1996 08 08 CC MinutesMINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN August 8, 1996 The City Council of the City of Baytown, Texas, met in regular session on August 8, 1996, at 6:30 p.m., in the Council Chamber of the Baytown City Hall, with the following in attendance: David Byford Council Member Manuel Escontrias Council Member E. Hall City Clerk Absent: Eva Benavides Council Member The meeting was opened with a quorum present, and Council Member Escontrias offered the invocation, after which the following business was conducted: Consider Approval of Minutes for the Regular Meeting Held on July 25, 1996 Council Member Escontrias moved to approve the minutes of the regular meeting held on July 25, 1996. Council Member Byford seconded the motion. The vote follows: Ayes: Council Members Byford, Escontrias, and Pruett Mayor Alfaro Nays: None Abstained: Council Members Hinds and DonCarlos 960808 - -2 Minutes for Regular Session - August 8, 1996 Consider Proposed Ordinance No. 960808 -1 Accepting Proposal for Code of Ordinances Recodification Proposals were mailed to four codifiers, and we received four proposals. The process of sealed competitive proposals does not allow for pricing to be revealed to the public until after the contract is awarded. Council Member DonCarlos moved to adopt the ordinance. Council Member Hinds seconded the motion. The vote follows: Ayes: Council Members Byford, Escontrias, Hinds, DonCarlos, and Pruett Mayor Alfaro Nays: None ORDINANCE NO. 7766 AN ORDINANCE ACCEPTING THE PROPOSAL OF MUNICIPAL CODE CORPORATION FOR THE CODE OF ORDINANCES RECODIFICATION AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF ELEVEN THOUSAND AND NO/100 DOLLARS ($11,000.00); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consent Agenda Council considered the consent agenda items "a" through "g." a. Proposed Ordinance No. 960808 -2 awards the annual electrical services contract to Gulf Coast Electrical Services in the amount of $23,950.00. Invitations to bid were mailed to four companies. We received two bids and one no bid. This contract is used by all departments for electrical services regarding emergencies, bucket truck service, and miscellaneous electrical services. Section I is primarily used by the Parks and Recreation Department. This is the third year for this contract. We recommend approval. 960808 --3 Minutes for Regular Session - August 8, 1996 b. Consider rejection of bids for the annual battery contract. Invitations to bid were mailed to six companies, and we received two bids. This contract is used by all departments, the majority of which is used by the Equipment Services Garage inventory. Stewart and Stevenson and Interstate Battery were unable to meet reserve capacity specifications. Other suppliers overlooked the bid opening. We recommend this annual contract be rejected, rebid, and the specifications be revised to solicit additional bidders. We recommend rejecting all bids. C. Proposed Ordinance No. 960808 -4 amends the interlocal agreement for the Harris County Organized Crime and Narcotics Task Force to allow the City of Houston toe perform all crime lab services. The proposed amendment authorizes the Houston Police Department Crime Lab to perform all drug analysis, storage, preservation, and court- ordered destruction of illicit drugs and narcotics seized and submitted by the task force. The City of Houston would be reimbursed $34,290 for these services to be paid out of grant funds. We recommend approval. d. Proposed Ordinance No. 960808 -5 amends the agreement with Busch, Hutchison & Associates, Inc. for engineering and architectural services to include renovation of the boat ramps at Roseland Park in the amount of $33,012.20. The City approved bonds in 1991 for the renovation of these boat ramps and has been awarded a grant from the Texas Parks and Wildlife Department. Plans and specifications should be completed by the end of August. Construction is planned to begin in November with completion expected in January 1997. The estimated cost of construction is $337,000. We recommend approval. e. Proposed Ordinance No. 960808 -6 amends Ordinance No. 7756 to establish a maximum prima facie speed limit of 20 miles per hour for DeZavala Elementary. This school zone was inadvertently left out of the ordinance adopted by council at the last meeting. The amended time schedule for the school district requires the posted school speed zone to be amended as follows: 960808 --4 Minutes for Regular Session - August 8, 1996 School Speed Zones Elementary 7:00 - 8:00 a.m. 3:00 - 4:00 p.m. We recommend approval. f. Proposed Ordinance No. 960808 -7 amends Chapter 25 -112 "Standard Sign Code," Section 25 -112 - 10. 'Off - Premise Sign Provisions," Subsections (c), (d), (e), (f), and (g) of the Code of Ordinances. This amendment clarifies that the provisions relating to the off - premise signs are applicable only to the extent off - premise signs are allowable in the City of Baytown. We recommend approval. g. Consider Proposed Ordinance no. 960808 -8 authorizes an Industrial District Agreement with Chevron Chemical Company. The City entered into an industrial district agreement with Chevron in May 1989 for a term of seven years. Such contract has now expired; however, both parties desire to enter into another industrial district agreement for an additional seven year period. The agreement is advantageous to both the City and Chevron as the City will receive an industrial district and Chevron derives both direct and indirect benefits from the municipal services provided by the City. This agreement is in accord with the Industrial District Policy adopted by Council in July 1995. We recommend approval. Council Member Escontrias moved to approve the consent agenda as recommended. Hullum Conference Room of the Baytown City Hall, with the following in attendance: David Byford Council Member Manuel Escontrias Council Member E. Frank Hinds, Jr. Council Member Stephen DonCarlos Council Member Rolland J. Pruett Council Member Pete C. Alfaro Mayor Bobby Rountree City Manager Ignacio Ramirez City Attorney Eileen P. Hall City Clerk Absent: Eva Benavides Council Member The meeting was opened with a quorum present after which the following business was conducted: Consider Appeal of Tex -Cal Investments, Inc., Concerning the Decision of the Urban Rehabilitation Standards Review Board of the City of Baytown to Demolish Buildings Numbered 2, 4, 8, 22, 28, 29, and 33 Located at 1601 Garth Road, Baytown, Texas Mayor Alfaro called the appeal hearing to order and stated that this hearing was being held at the request of Mr. Alfred J. Antonini, President of Tex -Cal Investments, Inc. The City Manager recomended, upon the request of Mr. Antonini, that the hearing be postponed for thirty days in order to meet the following conditions: The buildings at Woodcreek Village Apartments are to be secured by fencing or boarding up to make them safe for the public. Furnish a $100,000 bond guaranteeing performance. 960808 -1 Minutes of the Special Session - August 8, 1996 Work out a plan detailing work to be completed with detailed time schedules. After securing the buildings, furnishing the bond, and supplying the plan to the City, the following conditions must be met: 120 days to repair foundations and some major problems on four of the buildings along with some demolition. After that major work is done, ninety days to rebuild the office and renovate the exteriors of the remaining buildings. In response to inquiry from Council, Mr. Antonini stated that Woodcreek Village consisted of 301 units, with approximately 80 to 90 leased. Five or six units are ready for lease. Mr. Bill Gidley, Chairman of the Urban Rehabilitation Standards Review Board, stated that he thought the thirty days was reasonable as specified by the administration. The City Manager assured Council that in thirty days the administration would have this matter on the agenda for a hearing and possible demolition or would have a written agreement for renovation with security for the City. There being no other individuals desiring to speak and no further inquiry from Council, Mayor Alfaro declared the hearing to be closed subject to being reconvened no later than thirty days.
