MINUTES OF THE SPECIAL CITY COUNCIL MEETING OF THE
CITY COUNCIL OF THE CITY OF BAYTOWN
August 18, 2008
The City Council of the City of Baytown, Texas, met in a Special City Council Meeting
on August 18, 2008 at 6:30 P.M. in the City Council Chambers of the City of Baytown
with the following in attendance:
Lena Yepez Council Member
Brandon Capetillo Council Member
Terry Sain Council Member
David McCartney Council Member
Scott Sheley Council Member
Stephen H. DonCarlos Mayor
Garrison C. Brumback City Manager
Robert D. Leiper Deputy City Manager
Ignacio Ramirez City Attorney
Kaythie Darnell City Clerk
Council Member Caskey was absent.
6:30 P.M. Mayor DonCarlos called the meeting to order.
1. DISCUSSIONS
a. Public Comment and Discussion on Zoning Changes – City Council.
Kelly Carpenter presented the Light Industrial Zoning history and noted that the purpose
of this meeting was to resolve issues left unresolved at the last Council meeting: Facades
and Loading Docks.
6:33 P.M. Mayor DonCarlos opened the meeting for public comments.
The following citizens spoke during the discussions:
Mike Boyd, 2200 West Loop, Suite 420, Houston, Texas
In Baytown, the predominant user has 10,000 – 20,000 square feet; screening is
expensive; many details need to be carefully thought through; give great flexibility and
cannot totally screen; do not want to put landowner at a disadvantage; vegetative buffers
are onerous and penalizing; I am a strong believer in restrictions, and buffers are fine for
residential; focus on façade of front of building as opposed to all sides.
James Haarmeyer, 8102 Bayside, Baytown, Texas
Personal opinion is that Baytown does not need.
Bob Crunk, 201 Timberlane, Baytown, Texas
Questioned if Planning and Zoning had any responsibility with the direction; suggest
addressing Old Town before the zoning; this cannot stand.
Billy Combs, 11302 Cedar Gully, Baytown, Texas
Mr. Boyd was very correct with his comments; City Council is raising good questions,
and the stakeholders need to be on the front side of the process in a less formal setting;
Old Town sounds good; flexibility is a must; the way it is sitting currently we are driving
values down.
Steve Darnall, Houston, Texas
Echoed Mr. Boyd’s comments and he operates one of the better businesses; my concern
is also the definitions of the various types streets.
Jerry Gainer, 1209 Decker Drive, Baytown, Texas
Set back is a killer to many deals.
Claire Sinclair, 2901 Baker Road, Baytown, Texas
Total agreement with all that has been stated; have already experienced a slow down and
Baytown must be competitive; if continue, we might further damage ourselves
competitively, and I want to see Baytown prosper.
Bill Smith, 802 Maplewood, Baytown, Texas
Noted that he was an owner of several pieces of property and businesses, and he was very
concerned of these proposed changes.
Mitchell Pearce, 4704 Ripplecreek, Baytown, Texas
Concerned with the neighborhood protection, and recommended sending back to
Planning and Zoning with a panel of citizens to review.
Larry Gordon, 2306 Bay Oaks Harbour, Baytown, Texas
Questioned if the City Council had considered freeways looking down on the various
businesses which might create unintended consequences.
Sharon Rogers, #4 Bay Villa, Baytown, Texas
Concerned that the proposed changes would be choking the life out of Baytown; at this
time, do not feel safe making investments in Baytown.
Wolfgang Fischer, 2101 Walker Road, Baytown, Texas
Concerned with proposed changes.
8:45 P.M. Mayor DonCarlos closed the meeting for public comments.
Mayor DonCarlos proposed a plan to select citizens for a sub committee at the first
meeting in September.
2. ADJOURN
Council Member Yepez made a motion, seconded by Council Member Capetillo to
adjourn the meeting.
Ayes: Council Members: Yepez, Capetillo, Sain, McCartney, Sheley and
Mayor DonCarlos.
Nayes: None.
The motion carried.
The City Council Special Meeting adjourned at 8:55 P.M.
