Ordinance No. 14,705ORDINANCE NO. 14,705 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, CONTINUING CHAPTER 66 "OFFENSES," ARTICLE IV "CURFEW FOR MINORS" OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. **************************************************************************************** WHEREAS, the City Council of the City of Baytown passed Ordinance No. 10,322 establishing a juvenile curfew in the City of Baytown, Texas, on May 11, 2006; and WHEREAS, pursuant to such ordinance, the City Council found that: 1. there existed a need to prevent any increase in juvenile violence, juvenile gang activity and crime by persons under the age of 18 in the City of Baytown; 2. persons under the age of eighteen were particularly susceptible by their lack of maturity and experience to participate in unlawful and gang -related activities and to be victims of older perpetrators of crime; 3. the City of Baytown had an obligation to provide ➢ for the protection of minors from each other and from persons in the area during nighttime hours, ➢ for the enforcement of parental control of and responsibility for their children, ➢ for the protection of the general public, and ➢ for the reduction of the incidence of juvenile criminal activities; and 4. a curfew for those under eighteen years of age was in the interest of the public health, safety, and general welfare, and would help to attain the foregoing objectives and to diminish the undesirable impact of such conduct on the citizens of the City of Baytown; and WHEREAS, Section 370.002 of the Texas Local Government Code requires a review of the curfew ordinance's effects on the community and on the problems which it was intended to remedy every third year after enactment; and WHEREAS, on April 23, 2009, April 26, 2012, April 23, 2015, and April 26, 2018, the City Council, after reviewing the juvenile curfew ordinance's effects on the community and on problems the ordinance was intended to remedy and after holding two public hearings, continued the juvenile curfew ordinance; and WHEREAS, on April 8, 2021, and on April 22, 2021, the City Council again held public hearings on the need to continue the juvenile curfew ordinance prior to the passage of this ordinance; and WHEREAS, the City Council of the City of Baytown has reviewed the curfew ordinance's effect on the community and on the problems the ordinance was intended to remedy, and finds the ordinance to be meeting the purposes for which it was enacted; NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS: Section 1: All matters and facts set forth in the recitals above are found to be true, and are approved as the processes and procedures which the City Council of the City of Baytown undertook and completed prior to the adoption of this ordinance. Section 2: The City Council of the City of Baytown continues in effect for all purposes Ordinance No. 10,322, which is now codified in Article IV "Curfew for Minors" of Chapter 66 "Offenses" of the Code of Ordinances, Baytown, Texas. Section 3: This ordinance shall take effect immediately from and after its passage by the City Council of the City of Baytown.
