MINUTES OF THE REGULAR SESSION
OF THE CITY COUNCIL OF THE CITY OF BAYTOWN
November 12, 1996
The City Council of the City of Baytown, Texas, met in regular session on,
November 12, 1996, at 6:15 p.m., in the Council Chamber of the Baytown City
Hall, with the following in attendance:

The meeting was opened with a quorum present, and Council Member
Pruett offered the invocation, after which the following business was conducted:
Consider Approval of Minutes for the Regular Session held on October 24,
1996
Council Member Hinds moved to approve the minutes for the regular
session held on October 24, 1996. Council Member Escontrias seconded the
motion. The vote follows:

Housing Authority of the City of Baytown -- Award Presentation
The Housing Authority of the City of Baytown (BHA) was presented with a
Certification of Excellence in Management Award by the U.S. Department of
Housing and Urban Development (HUD) for Achieving High Performer Status for
the 1995 federal fiscal year. Mr. George Rodriguez, the Director of the Houston
Area HUD office, presented the award to BHA. Mr. John LeFebre, Chairman of
the Board of BHA, accepted the award for BHA. The agency earned High
Performance status as measured by standards established through HUD's
Public Housing Management Assessment Program. This program requires
housing authorities to measure and report specific management functions on an
annual basis to determine if the agency is performing at an acceptable level.
During the last three years BHA has been evaluated as High Performer.
Agencies with High Performer status are given a greater degree of flexibility in
making decisions and are free from many reporting requirements that are
normally imposed on housing agencies by HUD. The agency is hopeful that this
designation will strengthen their ability in obtaining competitive grant awards.
Consider Proposed Ordinance No. 961112 -1, Amending Chapter 11-1/4
"Emergency Management And Preparedness," By Adding Article 11,
"Hazardous Substances, Liquids And Gas Pipelines," To Provide Policies
And Procedures For Registration And Permitting Of Pipelines Within The
City Limits Of Baytown
This ordinance requires each owner or operator of an existing pipeline
located within the City of Baytown or five thousand feet therefrom to register
each of its pipelines. All new pipelines must be permitted. Whether a pipeline is
registered or permitted, the same information is required to be submitted to the
City. Such information includes emergency contact personnel, origin and
destination points of the pipelines, the substances transported, maximum and
normal operating pressures, and other similar information believed necessary to
protect the citizens of Baytown. The ordinance will assist construction projects
located near the pipelines. The administration has worked with pipeline
companies in drafting this ordinance to ensure that it is administratively feasible
for the pipeline companies and that it provides the necessary information to the
City for emergency response and construction purposes.

Consider Approval Of Plans And Specifications For Airhart Sidewalk And
Kentucky Drainage Project And Authorizing Advertisement For Bids
This project includes the construction of a sidewalk on the east side of
Airhart Drive from Market Street to South Clyde and piping of the ditch between
Market and J. B. LeFevre. The project also includes installation of curb and
gutter on Kentucky between Utah and Carolina and replacement of curb and
gutter at Kentucky and Alabama. The project will be financed through
Community Development Block Grant funds at an estimated cost of $150,000.
Council Member Byford moved to approve the plans and specifications
and to authorize advertisement for bids. Council Member Benavides seconded
the motion. The vote follows:

Consent Agenda
Council considered the consent agenda items "a" through "f' as follows:
a. Proposed Resolution No. 1294, authorizes the City Manager to
make application to the Criminal Justice Division of the Governor's
Office for Texas Narcotics Control Program funds in the amount of
$2,923,606. It also authorizes the City Manager to sign
interagency agreements with the nine participating agencies. This
is our eighth year to apply. This will be for the period of June 1,
1997 to May 31, 1998, and will be submitted as a 75 % -25% grant.
The City of Baytown's match for this grant will be $68,300. The
other participating agency's match will be $506,241, and the
program income will be $452,672. The annual budget, which
includes the grant request, program income, the City of Baytown's
match, and the participating agencies match, totals $2,923,606.
We recommend approval.

b. Proposed Ordinance No. 961112 -2, authorizes payment of the
Texas Natural Resource Conservation Commission's annual waste
treatment fees in the amount of $27,050. The waste treatment fee,
assessed annually, is imposed on each permittee holding a permit
under the Texas Water Code, Chapter 26. The fees pay the
expenses of the Commission to administer water quality programs,
consistent with the provisions of the Texas Water Code, Chapter
26, the rules and orders of the Commission, and the provisions of
Commission permits governing waste discharges and waste
treatment facilities. Calculations are based on the daily average
flow limits and permitted parameters of each treatment plant.
We recommend approval.
C. Proposed Ordinance No. 961112 -3, authorizes payment of annual
water quality assessment fees by the Texas Natural Resource
Conservation Commission in the amount of $17,167.50. These
fees fund a state program to assess the quality of the river basins
of the state. This is being done in response to the Clean Water Act
on the federal level. The fees pay for testing and engineering work
that is required.
We recommend approval.
d. Proposed Ordinance No. 961112 -4, awards the annual sludge
disposal contract to Rustin Transportation in the amount of
$130,080, which is the same price currently being paid. Invitations
to Bid were mailed to four companies and we received one bid and
three no bids. This contract is used for the collection, hauling, and
disposal of processed sewage sludge at each of the three
wastewater treatment plants. The contract is based on disposal of
9,600 cubic yards.
We recommend approval.
e. Proposed Ordinance No. 961112 -5, authorizes a housing
rehabilitation contract at 706 E. Gulf with Colts Development in the
amount of $17,735. Rehabilitation includes reconstruction of one
wall due to termite damage, floor coverings, constructing rear
porch, hot water heater closet, electrical and plumbing systems,
HVAC unit, and roofing. Six bid packages were picked up and two
were returned. The office estimate was $17,589.23.
We recommend approval.

f. Consider rejection of the annual contract for the Senior Citizens'
Taxi Program. Competitive bids were solicited for provision of the
Senior Citizens' Taxi Program, which serves approximately 700
income eligible senior citizens. Two bids were received; neither
met specifications. The specifications were revised and will be
rebid. The schedule is to receive bids on November 22 and
prepare a recommendation to council for the November 26
meeting.
We recommend approval.

City Manager's Report
Trip to Texas Department of Transportation in Austin
The trip will be by bus on November 21, at 5:00 a.m. The bus will leave
from the northeast corner of the mall parking lot. The bus will return mid-
afternoon.
Citizen's Fire Academy Banquet
The Citizen's Fire Academy Banquet will be held Tuesday, November 19,
at Luna's.

The City Council of the City of Baytown, Texas, met in special session on
November 12, 1996, at 5:30 p.m., in the Don M. Hullum Conference Room of the
Baytown City Hall, with the following in attendance:

recessed into executive session pursuant to Section 551.071 of the Texas
Government Code to discuss contemplated litigation concerning the proposed
pipeline ordinance.
When the open meeting reconvened, Mayor Alfaro announced that no
action was necessary as a result of the executive session.

There being no further business to be transacted, the meeting was
adjourned.
