1996 09 26 CC MinutesMINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN September 26, 1996 The City Council of the City of Baytown, Texas, met in regular session on September 26, 1996, at 6:30 p.m., in the Council Chamber of the Baytown City Hall, with the following in attendance: Eva Benavides David Byford Manuel Escontrias E. Frank Hinds, Jr. Stephen DonCarlos Rolland J. Pruett Council Member Council Member Council Member Council Member Council Member Council Member Pete C. Alfaro Mayor Bobby Rountree City Manager Ignacio Ramirez City Attorney Eileen P. Hall City Clerk The meeting was opened with a quorum present, and Council Member Benavides offered the invocation, after which the following business was conducted: Hold Public Hearings on Proposed Annexation of a 6 -Acre Tract, South of Truck Stops of America at Interstate Highway 10 on Thompson Road at 6:31 P.M. Mayor Alfaro called to order the public hearing concerning the annexation of a 6 -acre tract out of the Clyde McConnell Harper Estate south of Truck Stops of America at Interstate Highway 10 on Thompson Road, and asked those present desiring to speak to register on the list provided in the lobby as that list would provide the speaking order for the hearing. He stated that the hearing was for the purpose of receiving public input with regard to the annexation and everyone desiring to present information at the hearing would be given ample opportunity to speak. However, he encouraged each speaker to be as brief and to the point as possible, noting that the hearing was not an adversarial 960926 -2 Minutes of the Regular Session - September 26, 1996 proceeding but an opportunity for all interested persons to be heard. He asked that all questions be directed to him, and he stated that, with the aid of City staff, he would attempt to answer the questions. The City Manager stated that the property has access to water and sewer and will require no additional city services. Since no one had registered to speak, the Mayor closed the public hearing. Consider Approval of Minutes for the Regular Session Held on September 12, 1996 Council Member Benavides moved to approve the minutes for the regular session held September 12, 1996. Council Member Escontrias seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds and Pruett Mayor Alfaro Nays: None Abstained: Council Member DonCarlos 960926 -3 Minutes of the Regular Session - September 26, 1996 Consider Proposed Ordinance No. 960926 -1, Amending Chapter 3 -112 "Alarms ", Section 3 -112 - 4, "Permit Issuance and Renewal" of the Code of Ordinances The ordinance amends the alarm ordinance by making residential permits valid as long as the permit holder owns the property. If ownership of the property changes, it will be necessary to update the permit. Business permits would continue to expire after one year. All residential permits issued before the effective date would be grandfathered and would expire upon sale of the property. Council Member DonCarlos moved to adopt the ordinance. Council Member Benavides seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7809 AN ORDINANCE AMENDING CHAPTER 3 -112 "ALARMS," SECTION 3 -112 - 4 "PERMIT ISSUANCE AND RENEWAL" OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE PUBLICATION AND EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 960926 -2, Amending our Agreement for Engineering Services with Langford Engineering, Inc. for Oversizing the Lift Station and Force Main from the New Lakewood Estates Subdivision to the West District Wastewater Treatment Plant The ordinance amends our agreement for engineering services with Langford Engineering, Inc. in the amount of $30,000. The sanitary sewer in the northern end of the Lakewood area flows south to the old Steinman Lift Station and is pumped back north to the West District Plant. There are some problems in the Lakewood Drive - Greenbriar area during rainfalls. Lakewood Estates is a new subdivision being built along the Decker Drive area. The developer is going to construct a force main to the West District Plant. The administration is asking Langford to develop the plans to oversize the lift station and the force main so that, in the future, the northern portion of Lakewood can be connected to the force main and pumped to the West District Plant to clear the bypass situation in 960926 -4 Minutes of the Regular Session - September 26, 1996 the Greenbriar area. This phase is for oversizing the lift station and the force main at an estimated cost of $300,000. The next phase will be connecting the northern portion of Lakewood to the force main. Council Member Escontrias moved to adopt the ordinance. Council Member Benavides seconded the motion. The vote follows: Ayes: Council Members Benavides, Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7810 AN ORDINANCE AMENDING THE AGREEMENT FOR ENGINEERING SERVICES BETWEEN THE CITY OF BAYTOWN AND LANGFORD ENGINEERING, INC., FOR THE LAKEWOOD SANITARY SEWER DIVERSION PROJECT IN THE AMOUNT OF THIRTY THOUSAND AND NO /100 DOLLARS ($30,000.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 960926 -3, Repealing Ordinance No. 7342, and Authorizing Engineering Services Agreement with Wayne Smith & Associates for Sanitary Sewer Line Rehabilitation in the Glen Arbor and Fair Park Subdivisions No action was necessary on this item. Consent Agenda: Council considered the consent agenda items "a" through "d" as follows: a. Proposed Ordinance No. 960926 -4, authorizes the purchase of an ambulance from H -GAC in the amount of $109,453.50 including an H- GAC administrative fee of $1,882.50. We recommend approval. b. Proposed Ordinance No. 960926 -5, authorizes a 51 -month lease of a Pitney Bowes mailing machine from the State Purchasing and General Services Commission contract in the amount of $71,037. The total 960926 -5 Minutes of the Regular Session - September 26, 1996 cost for the first twelve months will be $19,116. The total for the next 39 months will be $51,921 including maintenance fees and meter rental. The current lease payment is $1,869 per month. This lease totals $1.923 monthly; however, the Paragon Mail Center 2000 provides a report printer for charge tasks, an electronic scale for mail over 16 ounces up to 30 pounds, a stacking tray, and an electronic folder which are features that are not available with the existing system. We recommend approval. c. Proposed Ordinance No. 960926 -6, awards the annual water meter contract as follows: Section I Master Meter, Inc. $41,657.50 Section II Industrial International 16.519.87 Total $58,177,37 Invitations to Bid were mailed to seven companies. We received four bids and one no -bid. This contract is for velocity -type small water meters and turbine -type water meters to be installed by the Public Works Department. We recommend approval. d. Proposed Ordinance No. 960926 -7, awards the bid for playground equipment as follows: Invitations to Bid were mailed to six bidders and we received three bids. One modular play unit will be installed at J.C. Holloway Park. The additional units will be placed various parks as needed. Item 1 Gametime, Inc. $14,276.00 Item 2 Gametime, Inc. 9.282.00 Total $23,558.00 We recommend approval. City Manager's Report Baytown Fire and Rescue Service The International Association of Fire Chiefs presented a certificate to the Baytown Fire and Rescue Service in recognition of its work to keep the community free of deaths from fire in the year of 1995. Bond Committee The Bond Committee will reconvene in October. November Council Meetings Since the Texas Municipal League meeting and Thanksgiving both fall in November, the meetings for that month will be on the second and fourth Tuesdays, November 12 and 26 instead of the second and fourth Thursdays.
