MINUTES OF THE SPECIAL MEETING OF THE CITY COUNCIL OF THE
CITY OF BAYTOWN
October 2, 2008
The City Council of the City of Baytown, Texas met in a special meeting on October 2,
2008 at 5:00 P.M. in the Council Chamber of the City of Baytown with the following in
attendance:
Lena Yepez Council Member
Lynn Caskey Council Member
Brandon Capetillo Council Member
Terry Sain Council Member
David McCartney Council Member
Stephen H. DonCarlos Mayor
Garrison C. Brumback City Manager
Bob Leiper Deputy City Manager
Kevin Troller Assistant City Manager

Lynette Rodriguez Assistant City Clerk
Council Member Sheley was absent from the special session of October 2, 2008.
5:00 P.M. Mayor DonCarlos convened the October 2, 2008 special meeting with a
quorum present.
1. PUBLIC HEARINGS
a. Public Hearing: 5:00 P.M. – First Public Hearing to Increase Total Tax
Revenues – Finance Department.
Conducted a public hearing at 5:00 P.M. on a proposal to increase total tax revenues from
properties on the tax roll in the preceding tax year by 4.4 percent.
City Manager Brumback summarized the agenda item.
5:00 P.M. Mayor DonCarlos opened the public hearing.
There were no citizens signed up to speak.
5:03 P.M. Mayor DonCarlos closed the public hearing.

2. PROPOSED ORDINANCES
a. First Reading Annexing .3814 Acre Tract – Planning.
Ordinance 10,981 annexed property currently within the extra-territorial jurisdiction of
the City of Baytown and being property a 0.3814-acre tract of land situated in Lot 9,
Block 22 of the Highland Farms Subdivision, situated in Harris County, Texas, as
recorded in Volume 10 at Page 47 of the Map Records of Harris County, Texas, in the T.
Ristergen Survey, Abstract 1425, Harris County, Texas and being out of a part of certain
called 15.095-acre tract of land.
City Manager Brumback summarized the agenda item.
Motion was made by Council Member Capetillo, seconded by Council Member Caskey
approving Ordinance 10,981. The vote was as follows:
Ayes: Council Members: Yepez, Caskey, Capetillo, Sain, McCartney,
and Mayor DonCarlos.
Nayes: None.
The motion carried.
ORDINANCE NO. 10,981
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, MAKING CERTAIN FINDINGS; PROVIDING
FOR THE EXTENSION OF CERTAIN BOUNDARY LIMITS OF THE
CITY OF BAYTOWN, TEXAS, AND THE ANNEXATION OF A
0.3814-ACRE TRACT OF LAND SITUATED IN LOT 9, BLOCK 22 OF
THE HIGHLAND FARMS SUBDIVISION, SITUATED IN HARRIS
COUNTY, TEXAS, AS RECORDED IN VOLUME 10 AT PAGE 47 OF
THE MAP RECORDS OF HARRIS COUNTY, TEXAS, IN THE T.
RISTERGEN SURVEY, ABSTRACT 1425, HARRIS COUNTY,
TEXAS, AND BEING OUT OF A PART OF A CERTAIN CALLED
15.095-ACRE TRACT OF LAND, WHICH SAID TERRITORY LIES
ADJACENT TO AND ADJOINS THE PRESENT BOUNDARY LIMITS
FOR THE CITY OF BAYTOWN, TEXAS.
3. EXECUTIVE SESSION
Public notice is given that the City Council may elect to go into executive session at
any time during the meeting in order to discuss any matters listed on the agenda
when authorized by the provisions of the Open Meetings Act, Chapter 551 of the
Texas Government Code, and that the City Council specifically expects to go into

executive session on the matters enumerated herein below, if any. In the event the
Council elects to go into executive session regarding an agenda item, the section or
sections of the Open Meetings Act authorizing the executive session will be publicly
announced by the presiding officer.
4. MANAGER'S REPORT
a. Hurricane Ike Update
Hurricane Ike Recovery Update
Mayor DonCarlos announced he will be lifting the curfew and the ban on the sale of
firearms effective Friday October 3, 2008.
8. ADJOURN
Motion was made by Council Member Sain, seconded by Council Member Capetillo
adjourning the October 2, 2008 special meeting. The vote was as follows:
Ayes: Council Members: Yepez, Caskey, Capetillo, Sain, McCartney,
and Mayor DonCarlos.
Nayes: None.
The motion carried.
5:21 P.M. Mayor DonCarlos adjourned the special City Council meeting of October 2,
2008.
