The City Council of the City of Baytown, Texas, met in regular session on
July 10, 1997, at 6:30 p.m., at Lee College, 200 Lee Drive, John Tucker Lecture Hall,

Hold Public Hearings on the Proposed Annexation of an .8957 -Acre Tract at Garth
and Cedar Bayou- Lynchburg Roads at 6:35 p.m.
Mayor Alfaro called the public hearing to order on the proposed annexation of an
.8957 -acre tract at Garth and Cedar Bayou- Lynchburg Roads. He asked everyone who
desired to speak to sign the list at the back of the foyer as the list would provide the
speaking order.
The City Manager said that the property to be annexed was a small tract
purchased by the Hensarling Group where they are constructing a small center. The City
has annexed the four -acre tract where the center will be constructed, and when the .8957 -
acre tract was purchased for additional parking space, annexation was requested.
Since no one had registered to speak, Mayor Alfaro closed the public hearing.
Consider Proposed Ordinance No. 970710 -3, Setting the Time, Date, and Place for a
Public Hearing for July 24 at 6:35 p.m. on a Proposed Ordinance Nominating and
Designating an Area within the Extraterritorial Jurisdiction of the City of Baytown
as The International Group Reinvestment Zone (Property Located at 7106
Highway 146, Chambers County)
Consider Proposed Ordinance No. 970710 -4, Setting the Time, Date, and Place for
Public Hearings for July 24 at 6:40 and 6:45 p.m. on the Proposed Annexation of
Property Located at 7106 Highway 146, Chambers County (The International
Group, Inc.)
Consider Proposed Ordinance No. 970710 -5, Awarding the Contract for the Annual
Sanitary Sewer Rehabilitation Contract
Council will consider these three items at a future date if necessary.
Consider Proposed Ordinance No. 970710 -6, Approving a Three -Year Federal
Grant Award for COPS (Community Oriented Policing Services) Universal Hiring
Grant and Authorizing an Increase in Certified Police Positions
The ordinance approves a grant award and authorizes an increase in certified
police positions. The grant provides 75 percent of the entry level salary and benefits over
three years for new or rehired law enforcement officers. The City furnishes 25 percent
plus the capital. The capital includes five vehicles and equipment and totals
approximately $129,000 which the City will fund out of savings from the current year's
budget. The City will assume the full cost of the program in the year 2001. These
officers will be working neighborhoods to identify problem areas having to do with crime
trends, nuisance abatement, and special needs.

Council Member Byford moved to adopt the ordinance. Council Member Hinds
seconded the motion. In response to inquiry from Council, Police Chief Shaffer stated
that they will use two teams of five officers in order to have coverage for seven days. Out
of a team of five, two will use unmarked cars and three will use marked cars. The vote
follows:

ORDINANCE NO. 8019
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, AUTHORIZING THE CITY OF BAYTOWN,
TEXAS, TO ACCEPT GRANT FUNDS IN THE AMOUNT OF
SEVEN HUNDRED FIFTY THOUSAND AND NO /100 DOLLARS
($750,00.00) FROM THE UNITED STATES DEPARTMENT OF
JUSTICE; INCREASING THE NUMBER OF POSITIONS IN THE
CLASSIFICATION "SERVICE GROUP - POLICE "; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
Consider Proposed Ordinance No. 970710 -7, Awarding Annual Fill Sand Contract
The City received tie bids from Baytown Sand and Clay and Bedrock General
Contractor. Bedrock General Contractor's name was drawn. Council Member Byford
moved to adopt the ordinance awarding the annual fill sand contract to Bedrock General
Contractor. Council Member DonCarlos seconded the motion. The vote follows:

ORDINANCE NO. 8020
AN ORDINANCE ACCEPTING THE BID OF BEDROCK
GENERAL CONTRACTORS, INC., FOR THE ANNUAL FILL
SAND CONTRACT AND AUTHORIZING PAYMENT BY THE
CITY OF BAYTOWN, THE SUM OF EIGHTEEN THOUSAND
FOUR HUNDRED FIFTY AND NO /100 DOLLARS ($18,450.00);
MAKING OTHER PROVISIONS RELATED THERETO; AND
PROVIDING FOR THE EFFECTIVE DATE THEREOF.
Hold Public Hearing on Proposed Extension of the Boundary of Enterprise Zone 1
to include 5.69 acres Bounded by Alexander Drive, Knowlton Street, and Nolan
Road at 6:40 p.m.
Mayor Alfaro opened the public hearing on the proposed extension of the
boundary of Enterprise Zone 1 to include 5.69 acres bounded by Alexander Drive,
Knowlton Street, and Nolan Road. He asked everyone who desired to speak to sign the
list at the back of the foyer as the list would provide the speaking order.
The City Manager said that the developer of Enterprise Zone No. 1 requested that
the boundary be extended to include an additional 5.69 acres adjacent to the enterprise
zone. An assisted living facility for the elderly is planned for the site at a cost of
approximately $7 Million creating approximately thirty full and part time jobs. Being
included in the enterprise zone allows tax incentives and tax credits from the state. The
facility should support the businesses on Highway 146 and will increase the tax base.
Since no one had registered to speak, Mayor Alfaro closed the public hearing.
Consider Proposed Ordinance No. 970710 -1, Authorizing City to Make Application
to the Texas Department of Commerce to Extend the Boundary of Enterprise Zone
Number 1 to include 5.69 acres Bounded by Alexander Drive, Knowlton Street, and
Nolan Road.
The ordinance authorizes the City to apply to the Texas Department of Commerce
to extend the boundary of Enterprise Zone No. 1. Council Member Hinds moved to
adopt the ordinance. Council Member Escontrias seconded the motion. The vote

Consider Proposed Resolution No. 1315, Establishing the Program Limits for the
Housing Rehabilitation Program and the New Construction Program
The resolution establishes program limits for the Housing Rehabilitation Program
of $23,000 and for the New Construction Program of $27,000. The current limit is
$21,000 and $25,000, respectively. The guidelines are being revised to provide
additional insurance protection to the City and the homeowner which will result in
additional costs to the contractors.
Council Member Escontrias moved to adopt the resolution. Council Member
Hinds seconded the motion. The vote follows:

RESOLUTION NO. 1315
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, ESTABLISHING THE PROGRAM LIMITS
FOR THE COMMUNITY DEVELOPMENT HOUSING
REHABILITATION AND NEW CONSTRUCTION PROGRAMS
AND PROVIDING FOR THE EFFECTIVE DATE THEREOF.

Consider Proposed Ordinance No. 970710 -2, Authorizing Placement of Road
Humps on Pin Oak
The City Manager announced prior to consideration of this item by Council that
Council Member Escontrias had been advised by the City Attorney that his participation
in the discussion and vote on this issue could constitute a conflict of interest since the
council member lives on the affected street. He has filed the proper affidavit and will
refrain from discussion and from voting.
The ordinance authorizes the placement of two road humps on Pin Oak: one near
Bayway Drive; the other between Robin and Rollingwood. Stop signs have been
installed at Pin Oak and Robin. Current road humps are four inches in height, and in
discussions with Lakewood residents, Pin Oak residents, and the Civic Association, the
administration has agreed to make the road humps on Pin Oak a little lower in order to
minimize the impact but still serve the function of slowing traffic. There is no guarantee
that an automobile will be able to go over a three -inch hump comfortably, but it will be
less obtrusive than the four -inch hump.

The Growth Management and Development Commission has advised that the
road humps alone do not control speed in residential areas. The commission has
recommended that the road hump program be put on hold until the program has been
analyzed. The City Manager said that an item would be placed on the next agenda to put
the road hump program on hold to allow the Growth Management and Development
Commission time to study the program.
Council Member Hinds moved to adopt the ordinance. Council Member
DonCarlos seconded the motion. In response to inquiry from Council, the City Manager
said that road humps already approved would be constructed, but no action would be
taken on any others. He mentioned that at the Growth Management and Development
Commission meeting after the motion was made and seconded, the maker of the motion,
Don Murray said, "Although not part of the motion, Mr. Rountree should have the city
staff monitor the speed and report to him immediately any change in speed subsequent to
the installation of the road hump. I just think that this is information he would want to
have prior to installing the road humps." The vote follows:

ORDINANCE NO. 8022
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
BAYTOWN, TEXAS, AUTHORIZING THE PLACEMENT OF
TWO ROAD HUMPS ON PIN OAK DRIVE; REPEALING
CONFLICTING ORDINANCES; CONTAINING A SAVINGS
CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE
THEREOF.
Consent Agenda
Council considered the consent agenda items "a" through "f."
a. Proposed Ordinance No. 970710 -8, amends the Water Supply and Waste
Disposal Agreement with Chambers County Municipal Utility District
(MUD) No. 1 to add Sections 3 and 4 of Country Meadows Subdivision.
Since Country Meadows Subdivision lies outside the city and is part of
Chambers County MUD No. 1, they must contract with the City for water

and sewer services. The agreement currently in force provides water and
sewer services for Country Meadows Sections 1 and 2 (100 homes).
Section 3 has been platted, and Section 4 is in the preliminary platting
stage. These sections will add an additional 109 homes for a total of 209
homes. The City has the capacity to serve these developments.
We recommend approval.
b. Proposed Ordinance No. 970710 -9, authorizes final payment to American
Roofing Company for removal and replacement of the roof at the City
Hall Annex in the amount of $9,090. The original contract amount was
$89,400. There was one change order in the amount of $1,500 to provide
roof vent support. The roof has been inspected and approved by Tremco,
our roofing consultant.
We recommend approval.
C. Proposed Ordinance No. 970710 -10, awards the annual fire fighting
protective clothing contract Sections II, III, IV and V, and rejects Section
I, Items 1 and 2. We recommend awarding the contract as follows:
Four Alarm Fire Equipment Sec. II, III, IV & V, Item 98 $3,886.00
Casco Industries, Inc. Sec. V, Item #9 690.00

We recommend rejecting and rebiding Section I, Items #I & #2, bunker gear
in order to develop specifications that better meet the department's current
needs. Invitations to Bid were mailed to two suppliers and we received two
bids.
We recommend approval.
d. Proposed Ordinance No. 9707 10-11, awards the annual cast iron castings
contract to Industrial International, Inc. in the amount of $12,019.80.
Invitations to bid were mailed to six suppliers and we received four bids.
This contract will be used by the Public Works Department for drainage
and sewer maintenance (manhole covers, etc.).
We recommend approval.
C. Proposed Ordinance No. 970710 -12, awards the annual concrete ready
mix contract to Houston Shell & Concrete in the amount of $40,000.
Invitations to bid were mailed to two suppliers and we received two bids.

This contract will be used by the Public Works and Parks and Recreation
Departments for various construction projects including streets, drainage
repair, new projects, and rehabilitation projects.
We recommend approval.
f. Proposed Ordinance No. 970710 -13, awards the bid for a tractor with a
slope mower to Lansdowne Moody Co., Inc., in the amount of $39,997.
Invitations to bid were mailed to four suppliers and we received two bids
and two no -bids. This equipment will be utilized by the Parks and
Recreation Department.
We recommend approval.
Council Member Escontrias moved to adopt the consent agenda items "a" through
'T." Council Member DonCarlos seconded the motion. In response to inquiry from
Council on item "a," the City Manager replied that the residents of Country Meadows pay
the same water rates as the residents of Baytown, because we read one meter. They read
the master meter and send the reading to us. We do not have to go out and read the
individual meters. That is the way that MUD's that have one meter are handled. The
vote follows:

City Manager's Report
Commander of the Year Award
Johnny Erickson, of the Narcotics Task Force, has received an award for Commander of
the Year from the Texas Narcotics Control Program.
July 4 Celebration
The July 4 celebration was very successful. All city departments participated, but the
event was spear headed by the Parks and Recreation Department.
Spur 330
In August the Texas Highway Commission is going to consider funding the Spur 330
phase from Highway 146 north past Exxon with the overpass at Rollingbrook.

Grand Parkway
The City Manager testified in support of the Grand Parkway at the public hearing on
Monday night.
Summer Cleanup
The City is having a summer cleanup July 19 through July 27 on Saturdays, 10:00 a.m. to
3:00 p.m. at the Recycling Center. Residents can bring one pickup load of junk. Water
receipts will be checked. Building materials will be accepted. Tires, oil, appliances with
Freon, or hazardous materials will not be accepted.
Texas Avenue
There was a meeting on Wednesday and everyone seemed to be in agreement, but there
have been several calls today about leaving the planter boxes. This is an important
decision as it will change the face of Texas Avenue.
Budget Process
The administration is in the budget preparation process and will have the budget to
Council by the last day of July. The budget calendar will be set at the next meeting.
Council is asked to consider August 11 through August 15. There is a council meeting on
August 14. Typically, there is a 7:00 a.m. meeting followed by a 4:00 p.m.

Last year's successful bidders failed to exercise their renewal options because they could not hold their pricing firm for another year. New NFPA (National Fire
Protection Association) standards have required manufacturers to meet more stringent guidelines in the design and safety of firefighter protective clothing. More
testing requirements along with material design and chemical treatment have caused the majority of the price increases resulting in a 5% price increase for the
remainder of the items recommended to be awarded.

This year's contract is an overall 45% decrease this year from Last years awarded amount. Percentage decrease is partially due to four items
being deleted from this year's contract for lack of usage by the Utilities Department and Item #2's quantities being reduced from 30 to 10 each.
However, the same items for the same quantities as shown above for last year's contract indicate a 29% decrease. Last year there was a
shortage of scrap cast iron. This year the market has a surplus of scrap iron driving the pricing for cast iron down accounting for the majority of
price decreases.
i Item #9 is for the frame only and #10 is for the cover. The price difference among bidders for Item #9 is a result of the frame and cover priced
