1999 09 28 CC Minutes, SpecialMINUTES OF THE SPECIAL SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN September 28, 1999 The City Council of the City of Baytown, Texas, met in special session on September 28, 1999, at 7:15 a.m., in the Don Hullum Conference Room of the Baytown City Hall with the following in attendance: Victor Almendarez David Byford E. Frank Hinds, Jr. Coleman Godwin *Calvin Mundinger Scott Sheley Pete C. Alfaro Robert Leiper Ignacio Ramirez Eileen P. Hall Council Member Council Member Council Member Council Member Council Member Council Member Mayor Acting City Manager City Attorney City Clerk The meeting was opened with a quorum present and the following business was conducted: Consider Proposed Ordinance No. 990928 -1, Approving Exxon Chemical Nitrogen Gas Pipeline Permit for Installation of Pipeline under Bayway Drive at West Road The ordinance approves Exxon's gas pipeline permit for installation of a pipeline under Bayway Drive at West Road. The application is for a new line in the area of the docks and the entrance to the chemical building. Council Member Hinds moved to approve the ordinance. Council Member Byford seconded the motion. The vote follows: Ayes: Council Members Almendarez, Byford, Hinds, Godwin, and Sheley Mayor Alfaro Nays: None 990928 -2 Minutes of the Special Session – September 28,1999 ORDINANCE NO. 8713 AN ORDINANCE APPROVING THE APPLICATION OF EXXON CHEMICAL COMPANY FOR ONE NEW PIPELINE TO BE CONSTRUCTED WITHIN THE CITY OF BAYTOWN; AUTHORIZING AND DIRECTING THE DIRECTOR OF ENGINEERING AND INSPECTIONS TO ISSUE PERMITS THEREFOR; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. "Calvin Mundinger present. Consider Proposed Ordinance No. 990928 -2, Authorizing Change Order No. 2 to the 1998 Municipal Street Rehabilitation Program —Phase II The ordinance authorizes Change Order No. 2 to the 1998 Municipal Street Rehabilitation Program —Phase II. Garth Road between Park Street and Decker Drive is essentially finished and is a good street job, but more asphalt base material was used in the level -up work than the plans and specifications indicated; therefore, extra costs were incurred on that job. Amelia Street needs an asphalt two -inch cap but it has a crown that is unacceptable. Some material needs to be removed before the asphalt is put on. The job is presently on hold and will not proceed until Council approves the change order. Howard Wellspring, Director of Engineering /Inspections, noted that the proposed change order includes the deducts on Rollingwood. Herb Thomas, Assistant City Manager /Director of Public Works, explained the problem associated with street projects where there is heavy traffic and pressure to get the street open when a problem arises requiring a change order. He indicated that the administration would be discussing possible alternatives and would get back to Council in work session. Council Member Almendarez moved to adopt the ordinance. Council Member Mundinger seconded the motion. The vote follows: Ayes: Council Members Almendarez, Byford, Mundinger Hinds, Godwin, and Sheley Mayor Alfaro Nays: None 990928 -3 Minutes of the Special Session – September 28, 1999 ORDINANCE NO. 8714 AN ORDINANCE AUTHORIZING CHANGE ORDER NO. 2 WITH ANGEL BROTHERS ENTERPRISES, INC., FOR THE 1998 MUNICIPAL STREET REHABILITATION PROGRAM —PHASE II; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF THIRTY -TWO THOUSAND FIFTY -TWO AND NOMOO DOLLARS ($32,052.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.
