1996 06 27 CC MinutesMINUTES OF THE REGULAR SESSION OF THE CITY COUNCIL OF THE CITY OF BAYTOWN June 27, 1996 The City Council of the City of Baytown, Texas, met in regular session on June 27, 1996, at 6:30, in the Council Chamber of the Baytown City Hall, with the following in attendance: Eva Benavides E. Council Member DonCarlos seconded the motion. The vote follows: Ayes: Council Members Benavides, Escontrias, Hinds, DonCarlos, and Pruett Nays: None 960627 -2 Minutes for Regular Session - June 27, 1996 Hold Public Hearing on the Proposed Annexation of a 9.8099 -Acre Tract out of the Clyde McConnell Harper Estate, East of Thompson Road and South of Interstate 10 (Near Truckstops of America) at 6:31 P.M. Mayor Pro Tempore Escontrias called to order the public hearing concerning the annexation of the 9.8099 -acre tract out of the Clyde McConnell Harper Estate located east of Thompson Road and south of Interstate 10 and asked those present desiring to speak at this hearing to register on the list provided in the lobby as that list would provide the speaking order for the hearing. He stated that the hearing was for the purpose of receiving public input with regard to the proposed annexation, and everyone desiring to present information at the hearing would be given ample opportunity to do so. However, he encouraged each speaker to be as brief and to the point as possible, noting that the hearing was not an adversarial type proceeding, but an opportunity for all interested persons to be heard. He asked that all questions be directed to him, and he stated that with the aid of City staff, he would attempt to answer the questions. This area is on Interstate 10 near Thompson Road. The property is approximately ten acres adjacent to the San Jacinto River Authority Canal. It is Humble Truck and Trailer Repair facility. No additional city services will be necessary. It will be in Fire District No. 5 and Police District No. 1. Since no one had registered to speak, the public hearing was closed. Consider Proposed Ordinance No. 960627 -2, Accepting Proposal for Bank Depository Services Contract Two proposals were received. Baytown State Bank has the current contract and was the low bidder again. Nations Bank was the second low bidder. The estimated total amount is $46,478.90. Council Member Benavides moved to adopt the ordinance. Council Member Hinds seconded the motion. The vote follows: Ayes: Council Members Benavides, Escontrias, Hinds, and DonCarlos Nays: None Abstained: Council Member Pruett rw 960627 -3 Minutes for Regular Session - June 27, 1996 ORDINANCE NO. 7734 AN ORDINANCE ACCEPTING THE PROPOSAL OF BAYTOWN STATE BANK FOR THE BANK DEPOSITORY SERVICES CONTRACT AND AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN, THE SUM OF FORTY -SIX THOUSAND FOUR HUNDRED SEVENTY -EIGHT AND 901100 DOLLARS ($46,478.90); MAKING OTHER PROVISIONS RELATED THERETO; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Ordinance No. 960627 -1, Amending Chapter 25 -112 "Standard Sign Code," Section 25 -112 -10 "Off- Premise Sign Provisions" of the Code of Ordinances This ordinance prohibits all off - premise signs from being erected within the city limits after the date the proposed ordinance is passed. The amendment does not affect any off - premise signs which have been properly permitted prior to the 960627 -4 Minutes for Regular Session - June 27, 1996 date of the passage of the ordinance or those proposed within two hundred feet of Interstate 10 after the passage of the ordinance. A survey of eighteen cities in this area revealed that ten of eighteen cities did not allow off - premise signs. Mr. Stan Reid, 214 South Main, spoke to Council in opposition to the proposed amendment. Mr. Shawn McGuire, 3228 Indiana; Ms. Denise Howard, 3228 Indiana; Mr. Mery Rosenbaum, 423 Willow Lane, Ms. Janet Simon, 301 Post Oak; Mr. Joe Simon, 301 Post Oak, and Mr. Wayne Hanson, 111 Caldwell, spoke to Council in support of the proposed ordinance. In response to inquiry from Council, the Assistant City Attorney stated that a billboard damaged by weather could be repaired, but not enlarged, unless the damage was greater than fifty percent, in which case, it would be necessary to apply for a new permit. Council Member DonCarlos moved to adopt the ordinance. Council Member Benavides seconded the motion. The vote follows: Ayes: Council Members Benavides, Escontrias, Hinds, DonCarlos, and Pruett Nays: None ORDINANCE NO. 7735 AN ORDINANCE AMENDING CHAPTER 25 -112 "STANDARD SIGN CODE," SECTION 25 -112 - 10 "OFF- PREMISE SIGN PROVISIONS" OF THE CODE OF ORDINANCES OF THE CITY OF BAYTOWN, TEXAS; PROVIDING A REPEALING CLAUSE; CONTAINING A SAVINGS CLAUSE; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Council Member Benavides commented that in connection with Baytown's image, it is important that the Fred Hartman Bridge be kept clean. 960627 -5 Minutes for Regular Session - June 27, 1996 Consider Proposed Ordinance No. 960627 -3, Repealing Ordinance No. 7646 Passed on March 14, 1996 Which Approved Change Order No. 6 and Authorizing Change Order Nos. 10, 11, and 12 to the Public Works Municipal Service Center Construction Contract with Durotech, Inc. This ordinance repeals Ordinance No. 7646 dated March 14, 1996, which approved Change Order No. 5 and authorizes Change Order Nos. 10, 11, and 12 for a total of $8,341. Change Order No. 5 was unnecessary. Change Order No. 10 upgrades the Formica. Change Order No. 11 provides for replacing an existing beam which was deteriorating. Change Order No. 12 provides for additional roof support. The total change orders are $21,169.35 which is less than one percent of the original contract amount of $2,214,100. Council Member Pruett moved to adopt the ordinance. Council Member Hinds seconded the motion. The vote follows: Ayes: Council Members Benavides, Escontrias, Hinds, DonCarlos, and Pruett Nays: None ORDINANCE NO. 7736 AN ORDINANCE REPEALING ORDINANCE NO. 7646 PASSED ON MARCH 14,1996; AUTHORIZING CHANGE ORDER NOS. 10, 11, AND 12 WITH DUROTECH, INC., FOR THE MUNICIPAL SERVICE CENTER PROJECT; AUTHORIZING PAYMENT BY THE CITY OF BAYTOWN THE SUM OF EIGHT THOUSAND THREE HUNDRED FORTY -ONE AND NO1100 DOLLARS ($8,341.00); AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consider Proposed Resolution No. 1282, Establishing a Casual Dress Code for Summer Council Sessions The resolution establishes a casual dress code for summer council sessions. The proposed resolution establishes June 21 through September 22 as the period of casual dress for Council members. The resolution does not apply to City employees. Council Member Pruett moved to adopt the resolution. Council Member Hinds seconded the motion. ESTABLISHING A CASUAL DRESS CODE FOR THE COUNCILMEMBERS DURING SUMMER COUNCIL SESSIONS; AND PROVIDING FOR THE EFFECTIVE DATE THEREOF. Consent Agenda Council considered items "a" through "c" as follows: a. Proposed Ordinance No. 960627 -4, awards the bid for a truck mounted jet rodder and a trailer mounted sewer cleaner (jet wash trailer) to Underground, Inc. in the amount of $73,495. Invitations to Bid were mailed to two companies and we received two bids. This equipment will be used by the Public Works Department. We recommend approval. b. Proposed Ordinance No. 960627 -5, authorizes final payment in the amount of $44,027 to P.M. Construction Company for the Wright Sanitary Sewer Repair Project. This project included replacing 900 feet of 6 -inch clay sewer with 6 -inch density polyethylene pipe (HDPE) using the pipe bursting method. The pipe lies between Wright and Sterling Streets from Fourth Street to Seventh Street. The bid amount was $43,900. There was an overrun on the project of $127. We recommend approval. C. Proposed Resolution No. 1283, authorizes the City Manager to make application for Solid Waste Management grants through the Houston - Galveston Area Council of Governments for a yard waste management grant and an enforcement grant in the amount of $181,648. The enforcement grant is to purchase three vehicles, four radios, salary, and supplies in the amount of $61,648. We recommend approval. For bid tabulation, see Attachment "A."
