The vote follows: Ayes: Council Members Byford, Mundinger, and Godwin Mayor Alfaro Nays: None Proposed Resolution No. 990722 -1, Expressing the Desire that the City of Baytown Remain as a Class Participant in the Lawsuit Styled City of Wharton, et at., v. Houston Lighting & Power, et. aL, No. 96- 016613; in the 127th Judicial District Court of Harris County, Texas, and that Benjamin L. Hall, III, Continue to Represent the City's Interests in Such Lawsuit This lawsuit has been brought by the cities of Wharton, Pasadena, and Galveston to recover unpaid franchise fees along with other amounts which may be due and owing by Houston Lighting & Power ( °HL &P "). Because all Texas municipalities with franchise agreements with HL &P are similarly situated and have common issues to be resolved, the court found it expedient to consider all such matters in a single lawsuit and, therefore, made the above - referenced lawsuit a class action. Normally, to remain in a class certified by the court, the members of the proposed class need not act. Currently, the City is a party to this suit. According to the attorney representing the cities, the court appears to be inclined to dismiss the parties who did not file an inclusion request. However, instead of filing such request, the City, upon the recommendation of class counsel, wishes to express its desire to remain a class participant in the above - referenced suit and to affirm the City's representation by Benjamin L. Hall, III, current class counsel. As such, the proposed resolution authorizes the City Manager to take appropriate action to ensure the City of Baytown remains a class participant in the above - referenced suit. HOUSTON LIGHTING & POWER, ET AL, NO. 96- 01613; IN THE 127TH JUDICIAL DISTRICT COURT OF HARRIS COUNTY, TEXAS, AND THAT BENJAMIN L. Proposed Resolution No. 990722 -2, Authorizing the City Manager to Submit a Proposal for Funding under the Texas Department of Transportation Enhancement Program for Funding of a New Entrance to the Baytown Nature Center (the "Center") With these funds the City plans to construct a new, landscaped scenic entrance to the Center and exit drives, which will significantly improve public access as well as the public's safety and enjoyment of the City's largest and most unique natural resource park area. This project is an integral part of the city's new master plan for the Baytown Nature Center. The proposed project will include entrance and exit roads and related construction, beautification /landscaping, land acquisition, planning /engineering /design, inspection and testing, for a total project cost of $750,000. The grant will represent Texas DOT Enhancement Funding of $600,000 and City of Baytown Funding of $150,000 for a total project cost of $750,000. City of Baytown funding is planned from the Capital Improvement Project Fund. Council Member Mundinger moved to adopt the resolution. Council Member Byford seconded the motion. The vote follows: Ayes: Council Members Byford, Mundinger, and Godwin Mayor Alfaro Nays: None 990722 -4 Minutes of Regular Session — July 22,1999 RESOLUTION NO. 1396 A RESOLUTION AUTHORIZING THE CITY MANAGER OF THE CITY OF BAYTOWN, TEXAS, TO MAKE APPLICATION TO THE TEXAS DEPARTMENT OF TRANSPORTATION ENHANCEMENT PROGRAM FOR FUNDING FOR VARIOUS PROJECTS INTEGRAL TO THE MASTER PLAN OF THE BAYTOWN NATURE CENTER; DESIGNATING AN AUTHORIZED REPRESENTATIVE; AUTHORIZING REPRESENTATIVE TO ACCEPT TO AFFIRM ANY GRANT AWARD THAT MAY RESULT THEREFROM; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Proposed Ordinance No. 990722 -1, Amending Chapter 14 "Animals," Article I "In General," Section 14-8 "Certain Animals Restricted" of the Code of Ordinances Currently, the ordinance prohibits a person from maintaining various animals/insects in the city within certain distances of private residences, churches, schools, day care facilities, nursing homes, hospitals, parks, or public places. The ordinance as proposed provides an exemption to this prohibition if the animals/insects or their habitats are maintained by a governmental entity solely for educational purposes. This exemption will allow the City of Baytown to install a hive of honeybees, enclosed in glass, as well as other animal exhibits in the science lab or elsewhere in the Wetlands Center, while providing a safe observation environment for visitors to the Wetlands Center. Proposed Ordinance No. 990722 -3, Awarding the Municipal Court and Jail Facilities Contract to North American Corporation Council will consider this item at a future date. Proposed Ordinance No. 990722 -4, Awarding the Engineering Services Contract to Busch Hutchison & Associates, Inc., to Prepare Plans and Specifications for the State Highway 146 Lift Station and Force Main The ordinance awards the contract to Busch Hutchison & Associates, Inc. Compensation for basic services will be based on nine percent (9 %) of the construction costs plus $7,500 for reimbursables (i.e. geotechnical and surveying). The scope of work includes design of a lift station and force main to increase sanitary sewer capacity along State Highway 146 between 1 -10 and the existing eighteen -inch sewer line located south of Pinehurst 11. The estimated construction cost is $500,000; therefore, the basic engineering fee would be approximately $45,000. This will be funded by capital buy -in fees. Council Member Godwin moved to adopt the ordinance. Council Member Byford seconded the motion. The vote follows: Ayes: Council Members Byford, Mundinger, and Godwin Mayor Alfaro Nays: None ORDINANCE NO. 8637 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER AND THE CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO A CONTRACT WITH BUSCH HUTCHISON AND ASSOCIATION, INC., REGARDING THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE STATE HIGHWAY 146 LIFT STATION AND FORCE MAIN PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN PURSUANT TO THE CONTRACT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 990722 -6 Minutes of Regular Session — July 22, 1999 Proposed Ordinance No. 990722 -5, Awarding the Engineering Services Contract to Langford Engineering, Inc., to Prepare Plans and Specifications for the Whispering Pines Lift Station and Force Main and Sanitary Sewer Rehabilitation Project along Crosby -Cedar Bayou Road The ordinance awards the contract to Langford Engineering. Compensation for basic services will be based on nine percent (9 %) of the construction costs plus $25,000 for reimbursables (i.e. geotechnical, surveying, and Corps of Engineers Permit). The scope of work includes design of a lift station and force main to State Highway 146 to correct the sanitary sewer by- pass condition located in the vicinity of Memory Lane and Savell Drive and design for the rehabilitation of an existing eight -inch sanitary sewer line along Crosby -Cedar Bayou Road between Massey- Tompkins Road and Alexander Drive. The estimated construction cost is $500,000; therefore, the basic engineering fee would be approximately $45,000. The Crosby -Cedar Bayou Road sewer rehabilitation will be funded by the Texas Water Development Board, and the Whispering Pines Lift Station and Force Main will be funded by 1998 Certificates of Obligation. Council Member Mundinger moved to adopt the ordinance. Council Member Godwin seconded the motion. In response to inquiry from Council, the City Engineer said the design would take about six months. The vote follows: Ayes: Council Members Byford, Mundinger, and Godwin Mayor Alfaro Nays: None ORDINANCE NO. 8638 AN ORDINANCE AUTHORIZING AND DIRECTING THE CITY MANAGER AND THE CITY CLERK OF THE CITY OF BAYTOWN TO EXECUTE AND ATTEST TO A CONTRACT WITH LANGFORD ENGINEERING, INC., REGARDING THE PREPARATION OF PLANS AND SPECIFICATIONS FOR THE WHISPERING PINES LIFT STATION AND FORCE MAIN AND SANITARY SEWER REHABILITATION ALONG CROSBY - CEDAR BAYOU ROAD PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN PURSUANT TO THE CONTRACT; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. 990722 -7 Minutes of Regular Session — July 22,1999 Consider Approval of Plans and Specifications for the Trash Removal and Disposal Contract at the East District Wastewater Treatment Plant Expansion Site and Authorize Advertisement for Bids The scope of work includes providing containers and picking up and hauling solid domestic waste to a permitted landfill in a timely manner. Disposal is expected to be completed no later than December 31, 1999. The estimated removal cost is $250,000 and will be funded from interest earnings on bond funds. Council Member Byford moved to approve the plans and specifications and authorize advertisement for bids. Council Member Mundinger seconded the motion. The vote follows: Ayes: Council Members Byford, Mundinger, and Godwin Mayor Alfaro Nays: None Consider Approval of Plans and Specifications for the Police Department Pistol Range Sewer and Water Line Project along McLean Road and Authorize Advertisement for Bids Council will consider this item at a future date. Consent Agenda On consent agenda item "g," the low bidders were tied. Lots were drawn and Smart Materials, Inc., was selected. Council considered the consent agenda items "a" through "g." a. Proposed Resolution No. 990722 -3, requests the sheriff to sell ten properties at a public sale pursuant to Section 34.05(c) of the Texas Tax Code. In 1997, the Legislature amended the Tax Code to allow taxing entities to sell via a public sale property held by a taxing entity as a result of the receipt of an insufficient bid at a tax foreclosure sale. The property will be sold at a public auction at the courthouse door of the county on the first Tuesday of the month, between the hours of 10:00 a.m. and 4:00 p.m. The acceptance of a bid at such a sale is conclusive and binding on the question of its sufficiency. This process provides an efficient mechanism for (i) returning deteriorated or unproductive properties to the tax rolls, (ii) 990722 -8 Minutes of Regular Session — July 22,1999 enhancing the value of abutting properties, and (iii) improving the safety and quality of life throughout the City. Three of the parcels were previously authorized for public sale, but due to untimely receipt of paperwork from the court clerk and the requirement by the Sheriff of an updated resolution, it is necessary to seek re- authorization on those three parcels. We recommend approval. b. Proposed Ordinance, No. 990722 -6, authorizes abandonment of 1.2433 acres of right of way known as Massey- Tompkins Road Extension between State Highway 146 and Cedar Bayou. In accordance with Chapter 2, "Administration," Article VII, "Disposition of City Properties," Section 2 -766, "Abandonment of Streets and Alleys," of the Code of Ordinances of the City of Baytown, the Bayer Corporation (Bayer), owner of the property on each side of the 1.2433 acres of right of way known as Massey- Tompkins Road Extension between State Highway 146 and Cedar Bayou, has requested abandonment of said right of way. The fair market value of that portion of Massey Tompkins Road Extension based on the 1998 HCAD certified land value is $12,035. Each of the utility companies has been contacted. Upon authorization to abandon and payment by the landowner, the Legal Department will furnish a quitclaim deed to Bayer. We recommend approval. C. Proposed Ordinance No. 990722 -7, authorizes the sale of property located at 407 West Pearce, (Lots 1, 2, 3, 21, 22, 23, and 24, Block 28, Goose Creek Subdivision) to Harvest Time Deliverance Church for the amount of $16,000. This property was originally struck off to the City in a tax foreclosure sale on October 6, 1987. Since that time, the City of Baytown for itself and on behalf of the Goose Creek Consolidated Independent School District and Lee College District has leased the property first to The Power Zone and then to Right Direction Community Action Center. Each lease was for a term of forty years with option to purchase the property at any time for $16,000, the value of the property as appraised on October 13, 1994, and was conditioned on the organizations constructing and operating a non - profit, anti -gang violence prevention community resource center. On January 26, 1996, The Power Zone terminated its lease with the City of Baytown. The City of Baytown terminated the lease agreement with Right Direction Community Action Center on February 12, 1998. 990722 -9 Minutes of Regular Session —July 22, 1999 r The proposed ordinance authorizes the sale of the property to Harvest Time Deliverance Church pursuant to Section 34.05 of the Texas Tax Code. Specifically, such section authorizes the City of Baytown to sell the property at any time at a private sale with the consent of each taxing entity entitled to receive proceeds of the sale under the judgment if the property is sold for less than: (1) the market value specified in the judgment of foreclosure; or (2) the total amount of the judgments against the property. In this instant case, no market value was specified in the judgment and the total amount of the judgments against the property exceeds $20,000. Subsequent to Council approval, the Goose Creek Consolidated Independent School District and Lee College District will consider authorization of said sale. We recommend approval. d. Proposed Ordinance No. 990722 -8, accepts the donation of Lot 10, Block V, of Brownwood, for inclusion in the Baytown Nature Center. This property has been donated by Frederick Craig Ramsey and Roger Alan Ramsey, both independently and in their capacities as co- trustees of the Alice Anderson Trust created under the will of Madeline Esther Anderson Ramsey, Deceased. We recommend approval e. Proposed Ordinance No. 990722 -9, awards the pavement markings contract to Paige Barricades, Inc., in the amount of $49,188.36. Invitations to bid were mailed to four contractors and we received three bids. The contractor will begin installation of pavement markings on August 1, 1999. Completion will be in thirty days. A list of the streets to have pavement markings installed is included in the packet. We recommend approval f. Proposed Ordinance No. 990722 -10, awards the contract for purchase and installation of a 15,000 watt PTO /hydraulic generator 990722 -10 Minutes of Regular Session —July 22, 1999 for the Fire Department Command Post Vehicle to Harrison Hydra - Gen, Inc., in the amount of $13,806. Invitations to bid were mailed to five vendors. Three no bids and one bid were received. The new generator will replace the existing 6.5 KW gasoline generator and will be powered by the vehicle engine through a power take off on the transmission. It can be utilized whether the vehicle is parked or moving. A Department of Emergency Management (DEM) grant is providing fifty percent of the funding for the replacement of the gasoline engine with a rebuilt diesel engine (complete) and the generator purchase /installation. The old generator will be utilized as back -up power for the ITS' computer servers at the Civic Center. We recommend approval. g. Proposed Ordinance No. 990722 -11, awards the annual fill sand contract to Smart Materials, Inc., for the amount of $15,170. Invitations were mailed to five suppliers and we received five bids. This contract is used primarily to fill and level construction areas when necessary, i.e., filling in water line construction, leveling yards where sewer and water line repairs occur. The vote follows: Ayes: Council Members Byford, Mundinger, and Godwin Mayor Alfaro Nays: None City Manager's Report Residential Garbage Collection BFI missed garbage collection on several streets on Thursday, July 8. They have assured the city that they have taken steps to see that this does not happen again. 2505 Market Street The building at 2505 Market Street should be open by October 1. This ,, location is for Utility Billing and Tax personnel. 990722 -14 Minutes of Regular Session —July 22, 1999 Interstate 10 Accident Three 18- wheelers and one one -ton truck involved in an accident. The three 18- wheelers crashed together and the one -ton truck ran into and was pinned under the back of one of the 18- wheelers. The Fire Fighters brought in the Jaws of Life and were able to free the driver within 38 minutes. The driver was stable when he was taken to Herman Hospital by Life Flight. The Fire Fighters are to be commended. In response to inquiry from Council, the City Manager said that he would talk to TOOT again to voice concerns about the accident rate on 1 -10 due to the construction.
