ANNOUNCE THE RESULT OF EACH VOTE OF THE CITY COUNCIL; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. IN 20000309 -3 Minutes of Regular Session — March 9, 2000 Consider Proposed Ordinance No. 000309 -1 Amending Section 126- 641(c) "Widths" of the Code of Ordinances to Reduce the Minimum Street Width for Local Streets The ordinance reduces the minimum street width for local streets to 28 feet back -to -back Section 126- 641(c) of the Code of Ordinances, "Widths," requires local street width to be 28 feet face -to -face. On February 16, 2000, the Growth Management and Development Advisory Commission voted to recommend reducing the minimum street width of residential or local streets to 28 feet back -to -back. This will bring the City standards in line with other governmental entities such as Harris County and surrounding communities. The vote was unanimous in recommending this amendment to City Council. Council Member Sheley moved to adopt the ordinance. Council Member Byford seconded the motion. N 20000309 -4 Minutes of Regular Session — March 9, 2000 Consider Proposed Ordinance No. 000309 -2, the First Reading of the Ordinance Annexing all Property currently within the Extra - Territorial jurisdiction of the City of Baytown between Garth Road on the east, Bush Road on the west, West Lynchburg Cedar Bayou Road (also known as Cedar Bayou Lynchburg Road) on the north and Baker Road on the south, save and except the 18.59 -acre tract currently in the annexation process, and including the area between Ginger Creek and Bush Road that is bounded by Ginger Creek on the west, Bush Road on the east, Quail Hollow on the south, and West Lynchburg Cedar Bayou Road on the North The City of Baytown has received a request to annex a 49.7154 -acre tract platted as Country Club Cove I LTD located on Bush Road. The subdivision consists of 184 lots for homes in the $100,000 to $130,000 price range. The City is in the process of annexing an 18.59 -acre tract for a future location of Home Depot. Therefore, the administration is recommending that this entire area be annexed due to the development there, its close proximity to the city, to avoid surrounding an unannexed area, and to square up the city limits. In accordance with state law, two public hearings were held on the proposed annexation on February 10, 2000. The following persons spoke in opposition to the annexation: Boyce Stallford, Bush Road Larry Holloway, Bush Road Council Member Mundinger moved to adopt the ordinance. Council Member Hinds seconded the motion. In response to inquiry from Council Member Almendarez, the City Manager said that since this was the first reading of the annexation ordinance, the City could reduce but not increase the area being annexed before the second and final reading. In addition, he said that the City could not annex in such a way as to completely encircle an area. Council Member Hinds asked if the residents of the area being considered for annexation would be grandfathered on agricultural. The City Attorney stated that if the property was being used for agricultural purposes at the time of annexation, it could still be used for agricultural purposes by the current owners and subsequent purchasers as long as the use did not cease. However, he said that the property owners would be subject to nuisance and other city ordinances. The City Manager commented that the area was being furnished City services of sewer, water, EMS, and fire protection. 20000309 -5 Minutes of Regular Session — March 9, 2000 Mayor Alfaro asked if Council could pass this ordinance on the first reading with the understanding that it will be modified and brought back to Council for the second and final reading. The City Manager said the administration would present two options to Council. ORDINANCE NO. 8853 AN ORDINANCE PROVIDING FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF ALL PROPERTY CURRENTLY WITHIN THE EXTRATERRITORIAL JURISDICTION OF THE CITY OF BAYTOWN BETWEEN GARTH ROAD ON THE EAST, BUSH ROAD ON THE WEST, WEST LYNCHBURG CEDAR BAYOU ROAD (ALSO KNOWN AS CEDAR BAYOU LYNCHBURG ROAD) ON THE NORTH AND BAKER ROAD ON THE SOUTH, SAVE AND EXCEPT THE 18.59 -ACRE TRACT CURRENTLY IN THE ANNEXATION PROCESS AND INCLUDING THE AREA BETWEEN GINGER CREEK AND BUSH ROAD THAT IS BOUNDED BY GINGER CREEK ON THE WEST, BUSH ROAD ON THE EAST, QUAIL HOLLOW ON THE SOUTH, AND WEST LYNCHBURG CEDAR BAYOU ROAD ON THE NORTH; WHICH SAID TERRITORIES LIE ADJACENT TO AND ADJOIN THE PRESENT BOUNDARY LIMITS FOR THE CITY OF BAYTOWN, TEXAS. 20000309 -6 Minutes of Regular Session — March 9, 2000 Items 7 and 8 are Related and May Be Considered Together Consider Proposed Ordinance No. 000309 -3, the Second and Final Reading on the Proposed Annexation of an 18 -Acre Tract, more or less, at the Southwest corner of Garth Road at West Lynchburg Cedar Bayou Road Consider Proposed Ordinance No. 000309 -4 Placing an 18 -Acre Tract, more or less, at the Southwest Corner of Garth Road at West Lynchburg Cedar Bayou Road in the Proper Council District which will be District Number Four. The City of Baytown received a request to annex the property and plans to annex the adjoining roadway at this location. The owners of the property, Jerilyn Novosad, Lula Fay Benes, and Luther Glenn Yarbrough have requested annexation of the tract. Plans are to construct a Home Depot at this site. In accordance with state law and the charter of the City of Baytown, the first reading on annexation was held not more than forty nor less than twenty days after the public hearings. Public hearings on the proposed annexation of this tract were held at the council meeting on December 9, 1999. Proposed Ordinance 000309- 3 was published on January 28, 2000, and at least thirty days have elapsed since the publication. Therefore, City Council may cause the ordinance to be adopted on second and final reading. All procedures prescribed by state law and charter have been met to allow council to proceed on the final reading. Proposed Ordinance 000309 -4 places the area in Council District Four. Council Member Godwin moved to adopt Proposed Ordinance Nos. 000309 -3 and 000309 -4. Council Member Almendarez seconded the motion. Items 9, 10, and 11 are Related and May Be Considered Together Consider Proposed Ordinance No. 000309 -5 Authorizing a Ground Lease with Edmundson Interests, L.L.C., for the Development and Operation of a Hotel Facility at Bayland Park Consider Proposed Ordinance No. 000309 -6 Authorizing a Development Agreement with Edmundson - Interests, L.L.C., for the Development of a Convention Center at Bayland Park Consider Proposed Ordinance No. 000309 -7 Authorizing a Facility Management Agreement with Edmundson Interests, L.L.C., for the Management, Operation, and Marketing of the Convention Center at Bayland Park Items 9, 10, and 11 were withdrawn from consideration. Consider Proposed Ordinance No. 000309 -8 Calling a Special Election to be held on May 6 for the Purpose of Submitting to the Voters the Question of Collective Bargaining for the Firefighters of the City of Baytown According to state statute, such an election must be held upon the presentation of a proper petition signed by five percent of the voters voting in the City during the last general election for state and county officials. The petition has been certified and the election is to be held on the first uniform election date following forty -five days after certification of the petition. The proposed ordinance establishes procedures for holding the election; names the judges, alternates, and locations for polling places; establishes the location for central counting, names the general manager and presiding judge of central counting, and provides for early voting hours and board. As the Municipal Election will be held the same day, the same procedures, persons, officials, and places will be used. 20000309 -8 Minutes of Regular Session — March 9, 2000 Paul Munoz, 12322 Nola Court Mr. Munoz spoke to Council in support of collective bargaining for firefighters. Council Member Sheley moved to adopt the ordinance. Council Member Mundinger seconded the motion. ORDINANCE NO. 8855 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ORDERING A SPECIAL ELECTION TO BE HELD ON THE 6T" DAY OF MAY, 2000, FOR THE PURPOSE OF VOTING FOR OR AGAINST THE ADOPTION OF THE STATE LAW APPLICABLE TO FIRE FIGHTERS THAT ESTABLISHES COLLECTIVE BARGAINING; PROVIDING FOR THE ELECTION OFFICERS; DESIGNATING THE PLACES AND MANNER OF HOLDING SAID ELECTION; PRESCRIBING THE HOURS; ESTABLISHING THE CENTRAL COUNTING STATION; PROVIDING FOR AN EARLY BALLOT BOARD FOR EARLY BALLOTS; AND PROVIDING FOR THE POSTING AND PUBLICATION OF NOTICE. Item 13 was withdrawn. Consent Agenda Council considered the consent agenda items "a" through "k." a. Proposed Ordinance No. 000309 -9 authorizes an Industrial District Agreement with Calpine Construction Finance Company, L.P., for a seven -year period. This is the first such agreement with Calpine Construction Finance Company, L.P., whose business primarily produces energy using geothermal steam. The company's facility is located within Industrial District No. 3. 20000309 -9 Minutes of Regular Session — March 9, 2000 b. Proposed Ordinance No. 000309 -10 amends Chapter 58 "Manufactured Homes, Mobile Homes and Parks," Article I "in General," Section 58 -6 "Skirting required," Subsection (a)(1) of the Code of Ordinances. This amendment requires skirting to be installed prior to final inspection, rather than sixty days after placement of a manufactured home or recreational vehicle. This change is recommended to increase the efficiency of manufactured home and recreational vehicle inspections as well as to ensure compliance with the skirting requirements contained in the Code of Ordinances. C. Proposed Ordinance No. 000309 -11 awards the bid for demolition of at 501 East Texas (commercial building) and 223 and 223 -% West Main (commercial building and house) to the second low bidder, Durrett Demolition in the amount of $18,646.20. The low bidder, B.M. Demolition, was not able to meet the insurance requirements. Asbestos surveys were not received until September, 1999. Due to the cost and timing, these structures were budgeted for the 1999 -2000 fiscal year. Eleven bid packages were picked up and returned. d. Proposed Ordinance No. 000309 -12 awards the bid for demolition of at 1105 North 4th (shed), 309 West Cleveland (house), 1614 West Texas (two barns), 209 Lincoln Cedars (house), to Durrett Demolition in the amount of $6,400; and at 1100 Johnston (house), 619 Willow (houselgarage), 1101 Stowe (house), and 716 Willow (two story structure) to Durrett Demolition in the amount of $8,990 for a total of $15,390. The structure located at 716 Willow is a voluntary demolition. The Urban Rehabilitation Standards Review Board issued orders to demolish the remaining structures on January 10, 2000. Eleven bid packages were picked up and returned. e. Proposed Ordinance No. 000309 -13 awards the annual police and animal control uniform contract to Direct Action Uniforms in the amount of $45,775.98. Invitations to bid were mailed to eight bidders and we received four bids and one no -bid. This contract has three sections and may be awarded separately. Skaggs is the apparent low bidder for Section II. However, Skaggs did not meet specifications. Direct Action Uniforms is the low bidder meeting specifications for all three sections and we recommend they be awarded the entire bid. Award of the contract is a 46.74 - percent increase compared to last year's contract due to the addition of alternative uniforms and quantities being increased to allow for sixteen new officers. 20000309 -10 Minutes of Regular Session — March 9, 2000 f. Proposed Ordinance No. 000309 -14 authorizes purchase of tactical armor for the Harris County Organized Crime /Narcotics Task Force to C & G Wholesale /dba C & G Police Supply in the amount of $23,265. Invitations to bid were mailed to four suppliers and we received four bids. g. Proposed Ordinance No. 000309 -15, awards the bid for purchase of a tractor for the Parks and Recreation Department to Lansdowne Moody Company, Inc., in the amount of $23,589. Invitations to bid were mailed to nine suppliers and we received three bids and three no -bids. h. Proposed Ordinance No. 000309 -16 authorizes renewal of the annual janitorial product contract on Items 1 -13 to Morse Wholesale Paper Company in the amount of $23,541.55 and on Item 14 to Groves Industrial Supply in the amount of $3,250, for a total of $26,791.55. This contract is used to stock the Central Warehouse for distribution of janitorial products to all departments. This renewal is the same unit pricing, terms, and conditions as last year's contract. i. Proposed Ordinance No. 000309 -17 awards the sole source purchase of five patrol car surveillance systems to Kustom Signal, Inc., in the amount of $22,800. The systems are for the Police Department. Kustom Signals, Inc., has the patent for this eyewitness in -car video system and is the only manufacturer that makes this equipment. These systems include a video camera that is mounted toward the front of the car and a locked recorder system in the trunk. These systems are used as a security measure to record the officers and any situations that may occur. Each system is $4,560. j. Proposed Ordinance No. 000309 -18 authorizes an interlocal agreement with Region IV Education Service Center to join the Texas Cooperative Purchasing Network. This cooperative purchase program was established by Region IV (Schools). Any state or local government entity may join this cooperative purchasing program. k. Proposed Resolution No. 000309 -3 authorizes the City Manager to make application for the Juvenile Accountability Incentive Block Grant Program. The City of Baytown received these grant funds last year and established a juvenile program. The city has been invited to apply for grant funds to aid in the reduction of juvenile crime. The City is eligible for $27,793 with a ten- percent cash match of $3,718 making the total project budget $30,881. These 20000309 -11 Minutes of Regular Session — March 9, 2000 funds would enable the court to provide alternative sentencing for juveniles in the Municipal Court. A Juvenile Crime Enforcement Coalition has already been appointed. These funds would allow the court to enhance the existing program which is divided into a classroom session for the juvenile and a parent or guardian and a community service session that requires the juveniles to dress in orange - colored vest and pick up trash, paint over graffiti, clean vacant lots, etc. All activities are closely supervised. The program has been tremendously successful and these funds would allow the Court to move forward to expand the existing program. This resolution will renew our present plan.
