2008 04 24 CC Minutes MINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN April 24, 2008 The City Council of the City of Baytown, Texas met in regular session on April 24, 2008 at 6:30 p.m. in the Council Chamber of the City of Baytown with the following in attendance: Lynn Caskey Council Member Brandon Capetillo Council Member Sammy Mahan Council Member Scott Sheley Council Member Stephen H. Mayor DonCarlos called the meeting to order at 6:30 p.m. with a quorum present. Council Member Sheley led the Pledge of Allegiance and prayer. MINUTES Considered approval of minutes of the April 10, 2008 Regular Meeting. Council Member Caskey moved that the minutes for the April 10, 2008 regular meeting be accepted as presented. RECOGNITIONS AND CITIZENS COMMUNICATIONS Citizen Communication - Ms. Cindy Coker addressed the City Council concerning the proposed barge terminal on Cedar Bayou. Mayor DonCarlos in the absence of State Representative Wayne Smith presented a Proclamation recognizing Council Member Sammy Mahon. PUBLIC HEARINGS Conducted a public hearing on a proposal re-zoning of 52.7885 acres from Mixed Use to Neighborhood Conservation. 7:25 P.M. Mayor DonCarlos opened the public hearing. Mayor DonCarlos requested that City Manager Garry Brumback summarize the subject of the public hearing. Mr. Brumback described the public hearing as referencing the application of James Hutchison for a zoning amendment to reclassify a 52.7885 acre tract of land situated in the Jacob Armstrong Survey, Abstract 2, Chambers County, Texas, and being all of the 50.4864 acre tract 1 conveyed by David M. Kadjar, Trustee, to J. G. Keeling and Sonya Keeling by deed dated November 3, 2004 and recorded in volume 735 at page 648 of the official records of Chambers County, Texas; together with all of that certain 2.3021 acre tract of land conveyed by Delmar Wayne Brazell to J. G. Keeling and Sonya Keeling by deed dated November 3, 2004 and recorded in volume 738 at page 160 of the official records of Chambers County, Texas from Mixed Use to Neighborhood Conservation. Devinwood Phase II, Block 4, Lots 1-47, Block 5, Lots 1-20, Block 6. Lots 1-34, Baytown, Chambers County, Texas from Mixed Use to Neighborhood Conservation. The City of Baytown is requesting that the Devinwood Subdivision, a residential development, be reclassified from Mixed Use to Neighborhood Conservation. ORDINANCES Considered a zoning map amendment/Ordinance amending the zoning Map by reclassifying 52.7885 acres from Mixed Use to Neighborhood Conservation. An ordinance amended the zoning map by reclassifyng a 52.7885 acre tract of land situated in the Jacob Armstrong Survey, Abstract 2, Chambers County, Texas, and being all of the 50.4864 acre tract 1 conveyed by David M. Considered Ordinance 10,875 for the closeout of Lakewood Sanitary Sewer Rehabilitation – II & III Project. Ordinance 10,875 accepted the Lakewood Phase II & III Sanitary Sewer Rehabilitation Project and approves release of retainage in the amount of $81,545.38 to PM Construction, Inc. ("PM"). The original contract was awarded to PM for $1,866,804.20 with a contract duration of 210 days. A change order in the amount of $7,653.60 was processed administratively for casing of sanitary sewer lines passing through the concrete lined drainage canal. The total contract amount totaled $1,874,457.80. The final project construction cost totaled $1,630,907.53; this was a cost savings of $243,550.27. The project was completed in the allotted time. The contractor finished the project with satisfactory workmanship. Motion made by Council Member Capetillo approving Ordinance 10,875. Council Member Sheley seconded the motion. ORDINANCE 10,875 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE LAKEWOOD PHASE II & III SANITARY SEWER REHABILITATION PROJECT; AUTHORIZING FINAL PAYMENT OF THE SUM OF Page 5 of 13 Minutes of the Regular Meeting—April 24, 2008 EIGHTY-ONE THOUSAND FIVE HUNDRED FORTY-FIVE AND 38/100 DOLLARS ($81,545.38) TO PM CONSTRUCTION, INC., FOR SAID PROJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Considered Ordinance 10,876 amending the rabies vaccination requirements. Ordinance 10,876 amended rabies vaccination requirements to more closely reflect current state regulations as it relates to the timing and frequency of rabies vaccinations. ORDINANCE 10,876 AN ORDINANCE OF THE CITY OF BAYTOWN, TEXAS, AMENDING CHAPTER 14 “ANIMALS,” ARTICLE III “RABIES CONTROL,”SECTION 14-66 “VACCINATION REQUIRED” OF THE CODE OF ORDINANCES, CITY OF BAYTOWN, TEXAS, TO REVISE THE INTERVALS FOR REQUIRED RABIES VACCINATIONS; PRESCRIBING A MAXIMUM PENALTY OF TWO THOUSAND AND NO/100 DOLLARS ($2,000); PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. Considered Ordinance 10,877 awarding a construction contract for the new Fire Station #5. Ordinance 10,877 awarded a construction contract in the amount of $1,965,500 to SeTEX Construction Corp., for the new Fire Station #5 Project. The bids include a base bid in the amount of $1,900,000 and five alternate bid items in the amount of $65,500. The recommendation is that the contract be awarded with the five alternate bid items. The scope of work includes a new Fire Station with approximately 10,121 square feet including sidewalks, site amenities, utilities, paving, storm drainage, and detention. In addition, the design requirement of a 150 mph wind event will be met. Five bids were received at the bid opening on March 25, 2008 at 1:30 p.m. in the Council Chambers. The bid tab and letter of recommendation from the architect are attached. The construction duration is 310 calendar days. Motion made by Council Member Capetillo approving Ordinance 10,877. ORDINANCE 10,878 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, RENEWING THE ANNUAL MILL AND OVERLAY CONTRACT – 2007 WITH ANGEL BROTHERS ENTERPRISES, LTD; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, IN AN AMOUNT NOT TO EXCEED ONE MILLION FIVE HUNDRED THOUSAND AND NO/100 DOLLARS ($1,500,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Considered Ordinance 10,879 awarding a construction contract for NEWWTP Offsite Phase III. ORDINANCE 10,879 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE AND ATTEST TO A CONTRACT WITH JIMERSON UNDERGROUND, INC., FOR THE NORTHEAST WASTEWATER TREATMENT PLANT OFFSITE PROJECT, PHASE III; AUTHORIZING PAYMENT OF A SUM OF EIGHT HUNDRED SEVENTY-EIGHT THOUSAND FOUR HUNDRED TWENTY-TWO AND NO/100 DOLLARS ($878,422.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. MOTIONS Authorized advertisement to take bids for the Streets Phase IV for District 1 and 3 Project. Motion made by Council Member Capetillo approving Ordinance 10,878. REPORTS Accepted the Visioning Report presented by Dr. James Moore resulting from the visioning work sessions with the City Council and the community. Page 8 of 13 Minutes of the Regular Meeting—April 24, 2008 The City Council conducted a work session on March 1, 2008 to discuss the strengths, weaknesses, opportunities and threats facing the community. The City Council's work session was followed up with community work sessions on March 25, 2008 to determine the citizens' ideas on the strengths, weaknesses, opportunities and threats. The City Council's ideas were very similar to the citizens ideas. The final report has been prepared by Dr. James Moore of HDR Engineering and was presented at the meeting for the City Council's adoption. Motion made by Council Member Sheley accepting the Visioning Report. Council Member Caskey seconded the motion. The vote was as follows: Ayes: Council Members Caskey, Capetillo, Mahan, Sheley and Mayor DonCarlos. Nays: None The motion carried. Received the City of Baytown Quarterly Investment Report and Financial Report for the period ending March 31, 2008 presented by Finance Director Rhonda Daughtery. The City of Baytown's Financial and Investment Reports for the quarter ending March 31, 200 were submitted for review. The reports were scheduled to be reviewed by the Council Finance Subcommittee on April 23, 2008, and the reports will be distributed to council at the April 24, 2008 council meeting. No action was taken by the City Council. CONSENT Motion made by Council Member Sheley approved Consent Items 7a, 7b, 7c and 7d. Council Member Capetillo seconded the motion. Nays: None Considered Ordinance 10,880 accepting the Central District WWTP Rehabilitation Project and authorizing final payment. Ordinance 10,880 accepted the Central District WWTP Rehabilitation Project and approves the release of retainage in the amount of $75,721.20 to CSA Construction, Inc. The project consisted of the replacement of the sludge collector mechanisms in Clarifier #1 and #2, rehabilitation and replacement of the head works influent channel Page 9 of 13 Minutes of the Regular Meeting—April 24, 2008 including bar screens and gates, work to the head works bypass channel, sludge dewatering conveyor, and electrical improvements to the MCC panel. The original contract was awarded to CSA for a sum not to exceed $1,508,000.00 and the final contract amount was $1,514,423.90. A change order for $6,423.90 was done administratively for additional bar screen fabrication. The contractor’s workmanship was satisfactory. ORDINANCE 10,880 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE CENTRAL DISTRICT WASTEWATER TREATMENT PLANT REHABILITATION PROJECT; AUTHORIZING FINAL PAYMENT OF THE SUME OF SEVENTY-FIVE THOUSAND SEVEN HUNDRED TWENTY-ONE AND 20/100 DOLLARS ($75,721.20) TO CSA CONSTRUCTION, INC., FOR SAID PROJECT; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Considered Ordinance 10,881 authorizing a construction management contract for the Northeast Wastewater Treatment Plant Project with Camp, Dresser, and McKee, Inc. Ordinance 10,881 authorized a construction management contract for the Northeast Wastewater Treatment Plant Project with Camp, Dresser, and McKee, Inc. ("CDM"), for the remainder of the construction project. Under the Agreement CDM will monitor the progress of the construction and the plant start-up to assure conformance with the contract documents and proper operation of the new facility. For these services, the City will pay CDM an amount not to exceed $116,600, which includes $106,000 for services and $10,600 for reimbursables. ORDINANCE 10,881 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, AUTHORIZING A PROFESSIONAL SERVICES AGREEMENT WITH CAMP, DRESSER, AND MCKEE, INC., FOR CONSTRUCTION MANAGEMENT SERVICES RELATING TO THE NORTHEAST WASTEWATER TREATMENT PLANT PROJECT; AUTHORIZING FUNDS IN A TOTAL AMOUNT NOT TO EXCEED ONE HUNDRED SIXTEEN THOUSAND SIX HUNDRED AND NO/100 DOLLARS ($116,600.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Considered Ordinance 10,882 awarding the bid for the annual electrical services contract in the amount of $200,000. Ordinance 10,882 awarded the bid for the annual electrical services contract to Baytown Electric Company, in the amount of $200,000. Invitations to bid were sent to three suppliers resulting in one response and one no-bid. The annual electrical services contract is used by all departments for electrical services regarding emergencies, bucket truck service, repair, new installations, and miscellaneous electrical services. Baytown Electric Company has performed electrical work for the City for numerous years and continues to provide excellent service. ORDINANCE 10,882 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF BAYTOWN ELECTRIC COMPANY FOR THE ANNUAL ELECTRICAL SERVICES CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, IN THE AMOUNT OF TWO HUNDRED THOUSAND AND NO/100 DOLLARS ($200,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Considered Ordinance 10,883 awarding the annual electrical motor control center services contract in the amount of $100,000. Ordinance 10,883 awarded the annual electrical motor control center services contract to Baytown Electric Company in the amount of $100,000. Invitations to bid were sent to three suppliers resulting in one bid and one no-bid. This annual electrical motor control center services contract is primarily used by the wastewater treatment plants and lift stations for control panel board electrical work. Specialized knowledge of motor control centers and electrical equipment is required. Baytown Electric Company provides excellent service. ORDINANCE 10,883 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, ACCEPTING THE BID OF BAYTOWN ELECTRIC COMPANY FOR THE ANNUAL ELECTRICAL MOTOR CONTROL CENTER SERVICES CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, IN THE AMOUNT OF ONE HUNDRED THOUSAND AND NO/100 DOLLARS ($100,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. APPOINTMENTS Appointed Kelly Benavides, Michael Marks, Oshea Spencer and Andy Helms as Associate Municipal Court Judges for the remainder of the term of office, which began February 1, 2008, and ends on January 31, 2010. Considered appointment of Kelly Benavides, Michael Marks, Oshea Spencer and Andy Helms as Associate Municipal Court Judges for the remainder of the term which commenced on February 1, 2008, and ends on January 31, 2010. Associate Judges are only compensated upon serving in the absence of Judge Escalante. However, training costs will be incurred for each. On February 10, 2005, the City Council appointed Michael Mark and Oshea Spencer as Associate Municipal Court Judges for a term which expired Page 11 of 13 Minutes of the Regular Meeting—April 24, 2008 on January 31, 2006. On March 10, 2005, the City Council also appointed Andy Helms and Kelly Benavides as Associate Municipal Court Judges for the same term. The Associate Judges are not employees of the City. The Associate Judges serve on a contract basis to preside over the municipal court and jail dockets to which they have been assigned by the Municipal Court Judge, to issue warrants and court orders in absence of the Municipal Court Judge, and to perform other duties required by the Municipal Court Judge for the operation of the Baytown Municipal Court. The appointment of each Associate Municipal Court Judge is subject to his/her execution of a contract with the City and will be for the remainder of the two-year term, which commenced on February 1, 2008, pursuant to Section 24 of the Charter. The associate judges are usually available only after normal working hours or on weekends since the associate judges have regular, full-time jobs. Consequently, it is sometimes difficult to have an associate judge fill in for Judge Escalante when she is not available. Staff anticipates bringing additional associate municipal court judges to the City Council for consideration so that the court will have coverage in case of Judge Escalante's absence during to vacation, training or illness. Motion made by Council Member Sheley appointing Kelly Benavides, Michael Marks, Oshea Spencer and Andy Helms as Associate Municipal Court Judges. Council Member Mahan seconded the motion. The vote was as follows: Ayes: Council Members Caskey, Mahan, Sheley and Mayor DonCarlos. Nays: None Council Member Capetillo recused himself from the vote, Conflict of Interest Form on file. Motion carried. Considered appointed to the Tow Truck Committee. The Tow Truck committee is appointed by City Council and is composed of five (5) citizens who are not in the tow truck business. The Committee meets quarterly to hear grievances pertaining to enforcement procedures under the tow truck ordinance and to make recommendations to the City Council on policies needed to regulate tow trucks in the City. Appointments are generally made in April and are for two year terms. • Mr. Mitchell Pearce has served as a member of the board since March 8, 2007 and his current term will expire on April 2008. Mr. Pearce desires re-appointment for the term to begin April 2008 and end on April 2010. • Mr. Lee Lombard has served as a member of the board since May 23, 1996 and his current term will expire April 2008. Establishing contact with Mr. Lombard to determine Page 12 of 13 Minutes of the Regular Meeting—April 24, 2008 if he desires to be reappointed has been difficult and he has not returned staffs’ phone calls. This item will be postponed until the May 8, 2008 City Council Regular Meeting. EXECUTIVE SESSION Public notice is given that the City Council may elect to go into executive session at any time during the meeting in order to discuss any matters listed on the agenda when authorized by the provisions of the Open Meetings Act, Chapter 551 of the Texas Government Code, and that the City Council specifically expects to go into executive session on the matters enumerated hereinbelow, if any. In the event the Council elects to go into executive session regarding an agenda item, the section or sections of the Open Meetings Act authorizing the executive session will be publicly announced by the presiding officer. Gray Wetlands Education and Recreation Center will celebrate its 10th anniversary during an public open house. 2008 Arbor Day Celebration The City of Baytown Parks and Recreation Department will celebrate Arbor Day on Friday, April 25, 2008 at the Eddie V. Gray Wetlands Education and Recreation Center. This year's the Parks and Recreation Department will have Live Oak, Loblolly Pine, Bald Cypress, Sawtooth Oak, Texas Green Ash, Burr Oak, Red Oak, Chinese Pistache, Shumard Red Oak, Hackberry and Sweet Gum trees available for public adoption. Over 1,000 one gallon size trees are available this year. The trees will be limited to three (3) trees per person and will otherwise be available on a first-come, first-served basis, while the supplies last. This year, volunteers from NRG Texas' Cedar Bayou Electric Generating Station will be assisting Parks and Recreation employees with the distribution of the trees along with helpful information on how and where to plant the trees. The event will begin at 9 a.m. and continue until 4 p.m. and Saturday from 10 a.m. to 4 p.m. The Wetlands Center is located at 1724 Market Street. Auction On-Line The City of Baytown is currently conducting its first on-line auction of surplus equipment. Staff is utilizing this format since GCCISD is no longer partnering with the city in the Page 13 of 13 Minutes of the Regular Meeting—April 24, 2008 annual auction at Stallworth Stadium. GCCISD has also gone to disposing of all surplus material via on-line auctions. The City of Baytown's current auction runs from April 21st thru May 6th and can be accessed at www.renebates.com.
