The City Council of the City of Baytown, Texas, met in a Regular Meeting on Thursday,
September 12, 2013, at 6:30 P.M. in the Council Chamber of the Baytown City Hall, 2401

Mayor DonCarlos convened the September 26, 2013, City Council Regular Meeting with a
quorum present at 6:30 P.M., all members were present with the exception of Council Member
Mercedes Renteria III, who was absent.
Pledge of Allegiance, Texas Pledge, and Invocation was led by Council Member Scott Sheley.
1. RECOGNITIONS AND CITIZEN COMMUNICATIONS
a. Present a proclamation designating October as National Community Planning
Month.
Mayor DonCarlos presented a proclamation to Ms. Tiffany Foster, Assistant Director of Planning
and Development Service designating October as National Community Planning month and
thanked her for her commitment and service to our community.
b. Present a proclamation designating October 6 -12, 2013, as Fire Prevention Week.
Mayor DonCarlos presented a proclamation to Assistant Fire Chief Bernard Olive designating
October 6 -12, 2013, as Fire Prevention Week and thanked the Baytown Fire Department and
staff for all of their hard work in helping to educate others about fire prevention and safety.

C. Present a proclamation designating October as Crime Prevention Month and
recognizing October 1, 2013, as National Night Out.
Mayor DonCarlos presented a proclamation to Police Chief Keith Dougherty designating
October as Crime Prevention Month and reminded everyone that October 1, 2013, beginning at
6:00 p.m. is National Night Out.
d. The 8th Annual Grito Fest is scheduled for Saturday, October 5, 2013, at
Bicentennial Park and will feature this year's headliner Los Herederos del Nuevo Leon.
City Manager Leiper presented the item and invited Mr. Scott Johnson, Parks and Recreation
Director to expand on the item. Mr. Johnson stated that the 8th Annual Grito Fest is scheduled
for Saturday, October 5, 2013, at Bicentennial Park and invited everyone to attend this successful
event.
Co- organizers of this event, Mr. Agustin Loredo and Mr. Jacob Schaffer thanked the Council and
City staff for their continued support for this event. They stated that this event was a family event
that focuses on bringing people from all walks of life together in a communal and familial
fashion. The event will be held from 4:00 p.m. to 9:30 p.m. and admission is FREE. This family -
friendly outdoor concert will feature Mariachis, Kid's Activities, Jalapeno Eating Contest, Salsa
Contest, Tamale Competition, Accordion Competition, and a Grito Competition. Food and arts -
n -craft vendors will be selling tasty treats and handmade creations.

2. PROPOSED ORDINANCES
a. Consider an ordinance concerning the second and final reading of the disannexation
of approximately 43.8 acres located on the north side of the I -10 feeder road, west of
Thompson Road, legally known as a portion of land out of the Nathaniel Lynch Survey,
Abstract 55, Harris County, Texas.
City Manager Leuper presented the item and stated that the City entered into a Strategic
Partnership Agreement (SPA) with Lake Municipal Utility District (Lake MUD) and annexed a
portion of its land for limited purposes on June 27, 2005. The agreement allowed the City to
impose certain regulations and to collect sales and use tax on any commercial development in the
area. Since that time, the area has been developed into residential lots as West Meadows
subdivision instead of the commercial uses originally proposed by Lake MUD. The City and
Lake MUD agree to the disannexation of this area because there are no plans for commercial
development within the West Meadows subdivision.
This disannexation process follows a similar path as annexation. Notices of the first and second
public hearings were published in the July 11th and July 21st editions of The Baytown Sun and
mailed to property owners and interested agencies. Notices were also posted on the City of
Baytown's notice board and website on July 8, 2013, and July 19, 2013. The first and second
public hearings were held on July 25, 2013, and August 1, 2013. The first reading of the
ordinance was held on August 22, 2013 and was published in the Baytown Sun on August 27,
2013.

b. Consider an ordinance establishing the City of Baytown's 2013 -14 Tourism
Partnership Grant Program Allocations and Adopting a Standard Form of Agreement for
Recipients of such Program.
City Manager Leiper presented the item and stated that Ordinance No. 12,357 establishes the
City of Baytown's 2013 -14 Tourism Partnership Grant Program Allocations and adopts a
Standard Form of Agreement for recipients of such program.
City Manager Leiper further stated that last year, Council adopted a new procedure for allocating
funds for the City's Tourism Partnership Grant Program. This process requires organizations
seeking Hotel Occupancy Tax funds to submit an application that describes their event and how
HOT funds supporting the event will comply with State law. Applications were received from
May 22 - June 28, 2013. In the City's FY 2013 -14 Hotel /Motel Fund budget, $125,000 is
allocated for the Tourism Partnership Grant Program. Staff recommendations to Council on
which organizations should be funded and what levels they should be funded at are based on the
criteria set forth by Council and in accordance with State law, which governs what HOT monies
are intended to be used for. The monies are required to be used to bring visitors to Baytown and
promote the hotel and convention industry.
Staff recommendations were based on the ability of an applicant to document the number of
visitors they are bringing to town and the number of people their event is putting in hotels. Eight
(8) organizations applied for funding during this year's application period. Below is staffs
recommendation on the allocation of funds to most effectively promote tourism in Baytown and
bring visitors to our community. The 2013 -14 Funding Recommendations are:

City Manager Leiper also stated that there is one organization that pulled their request due to
moving their event (Spring Fling Boating Festival) to Port Arthur, therefore, staff recommends
that the allocation be set aside ($5,000) to use in case an event approaches the City throughout

the year for grant funding. Council Member Sheley requested that the contingency monies be
not just for new initiatives or applicants, but also for existing applicants that can demonstrate a
need for the additional monies.

recipients and thanked the Council and staff for their continued support:

11. APPOINTMENTS
a. Consider one (1) appointment to the Planning and Zoning Commission.
City Manager Leiper presented the item and stated that there is one (1) opening, left by the
resignation of Ms. Lisa D. Clary for the City Manager's appointment of a real estate /developer.
City Manager Leiper stated that he met with Ms. Donna Winfrey- Varner, and her application
does meet the requirements for this position. City Manager Leiper stated that he recommended
Ms. Winfrey -Varner and if appointed she would complete Ms. Clary's unexpired term, which is
set to expire on December 31, 2014.
A motion was made by Council Member David McCartney and seconded by Council Member
Brandon Capetillo appointing Ms. Winfrey - Varner to the Planning and Zoning Commission to
complete Ms. Clary's unexpired term, which ends on December 31, 2014. The vote was as
follows:
Ayes: Mayor Stephen DonCarlos, Council Member Brandon Capetillo, Mayor
Pro Tern Robert C. Hoskins, Council Member David McCartney, Council
Member Terry Sain, Council Member Scott Sheley
Nays: None
Abstain: Council Member Mercedes Renteria I1I, (absent)

b. Consider one appointment to the Cedar Bayou Navigation District.
City Manager Leiper stated that on August 9, 2007, the City Council appointed Mr. Jack Adcox
to the Cedar Bayou Navigation District Position No. 7, which expires in 2013. Mr. Adcox has
requested reappointment and if approved would serve another six year term, which would expire
on 2019.
A motion was made by Council Member Terry Sain and seconded by Mayor Pro Tem Hoskins
appointing Mr. Jack Adcox to another 6 year term to the Cedar Bayou Navigation District. The
vote was as follows:
Ayes: Mayor Stephen DonCarlos, Council Member Brandon Capetillo, Mayor
Pro Tern Robert C. Hoskins, Council Member David McCartney, Council

12. MANAGER'S REPORT
City Manager Leiper gave the following reports and announcements;
a) The 4th Annual Health and Safety Fair will be held on Saturday, October 12, 2013, from
loam to 2pm at Goose Creek Memorial High. School, 6001 E. Wallisville. The Baytown
Office of Emergency Management and the Local Emergency Planning Committee
welcome you to the 4th Annual Health and Safety Fair. Come out and enjoy free health
screenings, kids' activities and much morel
b) Reminder that the City Council Regular Meeting scheduled for Thursday, October 10,
2013, has been canceled.
c) Reminder that the City Council will hold one special meeting regarding the tax revenue
increase on Tuesday, October 1, 2013, at 4:30 p.m. and another special meeting regarding
the adoption of the tax rate on Monday, October 14, 2013, at 6:00 p.m.
Council Member Sheley invited the members of Council and staff in attendance at the TML
conference to attend his presentation at the Cracker Barrel Roundtable on Wednesday, October
9, 2013, at 3:30p.m.
