Hall Council Member Council Member Council Member Council Member Council Member Council Member Mayor City Manager City Attorney City Clerk The meeting was opened with a quorum present, and Council Member Byford offered the invocation, after which the following business was conducted: Consider Approval of Minutes for the Regular Session held on September 26, 1996 Council Member Benavides moved to approve the minutes for the regular session held September 26, 1996. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None la 961010 -2 Minutes of the Regular Meeting - October 10, 1996 Consider Proposed Ordinance No. 961010 -1, Amending Chapter 11% "Emergency Management and Preparedness," by Adding Article II, "Hazardous Substances, Liquids and Gas Pipelines," to Provide Policies and Procedures for Registration and Permitting of Pipelines within the City Limits of Baytown This item will be considered at a future meeting. Consider Proposed Ordinance No. 961010 -2, Amending Agreement for Engineering services with Wayne Smith & Associates, Inc. for Developing a Master Plan of the East District Sewer System Council Member Byford moved to adopt the proposed ordinance; Council Member Pruett seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7815 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF BAYTOWN, TEXAS, APPROVING AMENDMENT NO. 6 TO THE AGREEMENT FOR ENGINEERING SERVICES BETWEEN THE CITY OF BAYTOWN AND WAYNE SMITH & ASSOCIATES, INC., FOR THE DEVELOPMENT OF A MASTER PLAN OF THE EAST DISTRICT SEWER SYSTEM IN THE AMOUNT OF SEVENTY - EIGHT THOUSAND ONE HUNDRED AND NO /100 DOLLARS ($78,100.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 961010 -3, Authorizing a Land /Tax Agreement and an Earnest Money Contract with Charles Nickel, Individually and as Independent Executor of the Estate of Lola Blake, Kathryn Bayne, H. Busch Enterprises, Inc., Robert Harris Edmundson, Individually and as Independent Executor of the Estate of Dorothy R. Edmundson, and Dorothy Jean Edmundson This item will be discussed at a future meeting. 961010 -3 Minutes of the Regular Session - October 10, 1996 Council considered the Consent Agenda items "a" through "g" as follows: a. Proposed Ordinance No. 961010 -4, renews our subscription with McNaughton Book Service in the amount of $33,756.99 for the period of December 1996 through November 1997. This service will provide 202 new books per month and a core collection of 4,040. This is a base subscription which provides popular new fiction and non - fiction titles which are already catalogued and processed, allowing the public to read bestsellers promptly. We recommend approval. b. Proposed Ordinance No. 961010 -5, authorizes a housing rehabilitation contract for 102 Booker Street to Investment Group in the amount of $19,100. Five bid packages were picked up and two were returned. Rehabilitation will include installation of complete exterior walls, insulation, vinyl siding, windows, new roof, decking, attic stairway, electrical and plumbing systems, three doors, and floor coverings. The office estimate was $20,009.37. We recommend approval. C. Proposed Ordinance No. 961010 -6, authorizes a housing rehabilitation contract for 105 Graham Street to Investment Group in the amount of $17,280. Five bid packages were picked up and two were returned. Rehabilitation will include new windows, subflooring and floor coverings, electrical and plumbing services, roofing and decking, and complete foundation work. Repairs include the sheetrock, and Bedroom #3 is to be rebuilt. The office estimate was $19,507.56. We recommend approval. d. Proposed Ordinance No. 961010 -7, authorizes an annual payment on a sole source basis to Fedscan LTD for Versaterm Systems for Police Software Maintenance and Support in the amount of $15,900. We recommend approval. 961010 -4 Minutes of the Regular Session - October 10, 1996 e. Proposed Ordinance No. 961010 -8, renews our annual mowing, edging and trimming contract with Niederhofer Enterprises, Inc. in the amount of $31,125. This is the first year to renew this contract and will include litter removal prior to mowing, weed control of beds, trimming, edging, and mowing of parks. The contract includes seventeen small high maintenance areas such as Briarwood Park, Pelly and Defee Triangles, Thomas Plaza (intersection of Texas Avenue, Lee Drive and Decker Drive), Roosa Pavilion area, McLemore Substation, etc. We recommend approval. f. Proposed Ordinance No. 961010 -9, approves a contract with the Baytown Opportunity Center for thoroughfare litter removal and park cleaning in the amount of $42,000. This contract provides a 12 month program of litter removal for approximately 30 miles of major streets. It covers litter and janitorial cleanups at the Gray Sports Complex, cleanup at Bicentennial Park following the July 4`h Celebration, and cleanup of public restrooms at Unidad Park and the Jo Roosa Pavilion. The Director of the Baytown Opportunity Center has reviewed and approved the contract. We recommend approval. g. Proposed Ordinance No. 961010 -10, authorizes the renewal of an industrial district agreement between the City and Advanced Aromatics, L.P. for an additional seven year term. Their contract expired in August 1996. We recommend approval. Council Member Escontrias moved to adopt the Consent Agenda Items "a" through "g." Council Member Benavides seconded the motion. ORDINANCE NO. 7816 AN ORDINANCE AUTHORIZING THE PAYMENT OF THIRTY - THREE THOUSAND SEVEN HUNDRED FIFTY -SIX AND 99/100 DOLLARS ($33,756.99) TO McNAUGHTON BOOK SERVICE AS THE COST FOR BOOK LEASING OF POPULAR NEW TITLES FOR THE STERLING MUNICIPAL LIBRARY; MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Confirmation of Mayor's Appointment to Parks and Recreation Advisory Board Council Member Escontrias moved to confirm the Mayor's appointment of Tony Fama to the Parks and Recreation Advisory Board. Council Member Hinds seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None foll", 961010 -7 Minutes of the Regular Session - October 10, 1996 City Manager's Report TxDOT Meeting in Austin The city staff will be going to Austin on November 21 to meet with the Texas Department of Transportation regarding Decker Drive. November Council Meetings The City Manager stated the at the last council meeting the November 14 "' meeting was changed to November 12. The Chamber of Commerce requested that date be changed because of their Annual Public Safety Awards Banquet on November 12. After discussion, Council requested the administration to schedule the meeting on November 12 before the Public Safety Awards Banquet. Comments From Council Council Member Pruett noted that the Golf Course will be open for play on November 1. A ribbon cutting will be held later.
